IN THE MATTER OF ENACTING ARTICLE VIII OF CHAPTER 8, PUBLIC WORKS, OF THE
WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County
Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the
codification of all previously adopted ordinances of a general and permanent nature enacted on
or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirement therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of
Weld, State of Colorado, that Article VIII entitled "Transportation Element of Northern Colorado
Regional Communities 1-25 Corridor Plan" of Chapter 8, Public Works, of the Weld County Code
be, and hereby is, enacted, to read as follows.

ARTICLE VIII
Transportation Element of Northern Colorado
Regional Communities 1-25 Corridor Plan
Sec.8-8-10. Adoption of Chapter VI Transportation Element of Northern Colorado Regional
Communities I-25 Corridor Plan. Eight regional communities in Northern Colorado, including the
County of Weld, have joined together to prepare the Northern Colorado Regional Communities 1-25
Corridor Plan (the "Plan"), which Plan encompasses an area in Weld County extending
approximately one mile on either side of 1-25 for a distance of five miles, beginning at WCR 40 and
extending northward to Colorado State Highway 60. The Plan includes in Chapter VI a
Transportation Element, a copy of which is found at Appendix 8-K. The County of Weld adopts the
Transportation Element for use in planning the transportation systems along said portion of the 1-25
Corridor within Weld County.
BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed
to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and sub-
sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and
sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section,subsection, paragraph,sentence, clause,
or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision
shall not affect the validity of the remaining portions hereof. The Board of County Commissioners
hereby declares that it would have enacted this Ordinance in each and every section, subsection,
paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more
sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be
unconstitutional or invalid.

The Board of County Commissioners of Weld County, Colorado, will conduct a public
hearing at 9:00 a.m., on May 5, 2003, in the Chambers of the Board of County Commissioners,

RE: Consideration of Adoption of Transportation Element of 1-25 Corridor Plan by Weld County
Dear Property Owner
As you know, Interstate 25 (1-25) has long played an important role in the economic well being of
our community. Ensuring that 1-25 continues as an efficient and functional transportation network
is vital to the future of Northern Colorado.
In May of 2001, you were sent a letter explaining the Northern Colorado 1-25 Corridor Plan ("the
Plan")and inviting you to participate in the planning process. Since that time several communities,
along with the North Front Range Transportation and Air Quality Control Council, and the Colorado
Department of Transportation, have accepted the Plan.
While the Plan contains several elements, the Board of County Commissioners will consider only
the adoption of its Transportation Element. The Transportation Element may be reviewed at the
website for the North Front Range MPO at www.nfrmpo.org. The adoption of the Transportation
Element will be its inclusion into the Weld County Code by ordinance. A copy of the notice for
Code Ordinance #2003-5 is enclosed, detailing the times and place of the three reading of the
ordinance. As a property owner along this corridor, your input is critical to the overall success of
the Plan. You are invited and encouraged to attend the three readings. If you are unable to attend,
written correspondence may be directed to the Board of County Commissioners at the above
address. An e-mail may also be sent to charding@co.weld.co.us to be included in the official case
file.
