Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. The arbitrator's written decision must be delivered to both parties personally or by registered mail within ten (10) days of the hearing. Such decision is final and not subject to review. The first assessed value was$162,155 and increase of$35,355. This was then reviewed and the new value was for$153,248. This is still an increase of almost 21%over the last time the property was valued. Which doesn't seem to fit the market my house in located in. I have again attached calculations and an appraisal report that was done on March 3,2003. The appraised value as of that dated was only$143,000,so as you can see this proves that the assessed value is not in line with the market my house is in. That appraisal report is as of March 2003 and not the June 30,2002 date when my house was supposedly valued and property values in Greeley did not drop from June 2002 to March 2003. This was my basis for my first review that the county then reduced my assessed value to the $153,428. My calculations take the prior assessed value and take a 4%growth rate for the two years since the last assessed date to come up with a value of$137,147. This rate is approximate rate of growth for house over the two years. The next column of calculations is to back the appraised value to the June 30, 2002 assessment date. Taking the same 4%growth rate out for the 8 months back to June 30,2002 the value comes to$139,187. So taking into account that both calculations may have some variance the last column takes the average value of those two calculations to come up with a value of$138,167. These calculations come to an increase of about 9%from the last assessed value. This again seems to be more in line with the economy and also in line with houses in my area since the traffic on 23rd avenue decreases the value of the property significantly. Again this is how I appealed the value the first time. Since this approach was not fully accepted during my first appeal, I am also enclosing a copy of a market value approach report my real estate agent did on 13 properties that were sold in my area during the time frame of the assessment. I have attached her calculations for my property and all the 13 properties that were used in her calculation. She took into consideration adjustments for differences between the properties sold and my property,such as square footage,traffic for 23rd avenue,older homes, attached garage,and central air,to make the properties sold about what my property would have sold for. This approach came up with a value of$130,600. I believe the calculations,appraisal and market approach give me proof that an assessed value of$134,500 would be fair to me the property owner and the county. This is more than half way between my first approach that was rejected($138,200)and the new market approach($130,600). This is a fair value since my property is on 23`d avenue and hasn't risen like to prices of other areas in Greeley. I believe that with the new information I have provided that even my first approach value is high and that is why I have changed to a lower value. Please read and look over all the evidence and you will see that my value of$134,500 Is fair to both the county and me the taxpayer. It is higher than the market value approach but lower than the calculation approach,which makes it more valid as it takes both approaches into account and averages them for any inaccuracies that each approach may have. I am a citizen that knows everyone needs to pay their taxes, but I feel the citizens should only have to pay an amount that is fair. The period analyzed was June 1, 2001 through June 30,2002. The average price for 13 comparables was $130,600, after adjustments. The adjustments made were for major items: square feet, basement, and basement finish square feet, central air, and updating. I spoke with an appraiser, and he said his adjustment for a busy street was $10,000 to $12,000. I was conservative and used $8,000 for the busy street adjustment. You are assessing a value of $162,155 and increase of $35,355. This is an increase of almost 28% over the last time the property was valued. With a slow economy and housing not selling in the Greeley market like they were two years ago that percentage increase doesn't seem to be in line with the economy or the housing market. I have attached calculations and an appraisal report that was done on March 3, 2003. The appraised value as of that dated was only $143,000, so as you can see this proves that the assessed value is not in line with the market my house is in, and that is as of March 2003 and not the June 30, 2002 date when my house was supposedly valued. My calculations take the prior assessed value and take a 4% growth rate for the two • years since the last assessed date to come up with a value of$137,147. This rate is approximate rate of growth for house over the two years. The next column of calculations is to back the appraised value to the June 30, 2002 assessment date. Taking the same 4% growth rate out for the 8 months back to June 30, 2002 the value comes to $139,187. So taking into account that both calculations may have some variance the last column takes the average value of those two calculations to come up with a value of$138,167. These calculations come to an increase of about 9%from the last assessed value. Which again seems to be more in line with the economy and also in line with house in my area since the traffic on 23rd avenue decreases the value of the property significantly. I believe the calculations and appraisal give me proof that an assessed value of $138,167 would be fair to me the property owner and the county. I am a citizen that knows everyone needs to pay their taxes, but I feel the citizens should only have to pay an amount that is fair. This is the second time in a row I have had to appeal my assessed value so please update your records to show that I do live on a busy street that reduces the value of my property that way the next time these are done neither one of us has to spend extra time with the appeals process.
