HomeMy WebLinkAbout20030410.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DONALD FUCHS FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Donald Fuchs, VI #0200594, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of February, 2003, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Donald Fuchs, property owner, was present at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. I have scheduled a meeting with the Board of County Commissioners on February 11, 2003, at 10:00 a.m., to consider the violations occurring on the property. The above mentioned property is in violation of the following Section(s)of the Weld County Code: Chapter 23,Article III, Div 1 "A(Agricultural) Zone District" Section 23-3-20 "Uses allowed by right." Section 23-3-20.A "One (1) Single-Family Dwelling Unit and Auxiliary Quarters per legal lot" Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV, Division 3 of this Chapter." Section 23-3-30 "Accessory uses." Section 23-3-30.1 "Noncommercial junkyard." Section 23-3-40 "Uses by special review." Section 23.3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts, provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions. PUD development proposals shall not be permitted to use the special review permit process to develop." Chapter 23, Article IV, Div 3 "Mobile Homes -No mobile home may be located or relocated in the County after August 25, 1981, except in accordance with this Division,including the issuance of any zoning permit which maybe required by this Section. Each mobile home located or relocated in the County after said date must have a building permit for a mobile home issued pursuant to Chapter 29 of this Code...." To bring the property into compliance: Based upon the agreement that we had made during a meeting held October 21,2002 we discussed the violations regarding the addition of mobile homes. Yet,it has been brought to our attention through several different sources that this is still occurring. All mobile homes shall be immediately removed from the property. Additionally, all items considered to be a part of a "Noncommercial Junkyard" shall as well be immediately removed and/or screened from all adjacent properties and public rights- of-ways. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. To bring your property into compliance with the Weld County Code: Since demolition of the mobile homes would indicate the authorization of mobile homes to be added and simply demolished. The demolition of the mobile homes is considered a commercial endeavor. Therefore, all of the illegal mobile homes shall be removed. Unless a mobile home has a valid Zoning and Building permit,they shall be removed from the site. The acceptance of additional mobile homes is considered a commercial business and is not a use allowed by right in a recorded town site. Additionally, because additional mobile homes were added after the original notification of the violation andat -- -- - was not common knowledge that numerous mobile homes were located on the site,the Building Permit(BCN- 020505) issued for the demolition of 4(four) mobile homes was issued in error. Weld County Code of Section 23-4-160(D)allows only one Mobile Home per legal lot, and in light of the on-going zoning violation, Building Permit(BCN-020505) is hereby being revoked. You will be refunded in the amount of$21.00 (fee assessed at issuance).
