HomeMy WebLinkAbout20031523.tiff HEARING CERTIFICATION DOCKET NO. 2003-45 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1426 FOR A RECREATIONAL FACILITY(TWO SOCCER FIELDS AND ONE BASEBALL AND TRACK FIELD) IN THE A (AGRICULTURAL) ZONE DISTRICT - VISTA RIDGE DEVELOPMENT CORPORATION A public hearing was conducted on June 4, 2003, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Monica Mika Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated May 16, 2003, and duly published May 22, 2003, in the South Weld Sun, a public hearing was conducted to consider the request of Vista Ridge Development Corporation for a Site Specific Development Plan and Use by Special Review Permit #1426 for a Recreational Facility (two soccer fields and one baseball and track field) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Monica Mika, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Mika gave a brief description of the location of the site, and stated the applicant is proposing a recreational ball field to be used in conjunction with a school that is under consideration with the Town of Erie. She further stated this site will eventually be annexed as well, and she displayed photographs of the site and surrounding area. Ms. Mika stated seven referral agencies reviewed this case and all responded favorably. She explained Weld County does not have Coordinated Planning Agreements with some of the municipalities which were sent referrals, therefore, some of the conditions proposed by the towns were not included. Char Davis, Department of Public Health and Environment, stated she has no comments regarding this case. In response to Commissioner Geile, Ms. Mika explained there will be no structures associated with this site, therefore, Building Permits will not be necessary and there will be no transportation impact fees. She further stated the only structures will be a fence and a ball back stop, which do not require Building Permits. In response to Commissioner Masden, Don Carroll, Department of Public Works, stated Sheridan Boulevard, previously known as Weld County Road 5, was included as part of the Vista Ridge Annexation. He stated it was once part of a designated haul route for a land fill, which has been eliminated. He further stated there is one small area located south of the site which is still in the County; however, it is proposed to connect to Sheridan Boulevard as an access; however, that area is not part of this particular application. 2003-1523 C&�) !—W PL1664 �t /}L I l HEARING CERTIFICATION -VISTA RIDGE DEVELOPMENT CORPORATION (USR#1426) PAGE 2 Todd Hodges, Todd Hodges Design, LLC, represented the applicant and stated the roadways are planned to be granted or transferred to the Town of Erie. He further stated the Town of Erie has reviewed and approved the school site, while Weld County has been reviewing this proposal. Responding to Commissioner Geile, Mr. Hodges stated the fence issue has been resolved. James Spehalski, Vista Ridge Development, stated the members of the LLC are also the owners of the golf course. He stated they came to an agreement with the school to provide water for the golf course and the ball fields. Responding to Commissioner Masden, Mr. Spehalski stated the annexation will go to a vote of the people. No public testimony was offered concerning this matter. Ms. Mika requested Conditions of Approval #1.C, D, E, F, and G be deleted, and the applicant concurred with this request. Commissioner Vaad moved to approve the request of Vista Ridge Development Corporation for a Site Specific Development Plan and Use by Special Review Permit #1426 for a Recreational Facility (two soccer fields and one baseball and track field) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting of Conditions of Approval #1.C, D, E, F, and G. The motion was seconded by Commissioner Masden, and it carried unanimously. Commissioner Masden stated he appreciates the applicant working with the School District and the Town of Erie to build this project in conjunction with the school. There being no further discussion, the hearing was completed at 11:00 a.m. This Certification was approved on the 9th day of June 2003.
