It appears that individual lot boundaries have changed slightly,but overall density and development plans have not changed. Building envelopes are not identified on the site plan that was submitted with this referral. It would .�. be prudent to delineate building envelopes that specifically exclude the area within the 150-foot setback from all gas/oil wells and related facilities, and to exclude from building envelopes on lots 5 and 6 a setback area extending from 150 feet west of the ditch alignment to 300 feet east of the ditch alignment. If this does not leave enough space on proposed lot 5 for a building envelope, lot boundaries surrounding lot 5 may need to be reconfigured. This setback will reduce the likelihood that homes and septic systems constructed on lots 5 and 6 will be affected by low strength and saturated soils. No new geological or geotechnical information was submitted with this referral, so my comments regarding "additional, site-specific geotechnical investigations 'to determine soil strengths, swell potential and groundwater levels, and to provide recommendations for structural design,' once building locations are determined, have not changed. I visited the site on October 8, 2001. I understand the applicant proposes to subdivide this 34.9-acre parcel into five residential lots of approximately 4.6 acres each,plus one residential lot of 9.7 acres. Individual sewage disposal systems(ISDS) are planned for each of the six new lots, and the applicant states that domestic water service will be provided by Central Weld Water County District. I have several P"'N comments regarding the proposed development. 1. Soils and bedrock. With this referral,I received an Engineering Geology Report prepared by Church and Associates, Inc., dated June 28, 2001. This report describes the results of a geotechnical investigation consisting of three soil test borings and limited laboratory testing. Church's test results indicate that the subsurface soils consist of silty, clayey eolian sands and clayey, alluvial sands and gravels exhibiting low swell potential and low to moderate strength characteristics. The underlying bedrock consists of Laramie Formation claystone and sandstone, and is expected to exhibit high swell potential and moderate to high strength characteristics. A sample of eolian sand from one of the test borings exhibited collapse under pressure when wetted. 2. Foundation design. Considering the low-strength, hydrocompactive soils and expansive bedrock present at this site, it is very important that the site-specific maximum bearing and minimum dead- load pressures are determined and incorporated into individual foundation and footing designs. This will help minimize the risk of foundation damage due to differential settlement and heave. Additional foundation damage due to compaction and differential settlement can occur if water infiltrates the soils adjacent to and beneath the foundation as a result of, for example,residential irrigation. Proper grading, compaction and drainage must be incorporated into the development plans. Church's report contains appropriate recommendations for additional, site-specific geotechnical investigations "to determine soil strengths, swell potential and groundwater levels, and to provide recommendations for structural design" (page 4). 3. ISDS. The Weld County Soil Survey describes the soil units present over most of the new planned lots as having slight limitations for buildings and septic systems, except in the area surrounding the Lupton Bottom Ditch between proposed lots S and 6. The soils within this area have severe limitations for both dwellings and septic systems due to low strength and saturated soils. For all lots, individual percolation tests will be needed to design ISDSs, and the area surrounding the ditch should be avoided. The owner has notified oil/gas well owners and operators that the property is being considered for development, and North American Resources Company has responded that no additional wells are planned, although additional well operations may be performed. All wells,pumps,processing facilities and tank batteries within the residential development should be fenced and locked, with warning signs posted to protect residents from hazards associated with the machinery and possibly tainted soils. Prospective residents should be advised and a plat note should be included informing buyers that the oil/gas well pumps and related equipment may be loud, may pose a visual nuisance, and will require ongoing servicing and maintenance. Water Division 1, Water District 2 Dear Mr. Robert Anderson: We have reviewed the additional information submitted for the above referenced proposal to subdivide 34.9 acres into 6 residential lots. The proposed water source is the Central Weld County Water District (District). A letter of commitment for service was submitted. This commitment is based on the condition that the subdivision meets the requirements of Central Weld County Water District, Northern Colorado Water Conservancy District and the U.S. Bureau of Reclamation. The water supply information summary states that the proposal will require 2,700 gallons per day (3 acre-feet annually). Information submitted by the District shows that the District has approximately 5,787.3 acre-feet secure water supplies for a dry year. Currently, approximately 5,388.49 acre-feet have been committed which includes this proposal. Pursuant to Section 30-28-136(1)(h)(II), C.R.S. the State Engineer's Office offers the opinion that the proposed water supply will not cause material injury to existing water rights, and with the Central Weld County Water District serving the proposal, the supply is expected to be adequate. Wells, Jr. In consultation with the Natural Resources Conservation Service (NRCS) , we have reviewed the above referenced case and have the following comments . SOILS/LIMITATIONS: The soils on this parcel are classified as Loup-Boel loamy sand (35) , Valent sand (69) and Vona loamy sand (72, 73) ; the majority of this parcel consists of Vona loamy sand. Both the Loup-Boel and Valent sand soils exhibit rapid permeability rates resulting in severe limitations for septic system absorption fields . Construction of these structures may require special engineering designs or intensive maintenance. The Vona loam has minor limitations for septic systems. A high water table may exist in areas near the Lupton Bottom Ditch. PRIME FARMLANDS: Soils on this land parcel are not considered prime farmland. SOIL EROSION POTENTIAL: Runoff from these four soil types is generally slow with a low potential for water erosion. However, the potential for wind erosion is very high. It is recommended that disturbances to large areas be avoided, and areas that are disturbed be protected from wind erosion during construction activities. OTHER: We recommend that the applicant contact Ron Broda, Weld County Vegetation Management Specialist, for assistance in developing a weed management plan. The covenants, conditions and restrictions for the homeowner' s association permits up to two large animals per lot . Land that is allowed to be overgrazed or left idle increases the potential for soil erosion on the highly erodible soils of this parcel . We would recommend that the developer contact the NRCS office in Brighton for grazing criteria and revegetation information to be provided to homeowners . The sheriffs office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway. 2. Either a mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county roadway to obtain their mail. 3. The names of all streets within the sub-division should be presented to the sheriff's office for approval. This will eliminate duplication of street names within the county. 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division, address, and a graphical presentation of the roadways within the subdivision. There should be a plan developed to maintain this sign. 5. If the roadway within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the sheriffs office will have limited traffic enforcement powers. 6. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 7. The sheriff's office is very supportive of homeowner funded homeowners associations. These associations provide a contact for the sheriff's office and a means for maintaining common areas. 8. There is an oil well or tank battery within this development. This needs to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. The Sheriff's Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed.
