RE: ACTION OF THE BOARD CONCERNING DUST BLOWING COMPLAINT -SE1/4,
S22, T8N, R66W
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been
informed, in accordance with Section 35-72-101(1), C.R.S., that dust is blowing from property
located in the SE1/4, Section 22, Township 8 North, Range 66 West of the 6th P.M., Weld
County, Colorado, lying west of U.S. Highway 85, and said property being owned and/or
operated by Timothy and Elane Swaney, 1575 Weld County Road 90, Pierce, Colorado 80650,
and
WHEREAS, the Board has caused an inspection of the above described parcel of land,
and
WHEREAS, pursuant to the information and the inspection referred to above, a hearing
before the Board was held on the 26th day of March, 2003, at which time the Board made
Findings of Fact, pursuant to Section 35-72-101(1), C.R.S., and
WHEREAS, the Board has caused an inspection of the above described parcel of land,
and
WHEREAS, upon recommendation of the County Attorney, the Board of County
Commissioners deemed it advisable to continue this matter to April 2, 2003, to allow the
property owner time to meet with the West Greeley Soil Conservation Service and determine
the necessary treatment plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the dust blowing complaint for property owned by Timothy and
Elane Swaney be, and hereby is, continued to April 2, 2003, at 9:00 a.m.

The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 26th day of March, A.D., 2003.
