RE: APPROVAL OF SERVICE PLAN FOR THE PROPOSED EAST EATON WATER
AND SANITATION DISTRICT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the East Eaton Residents are seeking to form the
East Eaton Water and Sanitation District pursuant to Section
32-3-101, et seq. , CR 1973, in order to provide the financing
necessary to construct a system whereby the East Eaton area may
be provided a suitable water supply and sanitary waste disposal
system, and
WHEREAS, the Board of County Commissioners held a public hearing
on the 13th day of January, 1982 at the hour of 2 : 00 o' clock p.m.
in the Chambers of the Board for the purpose of hearing the proposed
service plan. The legal description for the proposed district is
as follows:
Commencing at the intersection of the East side of
the right of way of the Union Pacific Railroad with
the East and West half section line through the center
of Section 31, Township 7 North, Range 65 West and
thence running East 1, 065 feet; thence South 1, 050 feet;
thence West 750 feet to the railroad right of way;
thence Northwest along said right of way 1, 135 feet
to the point of beginning, Weld County, Colorado.
Also known as Block 1, Lots 1, through 34; Block 2 ,
Lots 1 through 12 , Block 3, Lots 1 through 17; Block 4 ,
Lots 1 through 34; Block 5, Lots 1 through 34; Block 6,
Lots 1 through 21 of the East Side Addition to the Town
of Eaton as recorded on October 4 , 1902 , in Book No. 3
of Maps at Page 20, Reception No. 82434 of the Real
Estate Records of Weld County, Colorado.
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the petitioners and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, is satisfied that
the service plan of the proposed East Eaton Water and Sanitation
District should be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners that the service plan for the proposed East Eaton Water and
Sanitation District be, and hereby is, approved.

The following business was transacted:
I hereby certify that pursuant to a notice dated December 21, 1982
and duly published December 24, 31, 1981 and January 7 , 1982 in
the Johnstown Breeze a public hearing was held for the purpose of
considering the Proposed Service Plan for the East Eaton Water and
Sanitation District.
Steven Janssen, legal counsel for the residents of East Eaton was
present and elaborated on the proposed service plan. Mr. Janssen
reviewed the statutes covering this request and the present water
system in East Eaton.
Following discussion Commissioner N. Carlson made a motion to approve
the East Eaton Water and Sanitation District .service plan as presented
and included the recommended development standards. Commissioner
Kirby seconded the motion and it carried unanimously.

THE DEPARTMENT OF PLANNING SERVICE'S STAFF RECOMMENDS THAT THIS REQUEST BE
granted FOR THE FOLLOWING REASONS:
Section 32-1-205 et. seq. CRS 1973 as amended sets forth eight (8) criteria for
review of such service plans. Based upon the information submitted and a review
of the criteria set forth in the statutes, the Department of Planning Services
staff feels the following criteria have been satisfied:
1. There is sufficient existing and projected need for organized service
in the area to be serviced by the proposed district; and
2. The existing service in the area to be served by the proposed district
is not adequate for present and projected needs; and
3. Adequate service is not, nor is not anticipated to be, available to
the area through municipal annexation by other existing municipal or
quasi-municipal corporations within a reasonable time and on a comparable
basis; and
4. The proposed special district is capable of providing economical and
sufficient service to the area within its proposed boundaries; and
5. The facility and service standards of the proposed district appear
compatible with facility and service standards of adjacent municipalities
and special districts; and
6. The proposal is in substantial compliance with the master plan (County
Comprehensive Plan) adopted pursuant to Section 30-28-110 C.R.S. 1973; and
7. The proposal is in compliance with the duly adopted water quality manage-
ment plan for the area.
The Department of Planning Services staff is not equipped with the expertise to
review one additional criteria. The criteria requires satisfactory evidence that
the area to be included in the proposed district does have, or will have, the
financial ability to discharge the proposed indebtedness on a reasonable basis.
The staff recommends the Planning Commission be satisfied the criteria for financial
burden is justified before recommending approval to the Board of County Commissioners
or condition approval on the Board's satisfaction of the criteria.

NOTICE is hereby given of a hearing before the Board of County
Commissioners of Weld County, Colorado, on the 13th day of January,
1982 at the hour of 2: 00 P.M. in the Weld County Centennial Center,
915 10th Street, Greeley, Colorado, for the purpose of considering the
service plan of the proposed East Eaton Water and Sanitation District.
The notice is given pursuant to the Special District Control Act,
Section 32-1-201, et seq. , CRS 1973 , as amended.
Copies of the Service Plan are on file at the Office of the Clerk to
the Board of County Commissioners located on the 3rd floor, Weld

INTRODUCT[ON
The East Eaton Water and Sanitation District is being formed
for the purpose of providing a suitable water supply and sanitary
waste disposal system for the Weld County residents residing in
the area platted as the East Side Addition to the Town of Eaton .
This is an unincorporated area of Eaton north of the Great
Western Sugar Factory and east of Highway 85 . Within the area are
some 30 households as indicated on the map accompanying this
introduction. The vast majority of the residents are property
owners ; all are of Mexican-American. heri .:age ; most are poor ,
elderly , disabled or unemployed .
In the 1930 ' s Bennie Dee La Torre constructed a two inch
diameter water line to which he sold taps for a fee of $100 . 00 .
This water line has deteriorated to the point where the water
supply to the residents is of less than acceptable quality .
Additionally , the line was never properly sized and supply is
thus rendered undependable . The health conditions of the people
residing in East Eaton is also threatened by the fact that there
is no uniform waste disposal system ,
For numerous years individuals and entities have been
attempting provide a sanitary and economical water and sanitation
system to the people of East Eaton . Recently these efforts have
been coordinated by the Weld County Housing Authority and Paul
Halloran, a volunteer and representative of the East Eaton
Residents Committee . Funding has been pursued through Federal and
State agencies . The most viable alternative at this time is an
application for a Farmers Home Administration Grant . Farmers Herne
has indicated they would look favorably upon such a grant
provided a legal entity existed which would be responsible to the
agency for any grant or guaranteed loan. Therefore , the residents
of East Eaton are petitioning the District Court of Weld County
for the formation and organization of the East Side of Caton
Water and Sanitation District .
At this time , East Eaton only contemplates installation and
construction of a domestic waterline by joining the North Weld
County Water District . A prerequisite to the organization and
formation of the East Side of Eaton Water and Sanitation District
is the approval of this service plan by the Weld County
Commissioners . The decision to join North Weld County Water
District was made after careful evaluation and consideration of
all the possible alternative sources of supply . The connection
with North Weld will be the most economical and dependable source
of domestic water .
This service plan then includes a financial survey ci the
East Eaton area ; a preliminary engineering report upon the
improvements to be constructed and the services to be provided : a
description of the facilities to be constructed and the standards
of such construction; a map of the proposed boundaries of the
district with estimates of population and valuation for assess—
ment purposes ; an estimate of the costs of said improvements with
a method of financing the same ; and the Letter of commi.tcmer,t

INTRODUCTION
A. SCOPE OF THE REPORT
This report includes a detailed study of the water and wastewater
treatment problem in East Eaton. The results of the field investi-
gations and surveys were incorporated into a proposed plan of
collection and treatment improvements for East Eaton's wastewater
and water systems. A preliminary cost estimate is also included.
All recommended improvements are based on the larger of either the
estimated future population or current population. Details cf
design are in accordance with the policy of the Colorado Department
of Health.
The purpose of this report is to provide a plan for a cost effec-
tive, environmentally sound and implementable wastewater treat-
; ment program which will meet requirements of state and federal
water pollution laws.
B. SUGGESTED PROCEDURES
1 . Each member of the Improvement Association and interested
persons should thoroughly familiarize themselves with the
sanitary problems involved.
2. Inform the public of the advantages which the proposed
improvement to the sewage system will provide for the
community.
3. The Improvement Association should study the Improvements
recommended herein and the capabilities of East Eaton in
view of possible grants and loans available and plan a program
of construction and financing which will give the community
the sanitary collection and treatment facilities required.

C. PLANNING AREA
This report was prepared for and encompasses the area known as
East Eaton. East Eaton located on the northern front range of
Colorado, in Weld County and is approximately 15 miles north
of Greeley.
Rail service is provided by lines of the Union Pacific Railroad.
The principle roadway to East Eaton is provided by U.S. Highway 85.
D. PLANNING, PARTICIPATION AND COORDINATION
Associated Engineers, Inc. has developed this plan for East Eaton.
The general public was consulted and their ideas and comments
were considered during the devlopment of this report. The goals
of the authors of the Federal Water Pollution Control Act were
considered throughout this report.

ENVIRONMENTAL INVENTORY
A. CLIMATE
The East Eaton area receives an average of 12.2 inches of precipita-
tion annually. A maximum annual precipitaion of 22 inches may be
expected for this area. An average of 34 inches of snow falls in
the area annually.
Temperatures vary from minus 17 degrees Fahrenfeit to 105 degrees
Fahrenheit with a mean manimum average of 48.4 degrees. An average
of 146 days without killing frost may be expected in this area.
B. TOPOGRAPHY
The topography of East Eaton is relatively flat. The elevation
differential in town is 2-4 feet, with natural drainage generally
directed to the north.
C. GEOLOGY AND SURFACE SOILS
East Eaton is situated on deposits of mixed outwash and Eol 'ian
deposits. The surface layer is brown sandy loam about 12 inches
thick, the underlying material to a depth of 60 inches is pale
brown calcareous fine Sandy loam. Permeability is rapid.
Available water capacity is moderate. Surface runoff is slow and
the erosion hazard is low. Slopes range from 1% - 3%.
D. LAND USE
Of approximately 19 acres, 50% is developed and the remaining
acreage is vacant or unoccupied. Of the developed portion,
9.5 acres are residential , approximately . 10 acres are railroad
rights-of-way. Approximately 8.5 acres within the corporate
limits are in vacant lots and not in use.

E. GENERAL HYDROLOGY
The shallow ground water is expected to follow the same general
course as surface waters. Shallow ground water is typically
very high and flActuates widely. Surface water flows also range
widely and many streams have very little or no flow during some
portions of the year. Surface water quality appears to be greatly
influenced by runoff and contains high solids contents during
severe runoff periods.
{ F. AIR QUALITY
fff Although no detailed air quality analysis or date collection was
( performed; reported and observed air quality would apprear to
be consistent with the agricultural and municipal activities
carried out in the area and typical of Weld County. No severe
( air quality degradation was observed.
G. NOISE LEVELS
Although no detailed noise intensity data was collected , reported
and observed , noise levels would appear to be consistent
with the agricultural and municipal activities out in the area
and typical of Weld County. No severe or nuisance noise was
evident.

( H. ENERGY PRODUCTION AND CONSUMPTION
No significant energy production is tarred on with the immediate
area of the project. Energy consumption is generally for home
heating, food production and processing, personal transportation,
and other similar uses.
I . PLANTS AND ANIMALS
The area in and around East Eaton is the home for many varieties
of plants and animals. Deciduous trees are present within the
community. Some evergreen trees can also be observed. Many
song birds , such as robin, as well as sparrows , reside in the
area.

Although a detailed inventory of the flora and fauna in the
area was not attempted , the plants and animals associated with
the climate and soil conditions , of described above, could be
found in the area.

FUTURE CONDITIONS
Formulation and implementation of a program to meet the wastewater
treatment needs of East Eaton must also consider probable future con-
ditions as they may influence sewage treatment. Most conditions
would remain relatively unchanged. However, some changes will affect
the sewage treatment system.
A. FUTURE POPULATION
Population data from the U.S. Census Bureau was not available
for the unincorporated area of East Eaton. However, the East Eaton
Improvement Association has surveyed the community to develop
a current population profile of 89 people.
A population projection is dependent upon past population data
to project future growth rates. Since past date is unavailable,
Rural Weld County will be used to project the population of
East Eaton.
The method utilized in the population projection was Arithmetic
Progression. This utilizes the past two census periods to
project the population growth over the 20-year design period.
The data indicates that the growth rate increased at at rate of
4% for Rural Weld County from 1960 to 1970. Applying the percent-
age increase to the base population of East Eaton, the population
would be estimated at 97 for the 2000.
B. FUTURE LIFE STYLE
Increase standards of living speeds the development and use of
water using appliances. As the usage of automatic washing machines,
dishwashers , garbage disposals and water cooled air-conditioners
increases, so does the water usage rate per individual . Washing
machines are presently in widespread use. Diswashers and garbage
disposals are predicted to continue to gain popularity. Water
cooled air conditioner is increasing in popularity. The net

result is an expected increase in water usage by 5 to 10 gallois per
capita per day (gpcd) by the year 2000.
C. FUTURE DEVELOPMENT
Future development is expected to be limited to the existing
housing and commerical units. The zoning required apparently will
from industrial to agricultural.

WATER SYSTEM
A. EXISTING SYSTEM
East Eaton's water currently is supplied by two sources.
An existing 2 inch line from the City of Eaton supplies water
to ten users. The system is not metered and currently
the users are not paying for the water. Additionally,
shallow private wells are used to supply the remaining
users. However, the quality of the well water is
questionable since the nitrate concentration exceeds
Public Health Standards (Appendix A) .
B. EXISTING WATER DEMAND
Water demand is unknown since the system is not metered.
Therefore, the requirements are estimated based on the
1980 population (Appendix A) . Water consumption is
estimated as follows:

LETTER OF INTENT FROM
NORTH WELD COUNTY WATER DISTRICT TO EAST EATON
WATER AND SANITATION DISTRICT
To the East Eaton Water and Sanitation District:
The Board of Directors of the NORTH WELD COUNTY WATER
DISTRICT hereby states its intentions in regard to the
EAST EATON WATER AND SANITATION DISTRICT .
WHEREAS, North Weld County Water District, hereinafter
"District" , has the facilities and capacity to deliver
water to those homeowners owning land within the area
designateu as the East Eaton Water and Sanitation District ,
hereinafter "East Eaton" , and
WHEREAS, East Eaton desires to contract for the
delivery of the water required by the homeowners within
its district,
WHEREFORE, the Board of Directors of the District
hereby state its committment to provide water to East
Eaton subject to the following terms and conditions:
1. East Eaton will pay the District $11 ,686 . 85 fo::
participation in the 4" (four inch) water line now installed
to serve Agland.
2 . East Eaton will pay the District $1, 930. 00 for a
tap fee and investment in 1" (one inch) water - tap.. ..
3. East Eaton will reimburse the District $500. 00
for engineering fees incurred in this matter.
4. East Eaton will pay to the District $25 ,300. 00
for 11 (eleven) acre feet of raw water.
5. All property serviced under this committment
shall be included in the North Weld County Water District
service area. Inclusion shall be by the normal petition
process. East Eaton hereby specifically agrees and covenants
to abide all rules and regulations of the District as
said rules and regulations are in effect at this time or
as they may be amended from time to time by the Board of
Directors of the District.
6 . East Eaton agrees and covenants to pay a monthly
demand charge equivalent to that charge assessed against all
1" (one inch) users within the District. Presently, said
monthly demand charge is $68 . 00 and East Eaton agrees to
pay any increases in the demand charge as assessed to 1"
(one inch) users within the District and as approved by
the Board of Directors of the District.

7 . East Eaton will pay a commodity charge of $ . 50 per
1,000 gallons which will be registered through a common
meter to be read and billed by the District monthly. East
Eaton agrees and covenants to pay any increases in the
commodity charge as said increase may apply to all other

Directors of the District.
8. The foregoing committment is subject to the
incorporation of East Eaton as the East Eaton Water and
Sanitation District pursuant to and in accordance with
Title 32 , Article 4 , part 1, Colorado Revised Statutes
of 1973.
