TEH;rjg B-20 SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING September 15, 1981 A regular meeting of the Weld County Planning Commission was held on September 15, 1981 at 1:30 p.m. in the Commissioners' Hearing Room, 915 10th Street, Centennial Building, Greeley, Colorado. The meeting was called to order by the chairman, Fred Otis. Tape 69 - Side 2 Roll Call: Jack Holman Excused absence Jerry Kiefer Present Wilbur Wafel Present Bob Halleran Excused absence Fred Otis Present Bette Kountz Present Don Billings Present Bob Ehrlich Present Bill Diehl Excused absence Also present: Tom Honn, Zoning Administrator, Lee Morrison, Assistant County Attorney and Bobbie Good, Secretary. A quorum was present. The summary of the last regular meeting of the Weld County Planning Commis- sion held on September 1, 1981 was approved as distributed. CASE NUMBER - SUP-472:81:18 APPLICANT - Erie Water and Sanitation District SUBJECT - Wastewater Treatment Plant - Continued from August 18, 1981 LEGAL DESCRIPTION - NW1 , Section 6, T1N, R68W of the 6th P.M. , Weld County, Colorado LOCATION - 12 miles north of Erie APPEARANCE: Richard Lyons, Attorney for the District, reported the district wishes a new sewer system for the town. The current sewer system has received complaints from the State that they are not in compliance with the state standards. They are either going to upgrade the present sewer system, or put in a new sewer system. If upgraded it would only allow for approximately twenty-five new sewer taps, which the town feels is inadequate. There has been new growth and development in the town of Erie, and the old system is no longer adequate. They have not arranged for funding of any kind at this time, understanding that a special use permit is the first step to be taken in the process of putting in a new sewer. Keith Bell, Engineer for the Erie Water and Sanitation District appeared before the Planning Commission. Tape 70 - Side 1 Summary of the Weld County Planning Commission Meeting September 15, 1981 Page 2 Mr. Bell explained the various locations investigated for locating this site, the soils composition of each site and the location of each site. He explained the process of treatment, purification of liquid effluents and disposal of waste solids planned for the plant. Discussion from the members of the Weld County Planning Commission was directed to Mr. Bell and Mr. Lyons. Tom Honn, Zoning Administrator read the recommendations of the Department of Planning Service's staff and the Development Standards. The chairman, Fred Otis asked Mr. Lyons and Mr. Bell if they were aware of the recommenda- tions and if they felt they could live with these standards; to which they replied they had copies of these documents and felt they were reasonable. Discussion from the Audience: Bennie Bruntz, Westview Estates expressed the views of himself and other residents of this subdivision. He felt there were surely other areas a sewer could be located except right next to a subdivision. The residents are concerned that: 1. their water table would be lowered because of the dewatering process; 2. most of the properties have shallow wells for domestic use; 3. who would be responsible for odor control; and 4. who would be responsible for weed control, etc. While it has been stated a full-time employee would be provided to take care of the plant, the town of Erie sewer site is a "sad mess" now with weeds overgrowing the property. If they cannot afford to maintain this site properly, how can they afford to maintain the new site according to specifications? Many residents of Westview Subdivision are too low to be able to hook onto the sewer, therefore, they will not benefit from it. Also, this subdivision is extremely swampy and there is concern that the wells will be contaminated, or if it rains the sewer may overflow. Roelof Elting, a farmer, who lives on County Line Road stated County Line road was built up three or four feet and, therefore, acts as a dyke to hold any overflow of water from Coal Creek where it crosses County Line Road rather than letting it drain into Boulder Creek and run-off as a natural course of events. Because of this Coal Creek floods the area, including the Westview Subdivision. If the sewer were to drain into Coal Creek and flood this area, what would the consequences be? Tape 70 - Side 2 John Heffner of Westview Estates expressed his concern about the location of the sewer next to Westview Subdivision. He also wondered why other areas with a gravel base could not have be used for the sewer site. Summary of the Weld County Planning Commission Meeting September 15, 1981 Page 3 Ron Stow, Weld County Health Department reported he had spoken to Mr. Sam Cooper of the State Health Department, but did not receive a comment. Therefore, the Weld County Health Department is withholding their recommenda- tions pending the recommendations of the State Health Department and the State Board of Health. Lee Morrison, Assistant County Attorney explained the process this applica- tion would have to go through and be approved by, following the Weld County Planning Commission recommendation. Even if the Planning Commission were to recommend denial, the State takes final action on this and could override their decision. The Planning Commission inquired about another expert opinion from some source, perhaps the Weld County Engineering Department, as to whether this is the best site in regard to soils tests, etc. Tom Honn, Zoning Administrator stated the Department of Planning Service's staff does not have expertise in all areas, therefore, they rely on areas with that expertise to give them an opinion when referrals are made up on a particular case. In instances such as this, the staff relies on the Weld County Health Department and the State Health Department for expertise in their areas. Tape 71 - Side 1 George Montano appeared from the audience. He stated he had lived in the town of Erie all his life and has been watching it go backwards. Erie water is bad. A few years ago when a new water system was installed they were assured this would solve most of their problems, then it was discovered it was installed improperly. It was his feeling the Engineer, Mr. Bell, was much like a new car salesman. His primary interest is to sell the town of Erie this project. MOTION: Jerry Keifer moved that the Weld County Planning Commission continue the Erie Wastewater and Sanitation District application for a Special Use Permit until the next regular meeting, Tuesday, October 6, 1981, at 1:30 p.m. The motion was seconded by Bette Kountz. Discussion was called for from the members of the Planning Commission. Don Billings felt a decision should be made today and not postponed until the next meeting. The Chairman asked the secretary to poll the members for their decision. Jerry Keifer - yes; Wilber Wafel - no; Betty Kountz - yes; Don Billings - no; Bob Ehrlich - yes; Fred Otis - yes. Motion carried with four voting for continuance and two voting against. Summary of the Weld County Planning Commission Meeting September 15, 1981 Page 4 A recess was called by the Chairman. CASE NUMBER - CUP-70:81:3 APPLICANT - Windsor Assembly of God SUBJECT - Sanctuary and Parsonage LEGAL DESCRIPTION - Part of the SW', Section 17, T6N, R67W of the 6th P.M. , Weld County, Colorado APPEARANCE - The Reverend James Dunn, Pastor of the Windsor of God Church reported the church had made an application for a Conditional Use Permit to build a sanctuary and parsonage for the church. At a later date they also hope to build a church school, but these plans are not imminent. The town of Windsor has no objection to this request, except they have requested they be connected to the town of Windsor water supply. They would prefer using North Weld water, as it would be much more economical for them. Both water services are available to them. Tom Honn, Zoning Administrator, read the recommendations of the Department of Planning Service's staff and reviewed the Development Standards. He wished to call to the Planning Commission's attention that three entities have requested soils reports and subsurface water tables be checked to determine special needs (if any) prior to any building foundation design being done. The Chairman called for discussion from the audience. There was none. MOTION: Bob Ehrlich moved CUP-70:81:13 be recommended for approval to the Board of County Commissioners along with all conditions and standards as outlined by the Department of Planning Service's staff. Motion was seconded by Betty Kountz. Discussion by the Planning Commission. Jerry Keifer informed the applicant the Planning Commission tries to go along with the town's recommendation when an application for use is within their comprehensive plan, which this obviously is. Therefore, the recommenda- tion regarding use of Windsor water has not been changed. The Chairman asked the secretary to poll the member for a vote. Jerry Keifer - yes; Wilbur Wafel - yes; Bette Kountz - yes; Don Billings - no; Bob Ehrlich - yes; Fred Otis - yes. Motion carried by majority vote with five voting for the motionand one against. CASE NUMBER - SUP-476:81:22 APPLICANT - Douglas Howard SUBJECT - Agri-Business (livestock trailers) LEGAL DESCRIPTION - Part of the SE', Section 17, T6N, R67W of the 6th P.M. Weld County, Colorado Summary of the Weld County Planning Commission Meeting September 15, 1981 Page 5 APPEARANCE - Douglas Howard appeared in his own behalf. He explained he and his wife can run this business from their home if their application for a Special Use Permit is accepted. There would probably never be more than ten or fifteen trailers on the lot at any one time. Much of their business is wholesale and done by telephone sales. They have a large lot, with adequate lighting already installed. There would be little increase in traffic. The Chairman called for discussion from the audience. There was none. Tom Honn, Zoning Administrator reviewed the recommendation of the Department of Planning Service's staff, along with the Development Standards and Comments. He asked the Planning Commission to be aware of #3 of the staff's recommenda- tions concerning the recommendation of the city of Greeley regarding additional right-of-way. The Chairman asked Mr. Howard if he was aware of the contents of the recommendations and development standards. He stated he was. MOTION: Jerry Keifer moved the Planning Commission accept the recommendations and Development Standards for use by Special Review made by the Department of Planning Service's staff and that they be forwarded to the Board of County Commissioners with recommendation for approval. Motion seconded by Bette Kountz. The Chairman called for discussion from the Planning Commission. There was none. The Chairman asked the secretary to poll the members for their vote. Jerry Keifer - yes; Wilbur Wafel - yes; Betty Kountz - yes; Don Billings - yes; Bob Ehrlich - yes; Fred Otis - yes. Motion carried unanimously. CASE NUMBER - SUP-475:81:21 APPLICANT - Colhalar Company, Inc. LEGAL DESCRIPTION - SEA, Section 13, T3N, R66W of the 6th P.M., Weld County, Colorado. SUBJECT - Alcohol Production Facility APPEARANCE - Ken Colgan who stated they want to build a small alcohol production plant to use in conjunction with their cattle feeding business. They are now in the process of obtaining the necessary permit for their water. This will be quite a small plant and will only produce about 500 gallons of alcohol a day. The Chairman called for discussion from the audience. There was none. Summary of the Weld County Planning Commission Meeting September 15, 1981 Page 6 Tom Bonn, Zoning Administrator reviewed the recommendations of the Depart- ment of Planning Service's staff along with the Development Standards. He asked the Planning Commission to be aware of #3 of the recommendations regarding soils tests and foundation investigation prior to a building permit being applied for. Honn „ DOH FILE 45100 Department of Planning Services Weld County 915 Tenth Street `/ Greeley, Colorado 80631 S?j'" Dear Mr. Honn: We have reviewed the application from the Windsor Assembly of God Church for a Conditional Use Permit, and we ask for your consideration of the following comments. 1 . Projected traffic on State Highway 392 indicates the need for a total of 150 feet of right of way, 75 feet each side of the centerline. The existing right- of-way width north of the highway centerline is approximately 40 feet. An additional 35 feet should be protected as necessary by reservation or, preferably, dedication as permitted by local regulations. 2. We note that a runoff holding pond is located in the southwestern portion of this site. If water from this pond is released and flows toward S.H. 392, we ask that the rate of release not exceed the historical runoff rate for the entire site. Thank you for the opportunity to review this application. Very truly yours, DWIGHT M. BOWER DISTRICT ENGINEER /Doug as Rames District Preconstruction Engineer DDR:da cc: D. M. Bower D. N. Department of Conservation Agriculture Service 4302 W. 9th St. Road, Greeley, CO. 80634 September 2, 1981 Milton BaumgartAer, President West Greeley Soil. Conservation District P. 0. Box 86 _ Greeley, Colorado 80632 I have reviewed the request from Weld County Department of Planning Services for a Conditional Use Permit for a church and parsonage, Windsor Assembly of God Church, to be located on lot B, five acres in the SW4 of Section 17, T6N, R67W, 1/2 mile west of Windsor. This conditional use permit relates directly to the recorded exemption filing by Eaton Development Corporation. The church and parsonage are to be located in the southwest corner of the five acres on the corner of county road 15 and state highway 392. The entire site is made up of the soil type Olney fine sandy loam, 1 to 3 percent slope. This soil type is very compatible for the planned activities, however, north of the acreage is an area which in years past has exhibited surface drainage problems. The entire region west of Windsor on either side of highway 392 has exhibited some subsurface drainage problems. This is not to say that the acreage in question has subsurface water problems, but it would be wise to drill some deep holes to check for a subsurface water table which may affect the construction activities planned. Olney fine sandy loam, 1 to 3 percent slope is considered to be prime farmland when irrigated. Granting of this request may go against the established Weld County position to preserve prime farmland. / ' Sincerely, Ronald D. Honn Weld County Colorado Department of Planning Services 915 Tenth Street Greeley, Colorado 80631 Re : Weld County Referrals , August 13 , 1981 Dear Mr. Honn: The proposed church site is included on Windsor' s Comprehensive Land Use Map as a single family resi- dential area, and is therefore compatible with future land use plans. Windsor has a 12" water main along the south boundary of the proposed site and it is stated in the Comprehensive Plan that future develop- ment along existing water mains be served by the Windsor Water Department . Therefore , the Windsor Planning Commission, at their regular meeting September 3 , 1981 made the following recommendation to the Weld County Planning Commission by a unanimous vote : The recorded exemption and conditional use permit requests for the property located 1/2 mile west of Windsor are recommended for approval contingent upon the applicant utilizing Windsor water service now existing near the property. In the event the applicant does not wish to become part of the Windsor water system, the Windsor Planning Commission would recommend denial of the applications. Future plans include a Day Care Center plus Christian schooling (K - 12) such as is now being provided by Trinity Lutheran Day School or DaySpring Christian shool in Greeley. The parsonage will not be utilized for any activity other than those which accompanies a pastor's home. Building Type: Current building plans call for a circular type structure which utilizes space and energy the most efficiently. Under consideration is both the conventional type construction for circular buildings and the "dome" method of construction which utilizes the impacted concrete technique of construction. The reason for considering the "dome"type building is that cost of construction is 40 - 50% less than conventional methods, plus the dome/impacted concrete method has a minimum R-56 insulation factor and readily lends itself to solar applications. The type of building chosen will be architecturally designed and landscaped to be aesthetically pleasing. Parsonage structure will be of the conventional type. Access to the parsonage and church facility will from the County Rd. 15. The greatest amount of traffic to and from the church will not be during hours that are considered to be heavy traffic hours during the daytime. This site is underlain by sand and gravel . This material should provide good foundation material but on-lot septic systems may need engineering due to fast percolation rates. We recommend that building foundations be designed by qualified personnel . The two septic systems should also be designed by a qualified engineer. Additionally, we are concerned with groundwater quality in this area. Livestock concentrations have caused TDS and sulfate levels above recommended limits for domestic use. If a well (s) is used for this project, water quality should be checked; treatment may be necessary. If these recommendations are followed, we have no objection to approval of this permit.
