RE: SITE SPECIFIC DEVELOPMENT PLAN AND FINAL PLAN FOR SIX (6) LOT MINOR
SUBDIVISION, MF#609, MOOREA MANOR-STEVEN KLEN AND LORI GUTTENSTEIN
A public hearing was conducted on April 30, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 11, 2003, and duly published April 17, 2003,
in the South Weld Sun, a public hearing was conducted to consider the request of Steven Klen and
Lori Guttenstein for a Site Specific Development Plan and Final Plan for a six (6) lot Minor
Subdivision, MF #609, Moorea Manor. Lee Morrison, Assistant County Attorney, made this a
matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of
the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She stated the referral response received from the Town of Platteville, stated
the application does not comply with its Comprehensive Plan; however, no further comments or
explanation was given. Pam Smith, Department of Public Health and Environment, stated she had
no comments. Peter Schei, Department of Public Works, stated he is confident all conditions have
been met, and responded to Commissioner Geile that all access to and from the subdivision is onto
Weld County Road 21.5, which is paved. Responding to further questions from Commissioner
Geile, Mr Schei explained Weld County Road 24.5 ends at Weld County Road 21.5; there is no
right-of-way west of Weld County Road 21.5; and all traffic is required to use the one entrance on
Weld County Road 21.5. Ms. Lockman indicated since Weld County Road 24.5 is not on a section
line, there would not normally be County right-of-way.
Jeffrey Couch, TEAM Engineering, represented the applicant and stated unanimous approval was
given by the Planning Commission, and he has not heard any negative comments regarding the
project. Mr. Couch reiterated access will be from Weld County Road 21.5 onto Harpenden Lane,
which is the only internal road, and that Steven Klen owner, is also the developer and will reside
on the west lot.
No public testimony was offered concerning this matter.

Responding to Commissioner Jerke about the number of fire hydrants required in Condition of
Approval #1.1, , Ms. Lockman stated staff originally asked for one; however, two are already in
place, with the approval of the Platteville/Gilcrest Fire Protection District. Responding further to
Commissioner Jerke, Ms. Lockman stated five shares of water from Union Coalridge have been
transferred to the Homeowners'Association. Commissioner Jerke requested the specific number
be included in the Resolution.
Mr. Couch stated there were actually 13 shares of water, eight of which were transferred to Mr.
Klen, and five of which were transferred to the Homeowners' Association. He further explained
they will maintain the irrigation system already in place. Responding to Chair Long, Mr. Couch
stated he agrees with the Conditions of Approval as modified by Commissioner Jerke. Responding
to Commissioner Masden, Mr. Couch stated at the Sketch Plan stage of this project, a certified
geologist drilled the site and performed a soils test. His determination was that the amount and
size of gravel on site was not feasible to mine. Mr. Schei referenced the report from Church and
Associates, dated June 28, 2001.
Commissioner Jerke moved to approve the request of Steven Klen and Lori Guttenstein for a Site
Specific Development Plan and Final Plan for a six (6) lot Minor Subdivision, MF #609, Moorea
Manor, based on the recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval as amended. The motion was seconded by Commissioner Vaad, and
it carried unanimously. There being no further discussion, the hearing was completed at
11:20 a.m.
This Certification was approved on the 5th day of May 2003.
