r RESOLUTION RE: APPROVE FOUR PETITIONS TO THE TOWN OF LOCHBUIE, COLORADO, FOR THE ANNEXATION OF PORTIONS OF WELD COUNTY ROAD 39, BETWEEN 1-76 AND WELD COUNTY ROAD 6, AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Town of Lochbuie, Colorado, has purchased a tract of property in the NW1/4 of Section 29, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado, which the Town intends to use for the location of a wastewater treatment plant, and the Town intends to annex said tract, and WHEREAS, the Town of Lochbuie has asked the Board to approve four petitions to the Town to annex portions of Weld County Road 39, between 1-76 and Weld County Road 6, so that the Town may then have sufficient contiguity to annex said tract, with copies of the maps showing said annexations of Weld County Road 39 attached hereto, and WHEREAS, after review, the Board deems it advisable to approve said petitions and to authorize the Chair to sign. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petitions for Annexation, known as Petitions #3, #4, #5, and #6, for the annexation of portions of Weld County Road 39, between 1-76 and Weld County Road 6, to the Town of Lochbuie, Colorado, as shown on the attached maps, be, and hereby are, approved. Your Petitioner would further state to the Board of Trustees of Lochbuie, Colorado, as follows: 1. That it is desirable and necessary that such territory be annexed to the Town of _ Lochbuie, Colorado. 2. That the territory sought to be annexed to the Town of Lochbuie meets the requirements of Sections 31-12-104 and 105 as amended, of the Municipal Annexation Act of 1965, in that: a. Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with the existing boundaries of the Town of Lochbuie, Colorado; and the contiguity is not established by use of any boundary of an area which was previously annexed to the annexing municipality, that was not contiguous at any point with the boundary of the Town of Lochbuie and was not located more than three (3)miles from the nearest boundary of the Town of Lochbuie, further contiguity is not established by use of any territory which is subsequently annexed directly to, or which is indirectly connected through subsequent annexations to, such an area. b. A community of interest exists between the territory proposed to be annexed and the Town of Lochbuie, Colorado. c. That the territory proposed to be annexed is urban or will be urbanized in the near future and that the territory to be annexed is integrated or is capable of being integrated with the Town of Lochbuie, Colorado. d. To the extent that any such tracts or parcels are divided into separate parts or parcels by this Petition, Petitioner hereby consents to such division. e. That no land in the area proposed to be annexed,which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, comprising twenty(20) or more acres (which, together with the buildings and improvements situated thereon has a valuation for assessment in excess of$200,000.00 for ad valorem purposes for the year next preceding the annexation) shall be included in the area to be annexed without the written consent of the landowners,unless such tract of land is situated entirely within the outer boundaries of the annexing municipality as they exist at the time of annexation. f. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. g. The annexation of the area proposed to be annexed shall not result in the detachment of area from any school district. h. The annexation of the area proposed to be annexed will not require extending the municipal boundary more than three (3)miles in any direction from any point of such municipal boundary in one year. 3. The Petitioner owns all of the territory included in the area proposed to be annexed, as shown on Exhibit A. 4. That submitted herewith are four(4)prints of the annexation map, containing a written legal description of the boundaries of the area proposed to be annexed, together with the location of each ownership within said area and the contiguous boundaries of the existing city limits and the dimensions thereof. 5. That upon the Annexation Ordinance becoming effective, all lands within the area sought to be annexed shall become subject to all ordinances, resolutions, rules and regulations of the Town of Lochbuie as of the effective date of said ordinance. The annexation of the area proposed to be annexed shall not result in the detachment of area from any school district. h. The annexation of the area proposed to be annexed will not require extending the municipal boundary more than three (3)miles in any direction from any point of such municipal boundary in one year. 3. This stretch of WCR 39 lies on the section line between Sections 29 and 30, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado. The annexations are intended to enable the Town to obtain contiguity to annex a tract of land in the NW''h of Section 30 for the location of a waste-water treatment plant. The matter was first heard by the Board of County Commissioners on April 30, 2003. At that time, the Board heard requests from a few area residents for the Board ensure that Lochbuie's annexation would not preclude the use of current accesses and use of the road by farm equipment, and result in weight restrictions set by Lochbuie. The Board later discussed these concerns with Lochbuie representatives at a work session held on May 8, 2003. The Board and the Lochbuie representatives then agreed to certain terms concerning the annexation, with such terms to be memorialized in an annexation agreement. Enclosed is a copy of the proposed annexation agreement. The Board of County Commissioners will again consider the Town's request at its regular meeting at 9:00 a.m. on Wednesday, August 20, 2003. Town's Consent to Conditions. By execution hereof, the Town shall be deemed to agree to each and every condition stated in Paragraph 2 hereof and the use and maintenance of the real property described in Exhibit A shall thereafter be in accordance with the provisions therein. 4. Entire Agreement. This instrument embodies the entire agreement of the parties with respect to the subject matter hereof. There are no promises, terms, conditions, or obligations other than those contained herein; and this Agreement shall supercede all previous communications, representations, or agreements, either verbal or written, between the parties hereto. No modification to this Agreement shall be valid unless agreed to in writing by the parties hereto. 5. Binding Effect.
