Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lot B. Property owners are
advised that the quantity of water available for usage may be limited to specific uses, i.e.,"Domestic
Use Only,"etc. Because each situation is unique,the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.
3. Prior to recording the plat:
A. The plat shall be titled: Amended Recorded Exemption No. 0553-6-1 AMRE-327
B. Lot B shall use the proposed shared access point in the southeast corner of the lot. No
additional accesses shall be granted.
C. All approved accesses shall be clearly shown on the plat.
D. Weld County Road 27 is designated on the Weld County Transportation Plan Map as a local
gravel road, which requires 60 feet of right-of-way at full build out.There is presently 60 feet of
right-of-way. A total of 30 feet from the centerline of Weld County Road 27 shall be delineated
right-of-way on the plat. This road is maintained by Weld County.
E. Weld County Road 98 is designated on the Weld County Transportation Plan Map as section
line. This road is not maintained by Weld County.
F. The West Greeley Soil Conservation District has provided information regarding the soils on the
site. The applicant shall review the information and use it to positively manage on site soils.
G. The applicant shall address the requirements of Weld County School District RE-9 as stated in
the referral response received February 4,2003. Evidence of such shall be submitted in writing
to the Weld County Department of Planning Services.
H. The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Prior to release of building permits, evidence must be submitted to the Department of
Planning Services indicating that the shared access road has been installed in
accordance to Flood Hazard Overly District Requirements. The Weld County
Department of Public Works has indicated that the access road should have culverts at
the borrow pit ditch, side drainage patterns, and the main drainage crossing.
4) The low water crossing access road has a good possibility of washing out or being under
water during a storm. This shared access road will be privately maintained.
5) All construction or improvements, including the shared roadway, occurring in the flood
plain as delineated on Federal Emergency Management Agency FIRM Community Panel

Map 080266 0325 C dated September 28, 1982, shall comply with the Flood Hazard
Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County
Code.
6) The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S.flood plain policy. In accordance with the State of Colorado I.S.D.S.
Regulations, no septic system shall be installed with in the floodway.
7) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Amended Recorded Exemption number.
8) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
9) Potential purchasers should be aware that Lot B may not be eligible for a domestic well
permit which allows for outside irrigation and/or the watering of stock animals. The
State Division of Water Resources issues all well permits.
10) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
11) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non-
buildable if the lot owner is unable to obtain a well permit.The State Division of Water
Resources issues all well permits.
12) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code,
as recommended by the Mountain View Fire District.
13) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
14) Any disturbance of wetlands shall require the applicant to contact the Army Corps of
Engineers for permits pursuant to Section 404 of the Clean Water Act.
15) Effective January 1,2003,Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the Weld County Road Impact Program. (Ordinance
2002-11)
16) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.

Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement, silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
4. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
5. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps@co.weld.co.us.
6. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

On April 4, 2003, your application for an amended recorded exemption was administratively approved by
the Weld County Department of Planning Services with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should

AMENDED RECORDED EXEMPTION QUESTIONAIRE
1. Water supply statements addressing the following:
A well permit application has been filed with the State Board of Water Resources for
Lot `B' and shall be included in the Recorded Exemption being filed simultaneously
with this application.
2. A statement explaining that the proposed lots will have adequate means for disposal of
sewage in compliance with the requirements of the underlying district and the Weld
County Health Department. A copy of the septic permit or a letter from the sewage
disposal facility must accompany the application.
An I.S.D.S. permit shall be applied for according to the regulations of the Weld County
Health Department when needed.
3. A description of how the property is being used. When the parcel(s) is located in the
agricultural zone district, the description shall include approximate acreage of prime
and nonprime farmland as defined in the Weld County Comprehensive Plan, number
and types of livestock and any existing improvements such as the principal residence,
labor home, mobile home, manufactured home, barn outbuildings, irrigation ditches,
oil well production facilities on the property.
On the subject property,Lot 'A' was divided from the original parcel by RE-327 in
1978. It is approximately 2 acres in size and consists of a dwelling and a couple of
small out buildings. The remaining Lot `B' containing approximately 142 acres, is in
the Conservation Reserve Program and has no improvements. The soil is of poor
quality and much of the parcel lies within the one hundred year flood plain as defined
by the Federal Emergency Management Agency. A map showing the flood pain shall
be included with this application. Due to these two drawbacks, the parcel is not
conducive to farming.
4. The reason for the proposed recorded exemption with an explanation how each lot
will be used.
The Section in which the subject property is located is a Correction Section, therefore
the quarter section is not a full 160 acres,but shall be treated as if it was. There is a
total of +/- 142 acres in Lot 'B' of RE-327. The reason for the proposed Amended
Recorded Exemption is to remove the South 80 acres from Lot 'B' to make it eligible
for the Recorded Exemption process. We have applied for a Recorded Exemption
concurrently with this amendment application. The goal is to create a new lot through
the Recorded Exemption process in order to better utilize land that is not well suited to
farming.
5. A description of the location,size, and present use of the area where the proposed new
lot(s) will be created.
As mentioned above,the proposed Amended Recorded Exemption is located in an area
where the soil restricts its use as farm ground. Currently, approximately 132 of the
total 144 acres in the CRP program, and+\- 10 acres is wasteland. Lot 'A' consists of
2 acres that are used as a rural residence.
6. A statement describing any unique physical characteristics on the site, if applicable.
The only unique physical characteristics of the site are the sloping terrain to the South
and West and a large section of flood plain running diagonally across the parcel. See
enclosed map.
7. A statement indicating that all proposed or existing structures will or do meet
minimum setback and offset requirements for the zone district in which the property
is located.
All existing structures on Lot 'A' of the existing exemption meet all setback and offset
requirements. Any new structures created shall meet all setback and offset
requirements of the Weld County Zoning Ordinance.
8. A statement indicating whether the applicant is willing to place a conservation
easement on the property to maintain farm production or open space.
The applicant does not wish to place a conservation easement on the proposed
Recorded Exemption at this time.
9. A statement indicating whether a building envelope will be designated on any of the
lots.
We will be applying for a Recorded Exemption simultaneously with this application. A
building envelope will be suggested as part of the Recorded Exemption Application.

10. A statement explaining how the proposal is consistent with Weld County
Comprehensive plan and any adopted municipal plan, and any intergovernmental
agreement(s), if applicable.
This proposal is consistent with the Weld County Comprehensive Plan in that it
enhances the non-productive farmland by creating tax revenue for the county and the
improved maintenance and upkeep typically associated with owner occupied
residences. The end goal of this amendment is to create a lot on a parcel that is not
suited to farming. With the exception of the building envelope, the parcel will continue
to be returned to grassland as part of the CRP program.
11. A statement explaining how proposed uses will be compatible with existing
surrounding land uses.
The proposed uses for this proposed Recorded Exemption are compatible with
surrounding land uses in that the entire area is agricultural with small
acreage residences. These uses are consistent with this application.
12. A statement explaining how the proposal is consistent with the intent of the
district it is located within as expressed in the Weld County Zoning Ordinance,
as amended, and the Weld County Comprehensive Plan.
The proposal is consistent with the Weld County Zoning Ordinance which allows
for Recorded Exemptions in the Agricultural Districts. It allows for the
creation of lots with a minimum size of 1 acre and this proposal complies. The
intent of the Comprehensive plan is to preserve the productive farmland and improve
the non-productive farmland. This proposal is consistent with that intent.
13. A statement explaining how the proposal is consistent with efficient and
orderly development as defined in the Weld County Subdivision Ordinance,
Section 1.3.
This Proposal is consistent with efficient and orderly development. It meets the
requirements as set forth in the Weld County Subdivision Ordinance for Recorded
Exemptions and Amendments.
This amendment is just a required step to reach a goal of creating a lot on land that is
not easily utilized as farm ground due to the poor quality of the soil and a fairly
expansive flood plain.

This is a follow-up of our March 28, 2003, field trip. In reviewing the site of the amended recorded exemption
(RE) and the new RE proposals, the following comments and requirements should be taken into consideration.
A shared access point is being proposed between both the REs to accommodate the Lot B's of RE-3499 and
RE-3500. This access point passes through a large drainage area. The access road should have culverts at
the borrow pit ditch, side drainage patterns, and the main drainage crossing. This low water crossing access
road has a good possibility of washing out or being under water during a storm. This shared access road will
be privately maintained.
WCR 98 west of WCR 7 (section line road) was evaluated for access to Lot B. This section line access road
leaves the section line crosses the large drainage pattern on the north side of the proposed RE splits, creating
the same scenario as the shared access point from WCR 27.
Summary: The Weld County Public Works Department has concerns on accessing both the Lot B's during
spring storm conditions or flash flooding at this location.
Access to both lots could be gained during flooding conditions on the south property line of RE-3500, as it
appears to be south of the large drainage pattern. The easement or written permission should be acquired
from the appropriate property owner.
The WCR 98 (section line access) crosses the main drainage pattern. It would have the same drainage
problems as the shared access point in obtaining access to Lot B of RE-3499 during flooding conditions.
WCR 100: In evaluating the WCR 100 drainage pattern directly one mile north of the proposed facility. The
County has constructed five 48-inch ± tubes to accommodate passing some storm water through this area.
This area is notorious for sheet flow over WCR 100. There are signs posted on both sides of the drainage
area warning the traveling public that water may exist on the roadway.

COMMENTS:
WCR 27 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 98 is designated on the Transportation Plan Map as a section line. This road is NOT maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The residential access shall be placed in such a location to have adequate sight distance in both directions and
not below the crest of a hill or where physical obstructions are present. (Lot B)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert. (Lot B)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot B)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot A)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

with the Weld County I.S.D.S. flood plain policy (attached). In accordance with
the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the

Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of

Weld RE-9 School District with district offices located in Ault Colorado
has adopted a methodology to determine the in-lieu payment for
residential dwelling units sufficient to provide adequate educational
opportunities to new residential developments. The School District
Methodology has been developed in a manner so as to fairly
apportion the cost of acquiring school sites made necessary by
residential development.
The total in-lieu payment per dwelling unit is $759. Payment should
be hand delivered or mailed to Weld RE-9 School District, Box 68,
Ault, Colorado 80610. A receipt will be mailed to the party
requesting the exemption and a copy to Weld County Officials.

Purpose: Describe the requirements to install a septic system within a flood plain.
Responsibility: Office Technicians, Environmental Specialists, Supervisors, Director
Definitions:
Floodplain: an area adjacent to a stream which is subject to flooding as the result of the occurrence of
a one hundred (100)year flood, and is so adverse to past, current or foreseeable construction or land
use as to constitute a significant hazard to public or environmental health and safety or to property or is
designated by the Federal Emergency Management Agency (FEMA) or National Flood Insurance
Program (NFIP). In the absence of FEMA/NFIP maps, a Colorado Registered Professional Engineer
shall certify the flood plain elevations. (Source: Colorado Department of Public Health and Environment
I.S.D.S. Guidelines, Revised 1994)
Floodway: that area of the floodplain in which the channel of the watercourse and those portions of the
adjoining floodplain which must be reserved in order to discharge the base flood without cumulatively
increasing the water surface elevation more than one(1)foot at any point or as designated by the
Federal Emergency Management Agency or National Flood Insurance Program. In the absence of
FEMA/NFIP maps, a Colorado Registered Professional Engineer shall certify the flood way elevation
and location. (Source: Colorado Department of Public Health and Environment I.S.D.S. Guidelines,
Revised 1994)
Policy:
Septic systems will not be allowed to be located in the floodway per Colorado Department of Public
Health and Environment I.S.D.S. Guidelines, Revised 1994. Septic systems will be allowed in the flood
plain, but the system must be installed in a manner as to prevent the infiltration of groundwater into the
septic tank and to prevent the release of sewage from the tank during a flood event
If the tank lid is above the flood plain elevation, no special installation requirements would be necessary.
If the tank lid is not above the flood plain elevation then the access to the tank manhole lids must be
covered with 20 mil PVC and sealed with plumbers cement. When the seal is broken, i.e. the tank is
opened for pumping, etc., the tank must be re-sealed prior to backfilling again. A backflow preventer or
one-way valve, must also be installed in the effluent line between the tank and the absorption field.
All other percolation and suitable soil criteria must be met for a conventional septic system to be
installed.
For inspection purposes, the materials to seal the manhole lids must be on site. The manholes are not
required to be sealed at the time of inspection in order to allow for the inspection of tee's in the tank.
