RE: SHOW CAUSE HEARING TO SHOW WHETHER GOOD CAUSE EXISTS FOR
REVOCATION OF AMENDED USE BY SPECIAL REVIEW PERMIT #713 FOR A
SALVAGE YARD IN THE A(AGRICULTURAL)ZONE DISTRICT-MANUEL BALDERAS,
DBA M AND B SALVAGE
A public hearing was conducted on July 28, 2003, at 10:00 a.m., with the following present:
Commissioner David E. Long, Chair
Commissioner Robert D. Masden, Pro-Tem - EXCUSED
Commissioner M. J. Geile
Commissioner William H. Jerke
Commissioner Glenn Vaad
Also present:
Acting Clerk to the Board, Carol A. Harding
County Attorney, Bruce Barker
The following business was transacted:
I hereby certify that pursuant to a notice dated July 11,2003,and duly published July 17,2003,in the
South Weld Sun,a public hearing was conducted to show whether good cause exists for revocation
of Amended Use by Special Review Permit#713,held by Manuel Balderas,dba M and B Salvage,
fora Salvage Yard in the A(Agricultural)Zone District. Bruce Barker,County Attorney, made this
a matter of record,and stated he received an E-mail from Cindy Etcheverry, Department of Public
Health and Environment, stating that during an on-site inspection conducted July 22, 2003, she
observed that waste oil is removed regularly by an oil recycling company,antifreeze is recycled at
the facility or removed by a recycling company, Freon removal has been contracted for removal,
and cars and salvage materials previously stacked about six feet in height have been removed.
Therefore, she recommends dismissal, as does Bethany Salzman, Department of Planning
Services.
No public testimony was offered concerning this matter.
Commissioner Vaad moved to dismiss the hearing regarding Amended Use by Special Review
Permit #713, held by Manuel Balderas, dba M and B Salvage, for a Salvage Yard in the
A (Agricultural) Zone District. The motion was seconded by Commissioner Jerke, and it carried
unanimously. There being no further discussion, the hearing was completed at 9:35 a.m.
