We have reviewed the above applicant's request. The Eaton School District has
a process in place addressing growth within the District.
The School District has a adopted a methodology to determine a cash-in-lieu
payment for residential development within the District in order to provide
adequate educational opportunities as a result of that development.
The cash-in-lieu payment per dwelling unit is $1,043 for a total of $9,387 for this
9-lot development. Payment should be hand delivered or mailed to Eaton School
District, 200 Park Avenue, Eaton, Colorado 80615. A receipt will be mailed to the
applicant and a copy to the Weld County Planning Department.
As per the PUD Sketch Plan the transportation collector point for will be on WCR
70. The District will not enter the cul-de-sac to pick up students.

Weld County Public Works Department has reviewed this substantial change plan request. Comments made during
this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the
remaining application process.
Comments
External Roadways:
❑ CR 70 is classified by the County as a local road and requires a 60-foot right-of-way. The applicant shall verify the
right-of-way and the documents creating the right-of-way shall be noted on the change of zone plat. If the right-of-
way cannot be verified, it shall be dedicated on the final plat.
❑ CR 70 serving this development is a gravel road. This development will introduce approximately 80 additional
vehicle trips per day to the roadway system, which doubles the traffic count. This increased level of traffic on
unpaved roads creates fugitive dust and surface maintenance problems. This count approaches the 200 vehicles per
day County limit, whereby dust abatement measures are enforced.
❑ The applicant will be required to enter into an agreement with the County to proportionately share the cost of
improving CR 70 from the western most access road, easterly to paved CR 31. The cost will be based on a proportion
of the traffic generated by the development to the existing traffic. This agreement shall be submitted with the final
plan materials.
❑ The 5-acre building envelop for Lot 9 would require a second access onto CR 70. The applicant shall justify the need
for the second access and show its proposed location on the change of zone plat. The Lot 9 will have only one access,
thereby combining the building and agricultural services.
a Additional right-of-way shall be required adjacent to the bus pullout area equivalent to the width of the pullout lane.
The right-of-way will be dedicated on the final plat.
Internal Roadways:
❑ This development is requesting a PUD status, one mile from SH 392, and in proximity to several rural subdivisions,
which have paved internal roadways.
❑ Internal roads shall meet Weld County criteria for a PUD. The internal roadway right-of-way shall be 60-feet in
width including cul-de-sacs with a 65-foot radius, and dedicated to the public. The typical roadway section of interior
roadway shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-
de-sac edge of pavement radius shall be 50-feet. Stop signs and street name signs will be required at all intersections.
❑ Intersection sight-distance-triangles at the development entrance will be required. All landscaping within the triangles
must be less than 3% feet in height at maturity, and noted on the Landscape Plan. The bus shelter and mailbox kiosk
must be place outside the intersection sight distance triangles.
❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal.
The Engineering Geology Report for Proposed Cattail Creek PUD, dated March 18, 2003, by Church & Associates,
Inc. stated a geotechnical investigation is recommended for the roadway / pavement structure with respect to soil,

groundwater and traffic conditions.
❑ Roadway and grading plans along with construction details will be required with the final plan submittal.
❑ Easements shall be shown in accordance with County standards and / or Utility Board recommendations, also
dimensioned on the final plat.
❑ The applicant shall enter into Improvements Agreements According to Policy Regarding Collateral For
Improvements. These agreements shall be approved by the BOCC prior to recording the final plat.
Drainage:
❑ The applicant shall place a note prohibiting building within the 200-foot setback from the ditch on the Change of
Zone plat.
❑ A final drainage report stamped,signed and dated by a professional engineer licensed in the State of Colorado shall be
submitted with the final plan application. The 5-year storm and 100-year storm drainage studies shall take into
consideration off-site flows both entering and leaving the development. Increased runoff due to development will
require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition.
❑ The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The
engineer shall reference the specific map panel number, including date. The development site shall be located on the
copy of the FEMA map.
❑ The June 2002, report states increased runoff due to development is minimal and detention will not be required.
Calculations verifying this will be required with the final drainage report.
❑ The June 2002, report fails to incorporate the entire development, expressly Lot 9, in the drainage analysis. The final
drainage report shall include the entire PUD.
❑ The June 2002, report states in conclusions and recommendations that an adequately sized culvert is to be placed at
the intersection of the interior roadway and WCR 70. The final drainage report shall show detailed calculations sizing
this culvert. The plat shows a 24-inch culvert just upstream of the proposed location.
❑ The June 2002, report fails to correlate any of the abundant numerical data in Appendix I to the conclusions and
recommendations. The final report shall tie the calculated data to the discussion, conclusions and recommendations.
❑ The applicant shall prepare a construction detail for typical lot grading with respect to drainage at final plan. Front,
rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line
swales shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into
account adjacent drainage mitigation.
❑ Final drainage construction and erosion control plans, conforming to the drainage report, shall be submitted with the
final plan application.
❑ The applicant shall show and name all irrigation systems in the development on the final plat, including ditch
easements. Any increased drainage into an irrigation system shall be corroborated with the appropriate owner. The
applicant shall provide a confirmation letter from the ditch owner addressing these issues along with the final plat
application.
❑ The Engineering Geology Report for Proposed Cattail Creek PUD, dated March 18, 2003, by Church & Associates,
Inc. is acceptable. The applicant shall provide future property owners with a copy of this report. A note shall be
placed on the change of zone plat stating that shallow groundwater may interfere with basement construction, and
foundation depths.
Recommendation
❑ The Public Works Department recommends approval of this substantial change plan.
The applicant shall address the comments listed above at the specific step of the review process stated. The review
process will continue only when all appropriate elements have been submitted. Any issues of concern must be
resolved with the Public Works Department prior to recording the change of zone and final plats.'

1. Building permits shall be obtained prior to the construction of any building or structure
including the bus shelter.
2. A plan review is required for each building. Two complete sets of plans are required when
applying for each permit.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 Uniform Building Code,
1998 International Mechanical Code, 1997 International Plumbing Code, 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. (For residential
occupancies, walls shall be protected with one-hour fire resistive construction within three feet
of property lines and openings are not permitted within three feet of property lines) Separation
of buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances for all structures, to include the bus shelter, shall be
determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
Property lines shall be clearly identified and all property pins shall be staked prior to the first
inspection. Approved building and foundation plans shall be on the site and available to
inspectors for each inspection.

7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

Dear Sherri,
I received the packet from you concerning Cattail Creek PUD. I made a site inspection and have
been on that parcel many times over the years to check dove and goose hunters. In this letter you will find
the Division of Wildlife recommendations.
The site is an irrigated agriculture field planted yearly in a normal rotational pattern. A
channelized portion of Coal Bank Creek runs through the property, draining to the south. Because of the
nature of irrigated agriculture and the channelization of the creek, the site is of relatively low value as
wildlife habitat. The main use is by wintering waterfowl that glean fields of waste crop.
The Division has been in consultation with a neighboring landowner intending to do modifications
to his property that would improve wildlife habitat and diversity. The plans call for improvements along
Coal Bank Creek and installation of tree, shrub and grass plantings. During our conversations, the
landowner has expressed concern over trespass by hunters onto his property.
The Division's recommendation on Cattail Creek PUD would include:
• Shrub and or tree plantings could be installed along the upland edge of Coal Bank Creek and along
the north property boundary to increase habitat diversity.
• The 100 year floodplain and an additional upland setback along Coal Bank Creek could be preserved
to maintain and improve habitat for amphibians, reptiles and small mammals.
• The property boundary could be marked to insure that the residents of the PUD do not mistakenly
enter adjacent lands to hunt without permission.

Thank you for the opportunity to review this request. The City of Greeley Planning staff has reviewed it
and wishes to forward the following comments:
The original request for Cattail Creek was evaluated approximately one year ago by Darrell Gesick of our
office who determined that the proposal did not comply with the policies and intent of the City of Greeley's
Comprehensive Plan, and Resolution 7, 1985, which indicates that the City cannot recommend approval on
any application where the overall gross density exceeds one dwelling unit per 20 acres when the subject
property is located outside of the 2010 growth ring. Since the original application would have allowed the
creation of nine lots on an existing 161.34-acre parcel, Mr. Gesick indicated that we could not recommend
its approval.
While there has been some redesign of the site, the amended request would still create nine parcels on a
161.34-acre site; therefore, it would not comply with the policies and intent of the City's Comprehensive
Plan and Resolution 7, 1985, and the City of Greeley cannot recommend its approval.
However, should Weld County Planning Commission approve the request, I would echo the conditions
recommended by Mr. Gesick last year: (1) The private access road shall be paved; (2) Sixty feet of right-of-
way shall be reserved from the centerline of Weld County Road 70 to facilitate its development as a future
arterial roadway; and(3) Weld County Road 70 shall be paved up to the private access road to reduce the
development's impact on air quality.

The sheriff's office recommends the following improvements for this housing sub-
division:
1. The sheriff's office requests that builders and developers designate an area by
the entrance of the sub-division in which to place a shelter for school children
awaiting the school bus. This area should also include a pull off for the school
es, bus which enables it to safely load and unload children out of the roadway in
the event the bus is unable to drive down the street due to road conditions.
This appears to be planned for this sub-division.
2. Either a mail distribution within the sub-division or a central drop off location
within the sub-division should be developed so that residents do not have to
cross a county roadway to obtain their mail. This appears to be planned for
this sub-division.
3. The name of the street within the sub-division should be presented to the
sheriff's office for approval. This will eliminate duplication of street names
within the county. .
4. A permanent sign should be placed at the entrances to the sub-division
detailing the name of the sub-division, and address. There should be a plan
developed to maintain this sign.
5. If the roadways within this sub-division are not maintained or adopted by the
county, individuals purchasing property in this sub-division should be notified
that the sheriff's office will have limited traffic enforcement powers.
6. A plan should be developed to maintain roadways within the sub-division
especially during inclement weather conditions for emergency vehicles.
i-. 7. The sheriff's office is very supportive of homeowner funded homeowners
associations. These associations provide a contact for the sheriff's office and
a means for maintaining common areas.
8. If there is an oil or gas well within this sub-division. This needs to be fenced
off in order to mitigate the potential for tampering. These facilities are known
to create an attractive nuisance for young people. Tampering not only creates
a significant danger to safety but also of environmental damage with extensive
mitigation and clean-up costs.
9. The plans for this sub-division show roadway with no sidewalks. The
sheriffs office requests that sidewalks be provided.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

The Weld County Department of Public Health and Environment has reviewed this substantial change
application. The proposal has changed from 9 to 8 lots. Lots 1-8 have changed from 1 acre to 4 acres
each and the overall density has changed from one septic system per 17.9 acres to one septic system per
20.1 acres and meets current Department policy.
The application has satisfied PUD Chapter 27 of the Weld County Code in regard to water and sewer
service. Water will be provided by North Weld County Water District and sewer will be provided by
individual sewage disposal systems. Previously, a soil log boring found shallow groundwater at 3 feet. This
was near the seepage ditch and at the time, this was in the open space. Since the lots have been re-
configured, this information may impact the septic systems and require some to be engineered systems.
Primary and secondary septic envelopes have been placed on the substantial change plat map.
Previous referral comments, dated August 7, 2002, appear to still be applicable, and will be re-stated as part
of this referral. They are:
1. Water service shall be obtained from the North Weld County Water District.
2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system.
Sewage disposal shall be by septic systems designed in accordance with the regulations of the
Colorado Department of Public Health and Environment,Water Quality Control Division and the
Weld County Code in effect at the time of construction, repair, replacement, or modification of
the system.
3. Language for the preservation and/or protection of the absorption field envelopes shall be
placed in the development covenants. The covenants shall state that activities such as
permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the
absorption field site.
4. If required, the applicant shall obtain a storm water discharge permit from the Water Quality
Control Division of the Colorado Department of Public Health and the Environment. Silt fences
shall be maintained on the down gradient portion of the site during all parts of the construction
phase of the project.
5. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of the
Weld County Health Department, a fugitive dust control plan must be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and practical
methods which are technologically feasible and economically reasonable in order to minimize
dust emissions.
7. If land development creates more than a 25 acre contiguous disturbance, or exceeds 6 months
in duration,the responsible party shall prepare a fugitive dust control plan,submit an air pollution
emissions notice, and apply for a permit from the Colorado Department of Public Health and
Environment.
8. 'Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be
placed on any recorded plat.
