RE: APPROVE PARTIAL VACATION OF SPECIAL REVIEW PERMIT #415 - KEITH
OLSON AND GUADALUPE MONNETT-OLSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #800451 dated June 4, 1980, the Board did approve Special
Review Permit #415 for a Open Cut Mine Operation for Gravel for Frontier Materials, Inc., on the
following described real estate, to-wit:
A parcel of land located in the NE1/4, Section 20
and the S1/2 of Section 17, all in Township 2 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, being more particularly described in said
Resolution #800451, and
WHEREAS, the Board has received a request from current property owners, Keith Olson
and Guadalupe Monnett-Olson, 1738 Weld County Road 20.5, Longmont, Colorado 80504, to
vacate that portion of said Special Review Permit#415, consisting of Lot B of Recorded
Exemption #3523, being in part of the SE1/4 of Section 17, Township 2 North, Range 68 West of
the 6th P.M., Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit #415 be, and hereby is, vacated.
BE IT FURTHER RESOLVED by the Board that vacation of this portion of USR #415
does not absolve Frontier Materials, Inc., of its responsibilities or obligations included in Colorado
Mined Land Reclamation Permit# M-1980-160.

Attached is a handwritten letter from Mr. Olson, dated October 7, 2003.

The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40.B.1 through 24-8-40.B.6 of the Weld County Code have been met. This
Recorded Exemption is approved with the following conditions in accordance with information submitted in
the application and the policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. The Applicant has proposed a well as the source of adequate water for Lot B. Property owners are
advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic
Use Only,"etc. Because each situation is unique,the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.
3. Topographic or physical features of the proposed Lot A, such as ravines, ditches, streams etc. may
limit the area available for a new or replacement septic system. Prior to recording the plat the Weld
County Department of Public Health and Environment recommends that the applicant review the
Weld County Code pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size
to allow the installation of a septic system the lot may need to be enlarged.
4. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 1313-17-4 RE-3523
B. A Weld County Septic Permit is required for the proposed home septic system(s)and shall be
installed according to the Weld County Individual Sewage Disposal Regulations. Please note,
the lot owners should verify with the nearest Town/City or Sanitation District to determine the
location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line
exists within 400 feet of the property and the sewer provider is willing to serve the proposed
structure, a septic permit cannot be granted by the Weld County Department of Public Health
and Environment.
C. In accordance with Chapter 8, Article II of the Weld County Code, Lot B shall be granted one
residential/agricultural access. Direct access from a public road shall be limited to one access
per legal parcel for residential use,no circle drives or additional accesses shall be granted.The
road shall be graded and drained to provide all weather access. Accesses shall be placed in
such a location as to have adequate sight distance in both directions,shall not be placed below
the crest of a hill or where physical obstructions are present and shall be a minimum distance
of 75 feet from any intersecting County or State roadway.
D. Lot A shall use the existing residential access point as no additional accesses shall be granted.
E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
F. County Road 20 1/2 is designated on the Weld County Transportation Plan Map as an arterial
road, which requires one hundred feet of right-of-way at full build out. There is presently sixty
feet of right-of-way. A total of fifty feet from the centerline of County Road 20 1/2 shall be
delineated right-of-way reservation for future expansion of County Road 20 1/2. This road is
maintained by Weld County.
72! The applicant shall attempt to address the requirements (concerns) of Mountain View Fire
Protection District , as stated in the referral response received March 4, 2003. Evidence of
such shall be submitted in writing to the Weld County Department of Planning Services.
H.' The applicant shall address the requirements of Weld County Department of Building
Inspection, as stated in the referral response received March 6, 2003. Evidence of such shall
be submitted in writing to the Weld County Department of Planning Services.
1 The applicant shall attempt to address the requirements(concerns)of the Saint Vrain Sanitary
Sewer District,as stated in the referral response received February 28,2003. Evidence of such
shall be submitted in writing to the Weld County Department of Planning Services.
J. The Longmont Soil Conservation District has provided information regarding the soils on the
site. The applicant shall submit written documentation that they have reviewed the information
and will use it to positively manage on site soils.
The applicant shall address the requirements of Weld County School District RE-1J as stated
in the referral response received March 10,2003. Evidence of such shall be submitted in writing
to the Weld County Department of Planning Services.
Al vehicles located on the property must be operational with current license plates, or be
screened from all adjacent properties and public rights of way,or be removed from the property.
All other items considered to be part of a noncommercial junkyard must also be removed from
the property or screened from adjacent properties and public rights-of-way.
M. The applicant shall submit a letter requesting that USR-415 for Aggregate Mining c/o Frontier
Materials be vacated from Lot B of this Recorded Exemption.
N. The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
O. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code,shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) All construction or improvements occurring in the flood plain as delineated on Federal
Emergency Management Agency FIRM Community Panel Map 080266 0850 C dated
September 28, 1982, shall comply with the Flood Hazard Overlay District requirements
of Chapter 23, Article V, Division 3 of the Weld County Code.
4) The installation of any septic system within the 100-year flood plain shall comply with the
Weld County I.S.D.S.flood plain policy.In accordance with the State of Colorado I,S.D.S.
Regulations, no septic system shall be installed with in the floodway.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
7) Potential purchasers should be aware that Lot B may not be eligible for a domestic well
permit which allows for outside irrigation and/or the watering of stock animals. The
State Division of Water Resources issues all well permits.
8) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
9) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non-
buildable if the lot owner is unable to obtain a well permit.The State Division of Water
Resources issues all well permits.
10) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code,
as recommended by the Mountain View Fire District.
11) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
12) Effective January 1,2003,Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the Weld County Road Impact Program. (Ordinance
2002-11)
13) Potential Purchasers are hereby notified that a gravel mining and processing operation
is located directly north of this property and west of the intersection of Weld County
Roads 20 1/2 and 7. Off-site impacts that may be encountered include noise from
trucks and equipment; dust from the processing facility.
14) Prior to the release of building permits on Lot B, the Lot owner shall verify with the
nearest Town/City or Sanitation District to determine the location of the nearest sanitary
sewer line. In accordance with the Weld County Code, if a sewer line exists within four
hundred (400) feet of the property line and the sewer provider is willing to serve the
proposed structure,a septic permit cannot be granted by the Weld County Department
of Public Health and Environment. Evidence of such shall be submitted in writing to the
Weld County Department of Planning Services.
15) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads;odor from animal confinement, silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and county roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps(o co.weld.co.us.
7. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
• Weld County Board of County Commissioners with a staff recommendation for denial.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 20.5 is designated on the 1-25 Mixed Use Development Area Structural Plan Map 2.2, Structural
Transportation Network, as a four-lane undivided secondary road, which requires a 100-foot right-of-way at full
build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback
is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The access shall be placed in such a location to have adequate sight distance in both directions and not below
the crest of a hill or where physical obstructions are present. (Lot B, 31-acre parcel)
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert. (Lot B)
Direct access from a public road shall be limited; only one access is allowed per legal residential parcel. No
circle drives will be allowed. In accordance with Chapter 8, Article II of the Weld County Code, this policy shall
apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within
municipalities or other counties that access Weld County roads are also subject to this policy. (Lot B)
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot A)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Please note, the lot owners should verify with the nearest
Town/City or Sanitation District to determine the location of the nearest sewer
line. In accordance with the Weld County Code, if a sewer line exists within 400
feet of the property and the sewer provider is willing to serve the proposed
structure, a septic permit cannot be granted by the Weld County Department of
Public Health and Environment.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
2) Topographic or physical features of the proposed lot A, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

Dear Kim:
Thank you for referring Keith Olson & Guadalupe Monnett-Olson Two-Lot Recorded Exemption to the School District.
The District has reviewed the development proposal in terms of future student impacts and available school capacity
and has the following RECOMMENDATION: the District is OPPOSED to the approval of this application due to this
development's impact on already overcrowded school facilities.
The Board of Education has established a District-wide policy of opposing new developments that add to the student
enrollment of schools projected to be at or above 125% of their capacity. This particular application, which is currently
located in the Prairie Ridge Elementary, Frederick Middle, and Frederick High School Feeder, will add 1 new single-
family dwelling unit with a potential impact of 1 additional student in this feeder. The District opposes this development
because, as indicated in the chart below, Prairie Ridge Elementary, Frederick Middle, and Frederick High schools will
exceed 125% of their capacity with the addition of students from this development. Please note, however, that the
District has adopted a mitigation policy that may allow for a reconsideration of this recommendation. The accepted
mitigation involves a voluntary per unit payment by the developer to assist in providing classroom capacity in this area.

The recommendation of the District noted above applies to the attendance boundaries current as of the date of this
letter. New school facilities approved under the 2002 bond could affect the project's attendance area and capacity in
the future, however, the facilities for this area are not anticipated to be constructed for several years.Attendance areas
and a resolution to capacity shortfalls will remain undetermined until new schools are near completion. In addition, the
School District is in the process of reviewing the effects of new facilities on the 2006 capacity projections listed in the
chart above. It is possible that these figures will change in the near future.Transportation would most likely be provided
under the current attendance boundaries.
Should the County decide to recommend approval of this development proposal, the School District's cash-in-lieu
and/or land dedication requirements would still need to be satisfied. This requirement involves the dedication of land
with the adjacent infrastructure or payment of an equivalent cash-in-lieu fee based on the student yield of the
development. Although cash-in-lieu fees are insufficient to help provide for construction of schools and resolving
capacity shortages, it does assist in the purchase of land for future school sites. Since this property is not a likely future
school site,the fee would be assessed per the attached chart. Please let me know of any further questions.

A building permit, MP03530, was issued for the installation of a mobile home. In addition, a
building permit, BC-9801127, was issued for the installation of a pole frame garage. Both of
these permits received final inspections and approvals. The following three permits were
issued but were expired because required inspections were not requested or performed:
BP43133 to demolish a 20' by 30' storage shed; BP43132 to construct a 40' by 80' steel
building to store farm equipment; and BC-9700623 to construct a carport with electrical and
water.
1. Separate building permits shall be obtained to complete inspections for the following expired
permits: BP43132; BP43133; BC-9700623.
2. Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and
Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must
be filed with the Planning Department and an electrical and/or plumbing permit is required for
any electrical service to the building or water for watering or washing of livestock or poultry.
3. A plan review is required for each building except for buildings that meet the definition of Ag
Exempt buildings. Plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for each permit.
4. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code;
1998 International Mechanical Code; 1997 International Plumbing Code; 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
5. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.

6. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
7. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
8. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

I have reviewed the submitted material pertaining to the recorded exemption for the Monnett-
Olson property, adjacent to 1738 Weld County Road 20.5 (Case Number: RE-3523). The Fire
District does not object to the request, but does have the following comments and requirements
should the applicant decide to construct a residence or install a modular home on any of the
parcels created:
• All construction shall be in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other codes and ordinances, as enforced
by Weld County.
• Water supply for fire protection may be required for a new dwelling. In instances when a
request is for a recorded exemption and not a subdivision, water supply for fire protection is
not required for a single family residence that is not larger than 3,600 gross square feet and is
placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet, or is placed
on less than 2.5 acres, water supply for fire protection may apply. All other structures may
require water supply for fire protection depending on the use of the new structure.

WHEREAS, the above-named decedent Lee Ervin Olson, in
his lifetime made and executed his Last Will and Testament

the County of Weld, State of Colorado, Probate No. 84 PR
228;
WHEREAS, the above-named decedent Florence M. Olson,
died intestate on January 27, 1985 and probate of her estate
was commenced February 11, 1985 in the District Court in and

51;
WHEREAS, Grantors were duly appointed Co-Personal Rep-
resentative of both Estates on March 13, 1987, and are now
qualified and acting in said capacity.
NOW THEREFORE, pursuant to the powers conferred upon
Grantors by the Colorado Probate Code, Grantors do hereby
sell, convey, assign, transfer and set over unto Grantees,
9 as tenants in common and not as joint tenants, for and in
consideration of One Hundred Twenty-Three Thousand Five
('n Hundred and no/100 ($123,500.00) Dollars the real property
situate in the County of Weld, State of Colorado which is
more particularly described on Exhibit A attached hereto and
incorporated herein (the "Land");
Together with all water, water rights, ditch, ditch
rights, reservoir, reservoir rights owned by Grantor which
are used in connection with the Land but expressly excluding
therefrom one share of capital stock of the Godding, Plumb &
Dailey Ditch Company and any and all water and water rights
relative to such share, but expressly including in this
conveyance to Grantees all Left Sand water taps owned by
Grantors;
Together with all of Grantors' interests in all sand
and gravel which is on or under the Land together with all
of Grantors' interests in all gas, oil, hydrocarbons and
other minerals which are on or under the Land, together with
all of Grantors' interests in all oil and gas leases owned
by Grantors which relate to and only as they relate to the
Land. Grantors are the Lessor under a certain oil and gas
lease recorded January 17, 1980 in Book 893 as Reception No.
1814538 (extension of which was claimed by Affidavit of
Production recorded July 7, 1982 in Book 971 as Reception
No. 1896725 (the "Oil and Gas Lease") . For all purposes
hereof, the interest of Grantors in the Oil and Gas Lease
which is conveyed hereunder represents a 37/211.82 interest
in the 1/8 royalty granted to the Lessor under the Oil and
Gas Lease.
With all appurtenances, subject to covenants, ease-
ments, restrictions and all other matters of record.
As used herein, the singular includes the plural and
the masculine gender includes the feminine and neuter
genders as the context may require.
