Separate building permits are required for all monument signs. Signs shall adhere to Section 42 of the Weld County Zoning Ordinance and Section 2.8 of the Weld County MUD Ordinance as applicable. Engineering may be required. 3. Engineered foundations, structures, and building systems are required for all commercial buildings. Engineered foundations shall be based on a site-specific geotechnical report performed by a Colorado licensed engineer. Any fill material shall contain no rock or similar irreducible material with a maximum dimension greater than 12 inches. All fills shall be compacted to a minimum of 90 percent of maximum density. Engineering reports shall be supplied for all fill material. 4. All buildings or structures shall maintain distances from property lines and adjacent buildings as outlined in Table 5-A of the 1997 Uniform Building Code. 5. All structures shall conform to the 1997 Uniform Building Code, 1998 International Mechanical Code, 1997 International Plumbing Code, 1999 National Electrical Code, and the current Weld County Building Code Ordinance. 6. Setbacks to oil and gas facilities shall be as required by The Weld County Zoning Ordinance. 7. Development documents shall be supplied to the Mountain View Fire Department for review. The proposed water source according to the subdivision application is the Little Thompson Water District. A letter of commitment for service has been submitted, however, the letter obligates service for only 13 commercial lots. Since 15 lots are proposed, evidence must be submitted that all lots will be serviced by the District, prior to final platting. The District will supply treated water to the development. As a condition of activation of the taps, the applicant must transfer Colorado-Big Thompson (CBT)raw water for each lot, administered by the Northern Colorado Water Conservancy District, to Little Thompson Water District. The applicant must provide evidence that the CBT water has been transferred to the District prior to final platting. The amount of CBT water that must be transferred varies based on the tap size(see below). Comments made during this phase of the Planned Unit Development may not be all inclusive,as other concerns or issues may arise during the remaining application process. COMMENTS: Internal Roadways: I have reviewed the new layout for this development. The internal streets meet the requirements of Chapter 24 of the Weld County Code. Roadway plans will be required at final plat. External Roadways: I will need a letter from the adjacent landowner verifying that he is willing to dedicate the necessary right-of-way for the frontage road and for the future connection to WCR 9.5. The frontage road right-of-way shall be dedicated to CDOT, and the connection right-of-way shall be dedicated to Weld County. Since the alignment for the 9.5 connection has not been finalized, the width of the right-of-way should be 100 feet to provide for minor alignment changes and turn lanes. According to Weld County GIS data,Mead Road north of State Highway(SH)66 is aligned 30 feet on each side of the sixteenth section line. The developer will need to complete a boundary survey to verify the new frontage road will align with Mead Road. Traffic Study: The traffic study submitted with this development stated that SH 66 will operate 18%over capacity in the year 2020. This includes the widening of SH 66 to 4 lanes. The engineer has submitted supplemental information stating that this project will contribute 10%of the traffic on this section of SH 66. The developer will be required to escrow funds to pay for improvements to SH 66 to mitigate his traffic impacts. Drainage Study: The drainage study was included in my packet. There are several minor issues. I have discussed them,by phone, with the engineer. The drainage study should be modified to include: references for all formulas pond sized to hold the 100-year storm,releasing at the 5-year storm pond slopes at 4:1 a method of converting the point discharge to overland flow before leaving the site RECOMMENDATION: Approval DEVELOPMENT CONDITIONS (If Approved): ♦ Roadway plans shall be submitted with the final plat. f A letter from the adjacent landowner agreeing to dedicate the necessary right-of-way to reconfigure the frontage road and to provide a connection to WCR 9.5. 4 An Improvements Agreement including an escrow account for the direct traffic impacts of this project on the adjacent roadways. ♦ A revised drainage study. f A Boundary survey of the properties north of SH 66 to verify the frontage road/SH 66 intersection alignment. Road names within the PUD cannot duplicate existing street names elsewhere in the county. Pacific Circle is too similar to existing derivatives of Pacific already existing in southern Weld County. It is very important for individual addresses to be prominently displayed and easily visible from the roadway to facilitate emergency response particularly during darkness. Street name signs must also be prominently displayed and easily visible at all intersections with the proposed frontage road in the development. 2. The I-25 frontage road is used to temporarily re-route all traffic on north or southbound I- 25 in the event either are closed due to an accident or hazard. This contingency is outlined in the 1-25 Incident Management Plan. Use of the frontage road by the additional traffic volume identified in the study will significantly add to congestion when this occurs. Fortunately, the frequency of occurrence is probably 1-2 times a year for a matter of hours. The developer needs to be aware of this condition. 3. A 6-foot walking path is shown on the drawings but no detail is included in the project narrative. Additional information will be necessary. At this point, there are potential concerns pertaining to the safety of persons using this trail. 4. Without additional staff in accordance to the ten-year projection provided to the Board of Weld County Commissioners, the Sheriff's Office is not able to provide law enforcement services to new residents beyond 2001. Impacts anticipated at this time include private lot property damage vehicle accidents, increased call frequencies from incidents such as shoplifting, fraud, robbery, etc. The Sheriffs Office cannot absorb additional responsibilities without additional resources. The Fire District does not object to the request for Change in Zoning provided the development meets the requirements of the Fire District. All applicable codes as they pertain to water supply, fire hydrant locations, fire department access, and street designs must be met. Fire hydrant locations will need to be approved before the final plat is approved. Construction plans for the utilities showing the location of fire hydrants, the size of water mains and available fire flows must be submitted to the Fire District for review and approval prior to beginning construction of the subdivision. The submittal must include a water supply analysis indicating the available fire flow at the most demanding point in the water system. We appreciate being involved in the planning process. As you may know, the Town of Mead has entered into an intergovernmental agreement with Weld County which, if implemented, would have Weld County sending this individual to the Town for consideration of annexation if the property is contiguous to an existing Town boundary. We believe that this property meets that requirement. We hereby request that this process stop and that the individual work with the Town of Mead to annex the property. Health Department COLORADO 2 CASE NO.: Z-555 NAME: Lyons 66 Pacific The Weld County Health Department has reviewed this proposal. A member of our staff has also observed the site. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the Little Thompson Water District and sewer will be provided by St. Vrain Sanitation District. Will serve agreements from both districts were included in the application materials. The impact plan provided in the application appears to meet the requirements of the PUD ordinance. The specific uses in the PUD were not identified in the application. Additional review will be required as each use is subject to the Site Plan Review process. The Department recommends approval with the following conditions: 1. The applicant shall obtain water service from the Little Thompson Water District. 2. The applicant shall obtain sewer service from the St. Vrain Sanitation District. 3. The applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment, if required. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 4. During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. a. If land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months induration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 6. The Right to Farm statement as included in the Weld County Comprehensive Plan dated October 31, 2000 be required to be placed on any recorded plat. Below are a list of items that CDOT has addressed: • CDOT is aware of the County's plan to build Weld County Road 9%. Our Region Transportation Director, Karla Harding,has asked that a meeting between Weld County and CDOT be held to help determine CDOT's position regarding this new county road,and its relationship to our frontage road. I will be arranging for that meeting sometime in the month of January. • Regardless of the construction of WCR 9'%, CDOT will grant direct access to the Davis property by way of State Highway(SH)66 and the east frontage road. At this time,that intersection is planned as a full movement intersection. • Right-of-way needs for SH 66 are being determined by the CDOT design engineer working on the 125 widening project. That information will be forwarded to the County once we receive it. • Mr. Davis has been advised that the segment of state highway within his site may someday become a cul-de-sac, and the access to SH 66 limited. The SH 66/125 EFR intersection may someday become a right-in/right-out/left-in access. It is also possible that the access may be limited to right-in/right-out only. • Mr. Davis has agreed to realign the existing frontage road as per CDOT's specifications. • CDOT recommends that the County require Mr. Davis to create an access easement through his site to the east property boundary in anticipation of a connection to the new WCR 9'%. • CDOT also recommends that a development agreement be drafted between the County and Mr. Davis acknowledging the possible changes to the SH 66/125 EFR access. Such an agreement should address the relationship of WCR 9'%to this site. The final plat should also address possible changes to the SH 66/125 EFR intersection. I hope that I have addressed the County's concerns regarding this site. CDOT is prepared to work with Mr. Davis and his staff on this development. Otherwise we have to accept their intersection design which against our decision at scope meeting. In case we follow their design, how can we get the R.O.W. for the construction of the access they located it out off their land boundary and before our job on advertisement? Since we layout the new bridge across I-25 at south of SH 66, a 60 ft.(min.)wide R.O.W. will be required from the existing south side fence(or ROW)of SH 66. Please ask the developer to reserve that strip of land for SH 66 widening. For the proposed 1-25 frontage road (72'ROW),the curve tying with the existing frontage road should fit in with 40 mph (min.)design and the next curve at northeast shall be for 35 mph design. The drainage system in the developer's plan shell be incorporated with the facility of t-25 interchange and shall have enough capacity to handle the upstream storm flow.
