The submitted materials are in compliance with appli- cation requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commis- sioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a) The proposal is consistent with the Comprehen- sive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The attached Standards for Use by Special Review be adopted; 2. The plat for the use permit be placed of record by the Department of Planning Services staff prior to any building permits being issued on the site. Because he has the necessary property size to house a number of dogs, I find it very convenient to leave my dog with him when I am away from home for an extended period of time. Mr. Shebesta's kennel area has always been very clean and well cared for. The dogs have clean doghouses; the areas immediately around the houses are always free of refuse and litter; the animals are always well fed and watered; and all of his animals receive proper medical attention. His dogs are always confined and are never allowed to run free. Mr. Shebesta is a member of several dog clubs associated with the American Pit Bull Terrier, and he is a recognized authority (particularly in Colorado) of this breed. Since he has been raising these animals for a number of years, his time is frequently in great demand by others interested in showing dogs, improving their dogs' bloodlines, and in my case, care for family pets. The proposed establishments of a family operated non- commercial kennel is consistent with the Weld County Com- prehensive Plan: the subject property is zoned (A) agriculture and is located within Carol Heights, subdivision, an area who's residents are animal oriented, and are owners of a variety of animals including horses, dogs, cats, poultry. There are also many commercial poultry houses and dairy oper- ations in close proximity to the said property. The proposed use is not inconsistent with the existing uses. The proposed use would be compatible with any foreseeable future development of the immediate area as outlined in the Comprehensive and/or Master Plan covering the area. The property for which the application is proposed does not lie within an Overlay District. The Carol Heights subdivision is an area of nonproductive commercial farming comprised of 2 to 5 acre home sites, the proposed use would not be inconsistent with accepted land management practices. The proposed kennel use would be solely for non-boarding, breeding purposes. Housing, fencing, and space requirements will comply with existing county regulations. All animals are, and will be, regularly examined by a Dr. of Veterinary Medicine who also supervises the health maintenance program. . No more than 20 dogs will be housed in the kennel area.
