RE: APPROVE AMENDMENT TO AGREEMENT FOR PATHOLOGIST SERVICES
PURSUANT TO FEDERAL CLINICAL LABORATORY IMPROVEMENT ACT(CLIA)AND
AUTHORIZE CHAIR TO SIGN - JERRY WEIL, M.D.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Agreement for
Pathologist Services pursuant to the Federal Clinical Laboratory Improvement Act(CLIA)between
the County of Weld,State of Colorado, by and through the Board of County Commissioners of Weld
County,on behalf of the Weld County Department of Public Health and Environment,and Jerry Weil,
M.D., commencing November 1, 2003, with further terms and conditions being as stated in said
amendment, and
WHEREAS,after review,the Board deems it advisable to approve said amendment,a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Amendment to the Agreement for Pathologist Services pursuant to the
Federal Clinical Laboratory Improvement Act(CLIA)between the County of Weld,State of Colorado,
by and through the Board of County Commissioners of Weld County,on behalf of the Weld County
Department of Public Health and Environment,and Jerry Weil, M.D., be,and hereby is,approved.
BE IT FURTHER RESOLVED by the Board that the Chair be,and hereby is,authorized to
sign said amendment.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 12th day of November, A.D., 2003, nunc pro tunc November 1, 2003.

AMENDMENT TO AGREEMENT FOR PATHOLOGIST SERVICES
PURSUANT TO CLIA
THIS AMENDMENT ("Amendment") is made and entered into the date and year set
forth below by and between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Weld County Department of Public
Health and Environment, formerly known as the Weld County Department of Health, (hereinafter
referred to as"Weld County"), and Jerry Weil, M.D., (hereinafter referred to as "Pathologist"),to
amend an agreement entered into between the named parties on or about , 1995, which has
been renewed on an annual basis, and which agreement is known as the AGREEMENT FOR
PATHOLOGIST SERVICES PURSUANT TO CLIA("the Agreement").
1. This Amendment is made pursuant to the provisions set forth in paragraph 10 of the
Agreement.
2. Paragraph 3. Compensation shall be deleted, and shall be replaced with the following:
In consideration of the services to be provided by Pathologist as set forth hereinafter,
Weld County agrees to pay Pathologist as follows:
A. $80.00 per hour for on-site consultation fees (on-site visits);
B. $.34 per mile for actual miles traveled in performance of duties with the Weld
County Department of Public Health and Environment Laboratory;
C. Professional consultation fee of$600.00 per month.
Pathologist shall present a billing statement on or before the tenth of the month for
services rendered during the preceding month. Weld County will pay all bills submitted
within thirty(30) days after their receipt.
3. This Amendment to the Agreement shall become effective November 1, 2003.
4. Each and every remaining term and condition contained in the Agreement for Pathologist
Services Pursuant to CLIA shall remain in full force and effect as if restated herein.

SUBJECT: Amendment to Agreement for
Pathologist Services Pursuant to CLIA
Enclosed for Board review and approval is an amendment to the agreement between Weld
County and Jerry Weil, MD, for pathologist services.
The Federal Clinical Laboratory Improvement Act (CLIA) requires Weld County to obtain the
services of a pathologist to review the organization and procedures of the laboratory operated by
the Department of Public Health and Environment. An agreement between Weld County and Dr.
Weil was originally entered into beginning November 1, 1995 and has been renewed annually by
written notification since that date.
This amendment will increase the hourly rate for pathologist services from $75 to $80 and will
increase the amount paid for actual miles traveled in performance of duties from $.25 to $.34 per
mile. If approved, this amendment will become effective November 1, 2003.
