Our comments and requirements are as follows: COMMENTS: The Colorado Department of Transportation, CDOT) has jurisdiction over all access to the state highways. Please contact Gloria Hess-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional requirements that may be necessary to obtain or upgrade the permit. The access is from State Highway 66. Our most current average daily traffic count (ADT) reflects 5,200 vehicles taken in a 24-hour period in 1995 on State Highway 66 at this location. REQUIREMENTS: Storm Water Drainage: The storm water drainage will be handled by two retention ponds and two settling ponds located at the south end of the feeding facility. The retention ponds will be maintained and operated in accordance with the Colorado Confined Animal Feeding Patrolled Regulation. I am referring the storm water drainage and the complaint to the Department of Health and Environment, which has jurisdiction over any use by special review that would deal with animal units. Circulation: All feed alleys shall be surfaced with gravel and shall be graded to prevent drainage problems. There is adequate parking and circulation throughout the elevator and office building. Right-of-Way: The applicant shall indicate on the plat drawing the existing and/or future right-of-way for State Highway 66. I have researched the section line between Sections 29 and 30, T3N, R67W. We recommend for approval of the dairy with numerous recommended conditions and standards. We have attempted to simplify our referral by separating the proposed conditions into conditions of approval and development standards. The following are recommended to be conditions of approval: 1. Prior to recording the plat: A) The facility shall demonstrate compliance with the Confined Animal Feeding Operations Control (CAFO) Regulations and the additional requirements outlined below. This shall be demonstrated by submitting a comprehensive manure and waste water management plan, for a 2,500 head dairy, to the Weld County Department of Public Health and Environment for review and approval. This plan shall include, but not be limited to the following: (1) Demonstration that all manure stockpile areas and waste water collection, conveyance, and retention facilities are adequately sized and constructed to handle and retain the storm water run-off generated from a twenty-five year, twenty-four hour storm event. This shall be conducted by a Registered Professional Engineer . (2) Demonstration that any proposed waste water retention structure will be constructed in accordance with the CAFO Regulations and to have a seepage rate not to exceed 1/32"/day. The demonstration shall be conducted by a Registered Professional engineer. (3) A site map demonstrating the layout of the site. This should include the locations of all pens, structures, feed storage areas, Page 1 any water courses through the property, manure storage areas, lagoons, etc. (4) A surface contour map which demonstrates all surface water control features on the site. This should include surveyed surface elevations, indicate flow direction, run-on and run-off control features, etc. (5) Demonstration that the facility has the ability to manage, dispose, and/or land apply manure and waste water at agronomic rates in accordance with the CAFO regulations. (6) Demonstration that adequate measures are in place to prevent any discharges except those which are allowed by the CAFO Regulations. (7) Other necessary measures which are required in order to comply with the CAFO Regulations. (8) A description of the types of records that will be maintained on the facility, as required by the CAFO Regulations. (9) Evidence that the site is graded to convey stormwater or other waste waters to retention facilities in order to prevent stagnant or pooling water. B) In accordance with CAFO, the applicant shall submit the facility's manure and waste water management plan to the Colorado Department of Public Health and Environment for review and comment. C) Dust abatement, fly control, odor control, and pest control plans shall be submitted to the Weld County Department of Public Health and Environment for review and approval. D) Due to the age of the system, an ISDS evaluation is required for the septic system currently serving the home on the property. In the event the system is found to be inadequate, the system must be brought into compliance with current ISDS regulations. The following are recommended to be development standards: 1. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 2. All liquid and solid waste shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Page 2 3. There shall be no permanent disposal of solid wastes, as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site. 4. The facility shall maintain compliance with Confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and the Weld County Code, as amended. 5. The facility shall adhere to the maximum permissible noise levels allowed in the Light Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended. 6. Any required CDPS Permit shall be maintained in compliance with the Water Quality Control Division of the Colorado Department of Public Health & Environment. 7. The facility shall not discharge run-off or other waste waters to surface or groundwater with exception to what is allowed by the Confined Animal Feeding Operations Control Regulations. 8. Wastes materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath the manure storage areas shall be of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operations Control Regulation (5 CCR 1002-19). 10. The facility shall be operated in accordance with the approved odor abatement plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgement of the Weld County Health Officer, there exists an odor condition requiring abatement. 11. A spillage retention berm shall be required around any fuel container with a volume greater than 50 gallons. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 12. The facility shall be operated in a manner to control flies. The facility shall be operated in accordance, at all times, with the approved fly control plan. Additional fly control measures shall be implemented at the request of the Weld Page 3 County Department of Public Health and Environment in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Department of Public Health and Environment receives a significant number of fly (associated with facility) complaints, and in the judgement of the Weld County Health Officer, there exists a fly condition requiring abatement. 13. With exception to the existing septic system serving the residence on the property, all sewage disposal shall be conducted via the St. Vrain Sanitation District. The existing septic system located on the property must comply with all provisions of the Weld County Individual Sewage Disposal System Regulations. Should the septic system serving the existing home require replacement, the residence shall connect to the St. Vrain system. 14. There shall be no burning conducted at the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. 1 of the Colorado Air Quality Control Commission Regulations. 15. The facility shall be operated in accordance with the approved manure and waste water management plan. 16. No cattle shall have direct access to Waters of the State except access that is allowed per the Confined Animal Feeding Operations Control Regulation (5 CCR 1002-19). 17. All process waste water (not meant to include stormwater), as defined by the Confined Animal Feeding Operations Control Regulation, shall be discharged to the St. Vrain Sanitation District. The facility shall comply with all requirements of the District. 18. The facility shall be operated and maintained in a manner to prevent nuisance conditions. 19. The facility shall be operated in a manner to control pests. The facility shall be operated in accordance, at all times, with the approved pest control plan. USR-1405 There are no current or historical building permits on record for this property. 1. A building permit shall be obtained prior to the construction of the milking parlor. Buildings that meet the definition of an Ag Exempt building as specified in Section 29-3-206.13 of the Weld County Code do not need building permits, however those buildings shall obtain a Certificate of Compliance in accordance with Section 29-3-20B.13b. An electrical permit and/or plumbing permit shall be required for any electrical work or plumbing allowed in an Ag Exempt building. Pens or corrals do not require building permits. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. While this is an accurate statement, the property is located in the Flood Plain as delineated on FIRM Community Panel Map 080266 0855C for the southeastern area of the parcel. Should any development occur in this area, a Flood Hazard Development Permit may be required. This information shall be submitted prior to obtaining any building permits on site. The property is also identified on the Weld County Sand and Gravel Resources Map prepared from information obtained from the Colorado Geological survey, Special Publication 5-A dated 1974, identifies this parcel as having a Land Use classification of: Stream Terrace Deposits, with a Resource ,.� classification of: Gravel, relatively clean and sound, (T-1). Given this determination, prior to any development of this parcel, the applicant shall obtain a letter from the Colorado Geologic Survey stating that this is not a viable mineral resource that should be mined prior to this development occurring on site. This letter shall be submitted prior to scheduling the Planning Commissioners hearing. The application materials state that this will be a 2500 milking cow facility employing approximately twenty to twenty-five (20-25) employees in three shifts twenty-four hours each day, seven days each week. Given this number of employees, the Department of Planning Service shall require fifteen parking spaces, including two of the fifteen spaces for large vehicle loading, i.e., the semi-tractor trucks associated with the proposed operation. The application states that a separate Landscape Plan is to be submitted. The referral notice received did not include such drawings, nor was there discussion in the text of the application addressing the Landscape Plan requirements and intentions. This information shall be submitted for review and approval prior to recording the USR Plat. Drawing C-1, dated October 8, 2002 delineates the existing site conditions and surrounding property owners. It is noted that the property immediately east of and adjacent to this proposal is also under the ownership of the Aurora Dairy Corporation, yet it is not included in the application. The applicant shall provide evidence why this property is not part of this application. Drawing C-2, dated October 8, 2002 delineates the Site Layout. The perimeter access road to the dairy operations appears to originate in the northwest corner of the site north of the identified stormwater containment berm at an asphalt pad having a retaining wall on the west and south edges. es- SERVICE,TEAMWORK,INTEGRITY,QUALITY It is unclear how this access road is effectively utilized given that the road originates from a retaining wall and crosses the stormwater containment berm without a delineated bridge or piped crossing. Further clarification is required from the applicant. There are two thirty-six (36) inch CMP pipes delineated on the drawing that are located off of the Aurora Dairy property, however, it appears that the pipes may convey overland flow of waters from the dairy property into a retention basin owned by a third party (Sekich). The applicant shall provide assurances that the waters conveyed to this parcel do not originate from the dairy property. Rough estimates indicate that the property slopes from the north to the south at a grade of approximately four (4) percent. There are two areas where the grade exceeds this detemination. Area 1 is through the silage pit area. Existing grades at this location are approximately five (5) percent overall, the area to the south of the pit approaches twelve (12) percent slopes. Area 2 is south of the milking parlor and within the 125,000 square foot corral. Cross slopes at this location approach seventeen (17) percent slopes. The Department of Planning Services suggests that a Final Grading Plan be submitted for review by the Departments of Public Health and Environment, Public Works and Planning Services prior to recording the USR Plat. It is requested that the plan demonstrate that the proposed grading will accommodate the proposed access road(s), silage pit and provide for effective stormwater flow, diversion, retention and release. Drawings C-1 and C-2 shall also be amended to delineate the following at a minimum: 1. USR Boundary shall be a heavy line 2. Grading Plan delineating the existing and proposed topography 3. The entire property should be delineated on each sheet r• Drawing L-1, not reviewed and not submitted as previously stated shall include: 1. All berming and changes in topography, as delineated on drawings C-1, C-2 2. Detail study demonstrating how the proposed berm will transition back to proposed grade 3. Placement of all plant material, including a vegetative cover for side slopes 4. Landscape Legend: Deciduous Trees: Identify Common, Botanical Name, including cultivar if any. Call out number, size shall be 1.5" calipher minimum, trees to be balled and burlapped (B&B), guyed and staked in all locations. Evergreen Trees: Identify Common, Botanical Name, including cultivar if any. Call out number, size shall be six (6) foot minimum, trees to be balled and burlapped (B&B), guyed and staked in all locations. All plant material shall have a different symbol. The property named is within the boundaries of the Mountain View Fire Protection District and receives service from the District. The Fire District does not object to the Livestock Confinement Operation (Dairy) provided the requirements of the District can be met. Based on my review, I have the following comments: • Fire apparatus roads shall be provided for all new buildings or building additions so fire apparatus may reach to within 150 feet of all portions of the building. Apparatus access roads shall be a minimum of 20 feet in width and be designed and maintained to support the imposed loads of fire apparatus (60,000 pounds). Roads must have a surface that provides all-weather driving capabilities. Roads in excess of 150 feet in length must be provided with approved provisions for the turning around of fire apparatus. The minimum turning radii for all turns shall be thirty-five (35) feet inside turning radius and forty-eight (48) feet outside turning radius. We appreciate being involved in the planning process.
