The Town of Johnstown recognizes this responsibility and can successfully provide these services to those under consideration by the Town. The Town of Johnstown has adopted a Comprehensive Plan and Community Development Code that both describes and requires future development within the Town to meet standards that will provide the same level of service to new areas as it is currently providing within the existing town. These documents, we believe allow the Town to achieve controlled, orderly and efficient growth. To accomplish orderly, controlled growth in terms of annexation, Johnstown will rely on the Town's Development Code and Comprehensive Plan to provide the basic guidelines for development and construction of new areas around the Town. Klein Annexation The property included in this annexation is to be known as the Klein Annexation to the Town of Johnstown. This property is contiguous to the Town of Johnstown and the total area of this annexation is 125.20 acres +/-. The parcel included in this annexation is currently used for agricultural uses and will be annexed into the Town under the zoning of PUD-R - Planned Unit Development Residential. An additional parcel owned by the DWD Investment Group is also included in this annexation. This property will be zoned PUD-MU (Mixed Use). When the Hamilton West annexation was done there was a triangular shaped piece of property located in the southeast corner of the Hamilton West property that was not annexed. This was due to the fact that there are two center quarter corners in that area which created a triangular shaped piece of property that the ownership was in question. Imago Enterprises quit claimed their interest to the DWD Investment Group and we have included this parcel in this annexation. A copy of the quitclaim deed is enclosed with this report. A series of slanted gray lines represents the Town's current boundaries. The property lines surrounding the 129.55-acre parcel shown on the annexation map identify the proposed boundaries. Property Ownership Information Please see the attached ownership portions of the Title Commitment and Quit Claim Deed submitted under separate cover. Water Rights Information The developer Imago Enterprises currently owns and controls 10 shares of Consolidated Home Supply Ditch and Reservoir Co. that was transferred with the sale of the west half of the property. Another 10 shares will be included in the sale of the east half of the property to Imago Enterprises. The 20 shares of Home Supply Ditch serve 160 of the proposed residential units within the Klein Annexation (at 8 units/share). These water rights will be transferred to the Town (per the Town's ordinances) at the time the final plat is completed and the plat and development agreement are recorded with Weld County. If additional water rights are required, additional shares of Consolidated Home Water Supply will be purchased by the Developer to satisfy the water demand requirements of the project prior to the platting of additional parcels within the project. These water rights shall be purchased either on the open market or from the 5 Town if the Town has shares available at the time of development or the requirement may also be satisfied by paying cash-in-lieu fees to the Town as currently allowed in the Town ordinance. The developer is also requesting that the Town lease back to the Developer the water shares from Home Supply at the current market value to allow agricultural uses to continue on the property until development occurs. Existing and Proposed Infrastructure The Rocksbury Ridge development has extended the water and sewer lines to the south property line of the Klein Annexation. A 12-inch sewer line and an eight-inch water line have been stubbed out at the River Rock Drive right of way located in the center of the south property line of the Klein Annexation. Additionally a 12-inch sewer line and a 20-inch sewer line will be constructed in High Plains Blvd. and stubbed out at the south west corner of this property. The proposed water and sewer lines are shown on the preliminary utility plan shown on Map 2 of this Impact Report. It is proposed that the developer would extend all required utilities per the Town Code to the property as required. All roads and streets within and adjacent to the property would again be extended and constructed per the Town's Subdivision Regulations. Financing of Municipal Set-vice Expansion As stated above, the Town of Johnstown will require that the Developer bear the cost of any required expansions to the Town's utilities and roads. The developer may enter into a cost sharing (reimbursement) agreement with the Town that allows the Developer to be reimbursed for any improvements that benefit other properties as these properties develop and connect into these improvements. The Developer will most likely finance any required improvements and expansions through private funds and construction loans secured by the property. Existing Land Use The current zoning is - Weld County A-Agricultural The current land use is agricultural. Project Concept/Proposed Land Use and Zoning The proposed zoning is PUD R - Planned Unit Development Residential. The proposed PUD-R residential zoning district is consistent with the town's Land Use Plan and promotes the potential for a well-integrated mix of land uses in this area of Johnstown. This integrated mix of land uses includes the town's community park site and a school site contiguous to the east on the Cito Property, future higher density residential and commercial/employment uses directly west on the 6 Hamilton Annexation, and the nearly fully-developed 380 single-family lot Rocksbury Ridge Subdivision adjoining to the south. The east 80 acres of the Hamilton Annexation across from the Klein Annexation are approved for 600 multi-family units with a potential for 20 dwelling units per acre, and the west 80 acres of that annexation along I-25 are approved for 80 acres of industrial and retail uses. Considering 1) the adjoining multi-family land uses directly west, 2) the developed single-family directly south, 3) the park and school sites directly east, and 4) the potential for a major commercial/employment center one-half mile to the west, the Klein Annexation is well- positioned for a medium density, mixed residential neighborhood. Such density averaging approximately 4 du/ac would use the PUD approach for more creative and imaginative site design than a conventional, standard residential subdivision. The higher densities, 4 to 5 du/ac, possibly including patio home, duplex, and town home lots, would be closest to High Plain Boulevard. Densities would be reduced going east, with the east half of the property adjoining the community park and school sites consisting of single-family detached lots of varying lot sizes at 3 to 4 du/ac. A strong sense of neighborhood and attractiveness would be achieved through the following site planning element: 1. A mix of unit types appealing to a wide range of homebuyers and income levels and avoiding monotonous, repetitious housing design. 2. On-site amenities, including vest pocket parks, a swimming pool and common building, landscaped intersections, custom street signs and mail box shelters, decorative paving, and etc. 3. The use of color, varying setbacks, architectural variety, central open space areas, entry treatment, and etc. Setbacks along High Plains Boulevard will be similar in depth and landscape treatment to the Rocksbury Ridge Subdivision, thereby creating a unified design for one mile along the east side of High Plains between Highway 60 and 50. An objective of this annexation is to advance this property to the stage where general land use and conceptual design components are determined so that more detailed, site planning, engineering and marketing can proceed. During subsequent stages of development review by the town, specific concerns such as building elevations, covenants, landscaping and the overall "feel" and attractiveness of future development on this property will be addressed. A copy of the Outline Development Plan (ODP) is attached to this Impact Report. Natural and Man-Made Site Features The site is approximately 125 acres in size and is located on the south side of CR 50 7 approximately one half mile east of I-25. The site is a part of the north half of Section 2, Township 4 North, Range 68 West of the 6th Principal Meridian, Weld County, Colorado and a part of the southeast quarter of Section 35, Township 5 North, Range 68 West of the 6th P.M., County of Larimer, State of Colorado. It is bounded to the north by John and Victoria Nelson's farm; zoned agricultural in Larimer County; and to the east by Donald Cito's farm; zoned agricultural in Weld County; to the south by Rocksbury Ridge; zoned SF-1 in Johnstown, and to the west by the Hamilton Annexation; zoned PUD-MU in Johnstown. The property is currently being used for fanning and agricultural. There site slopes to the northeast and southeast at approximately 2%. There are concrete lined irrigation ditches located on the property that are currently in use for agricultural purposes. There is a 50-foot Kerr McGee gas easement that runs from the south property line to the center of the property to an abandoned gas well. This easement will need to be extended to the north property line to CR 50 as part of an agreement with the gas company. Additionally there are 3.44 acres offsite on the DWD Investments property that will be zoned PUD-MU. Public Use Dedication The proposed development is required to dedicate 10% of the total site for parks and 30% for open space as per the Town's Subdivision Ordinance. The Developer is proposing to dedicate acreage in the detention pond area for recreational use, linear park acreage for trail connections, landscaped open space areas adjacent to roadways, acreage for recreational use such as pocket parks and a swimming pool. Vehicular, Bike, and Pedestrian Circulation Vehicular access to the site shall be from State Highway 60 north on High Plains Blvd. and Weld County Road 50. Internal circulation shall be by public roads within the project with exact alignments determined at the lime of platting. All roads shall be dedicated to the Town of 8 Johnstown. Bike and pedestrian circulation shall use the public roads as well as open space areas throughout the project to provide connections to the dedicated open space and any future trail systems throughout the Town. Development Phasing and Schedule It is anticipated that Phase I will include portions of the planning areas B and D and that construction is expected to begin in the spring of 2005 with additional phases constructed as the market dictates. A phasing plan will be provided to the Town at the time of final platting. Fiscal Impact Development of the Klein Annexation will help the Town of Johnstown by attracting commercial development that follows residential development resulting in jobs and commerce. Additionally tax revenue generated from the approximate 400 homes in the Town of Johnstown will help the Town of Johnstown financially. Use tax, park fees, water and sewer tap fees will enable the Towns services expand to meet further development needs within the Town of Johnstown. Pre-Annexation Agreements At the current time, there are no drafts or pre-annexation agreements with the Owners, Developers and/or Town. It is anticipated that the Owner/Developer and Town will enter into an Annexation Agreement per the Town's standard "Annexation Agreement" format prior to the public hearing for the annexation. A copy of the Town's annexation agreement outline is attached to this Impact Report. School Impact: The projected number of students at full development of the proposed project based upon the Weld County School District RE-SJ student generation factors: (based upon the Districts' student generation rates and a total of 411 residential units). Elementary School 0.345 students/DU 142 students Middle School 0. 1 70 students/DU 70 students High School 0. 195 students/DU 80 students Total Projected Students a full build-out 292 students It is anticipated that the development would generate additional tax revenues for the school district and that these revenues would help offset any required capital construction costs required to educate students generated from this development. It is estimated that the yearly cost to educate such students would be $ 5,173 per student for a total yearly cost of $1,510,516 based upon 292 projected students at full build out of the project. These amounts are based upon the Districts' current formula for state aid. 10 Statement of Conformance with the Johnstown Comprehensive Plan The applicant and owner of the property known as the Klein Annexation are requesting annexation and zoning, to the Town of Johnstown, Colorado. The applicant believes that the proposed annexation and zoning meet the intent of the Johnstown Comprehensive Plan for the following reasons: 1. By allowing the annexation and zoning to proceed as proposed the applicant has met the following provision as stated in the Comprehensive Plan: a. Allows the Town further control of the Planning Area west of the downtown area between Johnstown and 1-25 as identified in the Comprehensive Plan thus allowing the Town to help shape the character of development in the Town's influence area. 2. The following Goals and Visions of the Comprehensive Plan are also met as follows: a. Preserve and enhance the Town's sense of community, including the assimilation of newcomers to the community. b. Within the growth constraints established by the Comprehensive Plan, ensure that property owners have equal opportunity to realize the fair market value of their property valves throughout the Planning Area. c.
