Re: Recorded Exemption #RE-615
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Charles Branch for a recorded exemption. The parcel of land
on which this request is being made is described as part of the SE' SW14,
Section 11, T5N, 165W of the 6th P.M., Weld County, Colorado.
The property is located approximately 2 miles east of Greeley on East
18th Street. The property contains approximately 38 acres of Class IIs
(prime) and VIw itrigated soils.
The request is to divide the property into parcels of 35.672 acres and
3 acres, more or less. It is the intent of the applicant to split his
property to build another new home.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the Subdivision
Regulations as follows:
The 38.672 acres, more or less, under consideration will
allow uses which are consistent with the intent clause
of the Agricultural Zone District. The uses will be
compatible with existing surrounding uses;

FIELD CHECK
FILING NUMBER: RE-615 DATE OF INSPECTION: May 19, 1983
NAME: Charles W. Branch
REQUEST: Recorded Exemption for existing improvements
LEGAL DESCRIPTION: Part of the SE's SW1, Section 11, T5N, R65W of the 6th P.M.
LAND USE: N 4 residences, fallow land and pasture, East 18th Street
E Hemlock Avenue, 2 mobile homes, trailer sales, cropland
S One residence, pasture
W Residences and pasture
ZONING: N Agricultural
LOCATION: Approximately 2 miles east of Greeley; E Agricultural
south of East 18th Street and west of Hemlock S Agricultural
Avenue. W Agricultural
COMMENTS:
Proposed Lot "B" of this 38.672 acre parcel contains the improvements; a residence and
a garage. Lot "A" is the resulting farmland without improvements. The site for the
proposed new home would be situated on USDA Class II prime farmland.
Lot "B" has access to East 18th Street, a paved road. Lot "A" has access to either
East 18th Street or Hemlock Avenue, a gravel road. The field inspection revealed that
the drainage ditch is closer to the intersection of East 18th Street and Hemlock Avenue
than what is revealed on the submitted map. Thus, the proposed new home may have access
only from Hemlock Avenue, and might be situated further into Lot "A" and prime farmland.

To Whom It May Concern:
My intent to split my property is to Utilize the non-productive
farm acres because of gravel, into a building site for myself, there-
fore; generating more income to continue farming the productive acres.
As to maintaining harmony with the Greeley Comprehensive Plan, I
believe the land split would benefit myself as well as my neighbors in
the fact that it would be a low density split and would contribute more
tax dollars for our County.
In the past 3 to 4 years there has been several land splits in my
area; which in turn helps the neighborhood to maintain a low density
home, business-type environment and smallturfing interprizes which
would conform to Local Zoning and Planning Mir the future.
