MEMORANDUM OF UNDERSTANDING

THIS MEMORANDUM OF UNDERSTANDING is signed this 13 day of
September, 1982 , effective August 16 , 1982 , by and between THE
. WELD COUNTY BOARD OF COUNTY COMMISSIONERS ( "Board") , and MARTIN
J. and DEBORAH D. NORTON ( "Nortons") . The Nortons have been
using, as a temporary residence, a building located on Lot 10 ,
Black Hollow Acres Subdivision, also described as 8775 Weld
County Road 86 , for which a building permit as a garage was
applied for on September 2 , 1981 , under Building Permit #18482 .
The Board and the Nortons wish to resolve problems which have
arisen regarding compliance with the Weld County Building Code by
means of this Memorandum of Understanding.
THEREFORE, the Board and the Nortons agree as follows:
1 . The Nortons will , by October 15 , 1982 , bring the
garage, being used as a temporary residence, into compliance with
the minimum standards of the Weld County Building Code for a
single family residence, except that compliance with the footing
and foundation requirements of the Weld County Building Code for
a residence shall not be required due to the light weight of the
structure and the temporary nature of its use as a residence.
2. The Nortons will continue work on the individual sewage
disposal system in accordance with the Weld County Individual
Sewage Disposal System Regulations and obtain final approval from
the Weld County Health Department by September 24 , 1982 .
When, and if, the conditions set forth herein as items "1. "
and "2 . " are met, the Board will authorize the Weld County
Building Inspections Department to issue a Temporary Certificate
of Occupancy which will be reviewed and renewed annually for a
period of time, not to exceed four (4) years . The Temporary
Certificate will be renewed only if the Nortons demonstrate
reasonable progress toward the construction of a permanent
residence. Reasonable progress shall be determined in light of
the Nortons ' plan to complete a permanent residence using their
own labor within the next four (4) years and will include
consideration of item 4 . ,

3 . The Nortons will make application for a building permit
for the permanent residence on or before April 1 , 1983 .
4 . The Nortons will not attempt to represent the existing
structure, being used as a temporary residence, to potential
buyers as a residence at any time in the future. Further, the
Nortons agree to discontinue use of the temporary residence when
the permanent residence has been approved for permanent
occupancy.
These parties have authorized this Memorandum of
Understanding to be executed by their authorized officers .
