RE: APPROVAL OF SPECIAL EVENTS PERMIT ISSUED TO RONALD MCDONALD
HOUSE CHARITIES OF DENVER, INC., AND AUTHORIZE CHAIR TO SIGN
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ronald McDonald House Charities of Denver, Inc., presented to the Board of
County Commissioners of Weld County, Colorado, an application for a Special Events Permit for
the sale of 3.2%fermented malt beverages for consumption by the drink on the premises only,and
WHEREAS, said applicant has paid the sum of TEN DOLLARS($10.00)to Weld County,
Colorado,pursuant to the laws providing therefore in payment fora County Retail Permit for the sale
of 3.2%fermented malt beverages for consumption by the drink on the premises only,for an event
scheduled for 11:00 a.m. until 8:00 p.m. on July 19, 2003, and from 11:00 a.m. until 7:00 p.m. on
July 20,2003,outside the corporate limits of any town or city in the County of Weld at the location
described as follows:
W 1/2 of the NW 1/4 of Section 7, Township 3 North,
Range 68 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said applicant has also paid the sum of TEN DOLLARS ($10.00) to the
Colorado Department of Revenue and has exhibited a State Special Events Permit for the sale of
3.2% fermented malt beverages for consumption by the drink on the premises only.
NOW,THEREFORE,BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant Special Events Permit Number 2003-03 to said applicant to sell 3.2%fermented
malt beverages for consumption bythe drink on the premises only,only at retail at said location;and
the Board does hereby authorize and direct the issuance of said permit by the Chair of the Board
of County Commissioners,attested to by the Clerk to the Board of Weld County, Colorado,which
permit shall be effective from 11:00 a.m. until 8:00 p.m.on July 19,2003,and from 11:00 a.m. until
7:00 p.m.on July 20,2003,providing that said place where the permitee is authorized to sell 3.2%
fermented malt beverages for consumption by the drink on the premises only,shall be conducted
in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating
thereto,heretofore passed by the Board of County Commissioners of Weld County,Colorado,and
any violations thereof shall be cause for revocation of the permit.

Note: if the event is to be held outside,please submit evidence of intended control,i.e.,fencing,ropes,barriers,etc.

A Special Event Permit issued underthis article may be issued to an organization,whether or not presently licensed under
Articles 46 and 47 of this title,which has been incorporated under the laws of this state for the purpose of a social,fraternal,
patriotic,political or athletic nature,and not for pecuniary gain or which is a regularly chartered branch, lodge or chapter
of a national organization or society organized for such purposes and being non profit in nature, or which is a regularly
established religious or philanthropic institution, and to any political candidate who has filed the necessary reports and
statements with the Secretary of State pursuant to Article 45 of Title'I, C.R.S. A Special Event permit may be issued to
any municipality owning arts facilities at which productions or performances of an artistic or cultural nature are presented
for use at such facilities.
If an event is cancelled,the application fees and the day(s)are forfeited.

Special Event Permit Questionnaire And Affidavit
1. An annual benefit event is being planned.
2. The event is to benefit the Ronald McDonald House of Charity by donating
proceeds from the event. The event is celebrating La Ley 1170 AM KJJD 5th Year
Anniversary. In its 5th year the station would like to thank its listeners,customers
and the general public by providing an event for the whole family. For example,
live music by famous Mexican Regional artist,clowns and a one-man circus act
for the children. This gives families who do not take part in nighttime leisure
activities the opportunity to listen and be entertained by there favorite Mexican
regional artist. Artists include local,national and international musical groups.
Simultaneously time KJJD will like to help out the Ronald McDonald House of
Charities for their hard work and contributions to the community.
3. Ronald McDonald House of Charities
4. 2500 people are expected for both dates Sat. July 19,2003 and Sun. July 20,2003
5. Attach is a sketch with dimensions of the assembly and location of dumpsters,
restrooms and water locations on the premises.An orange barricade fence will
fence of the premises.
6. Orozcos Security Agency will provide security services for the event. A team
large enough to handle this kind of event will be assembled.
7. 12 Security officers will be on sight. 3 will monitor the beer garden and check Ids.
8. Security officers will be identified because they will be using their security
uniforms.
9. An orange safety barricade fence will outline the premises and exterior
boundaries. The work will be performed by R&M Drain and Waterproofing.
Attached is a copy of the type of fence and a letter for work to be performed.
10. Mexican Regional Artist will provide live performances.
11. Wristband will identify anyone over the age of 21. People over the age of 21 will
be allowed to consume alcohol only in the beer garden area,which can be
identified in the drawing that is attached. Tampering with wristbands or the use of
fake identification will result in ejection of event. Any fake identification will be
handed over to proper authorities.
12. Conduct and intoxication monitoring,will be done by security officers and
bartenders serving the beer. A local bar TEXMEX will be assisting us with the
serving of alcohol. Any guest who is suspected of misbehavior because of
intoxication will be escorted from the premises reported to police.
13.Volunteers from local businesses with liquor license have committed to help serve
alcohol.
14.Water, soda and juices will be available on the premises.

15. The Ronald McDonald House of Charities has issued us a copy of their 501 c3 Tax
Form.
16. This event will receive publicity on the Radio,TV,posters visual in local
businesses and flyers. The targeted audience is the local Mexican Regional
listening audience,KJJD committed listeners. Also we will be inviting or
targeting any other people interested in enjoying this event.

business income under section 511 of the Code. If your organization is subject to this tax, it must file an
income tax return on the Form 990-T, Exempt Organization Business Income Tax Return. In this letter, we

business as defined in section 513 of the Code.
The law requires you to make your organization's annual return available for public inspection without charge
for three years after the due date of the return. If your organization had a copy of its application for

be liable for a penalty of S20 a day for each day you do not make these documents available fdr public

This letter is in response to your request for a copy cf your organization's determination letter. This letter will
take the place of the copy you requested.
Our records indicate that a determination letter issued in May of 1977 granted your organization exemption
from federal income tax under section 501(c)(3) of the Internal Revenue Code. That letter is stiff in effect.
Based on information subsequently submitted, we classified your organization as one that is not a private
foundation within the meaning of section 509(a) of the Code because it is an organization described in
sections 509(a)(1) and 170(b)(1)(A)(vi).
This classification was based on the assumption that your organization's operations would continue as stated
in the application. If your organization's sources of support, or its character, method of operations, or
purposes have changed, please let us know so we can consider the effect of the change on the exempt
status and foundation status of your organization.
Your organization is required to file Form 990, Return of Organization Exempt from Income Tax, only if its
gross receipts each year are normally more than $25,000. If a return is required, it must be filed by the 15th
day of the fifth month after the end of the organization's annual accounting period. The law imposes a
penalty of $20 a day, up to a maximum of 510,000, when a return is filed late,-unless there is reasonable
cause for the delay.
All exempt organizations (unless specifically excluded) are liable for taxes under the Federal Insurance

Organizations that are not private foundations are not subject to the excise taxes under Chapter 42 of the

legacies, devises, transfers, or gifts to your organization or for its use are deductible for federal estate and
gift tax purposes if they meet the applicable provisions of sections 2055, 2106, and 2522 of the Code.

The enclosed Special Events Permit Application was approved by the Weld County Board of
Commissioners on July 14, 2003, and I inadvertently neglected to submit the application to your
office for concurrent review to allow your staff the requested ten-day review period. I realize this
was a significant oversight on my part which will result in additional work for your staff; however,
the event is scheduled for this weekend, July 19 and 20, 2003, and I am requesting a special
accommodation and expedited review. Weld County Attorney, Bruce Barker, has reviewed the
application materials and found everything to be complete. If there is any way this paperwork
