RE: APPROVE ENTRY UPON VARIOUS LANDS BY WELD COUNTY VEGETATION
MANAGEMENT SPECIALIST
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on May 29, and June 2, 3, 4, and 5, 2003, the Weld County Vegetation
Management Specialist mailed notices to various landowners within Weld County advising them
that lands owned or occupied by them contain Canada thistle (Cirsium arvense), musk thistle
(Carduus nutans), Scotch thistle (Onopordum acanthium), field bindweed (Convolvulus arvensis),
leafy spurge(Euphorbia esula),and/or Russian knapweed(Acroptilon repens),noxious weeds,and
WHEREAS, said notices stated that said noxious weeds must be controlled or eradicated
within ten days from the date of said notices and gave recommendations as to what methods are
to be used for such control or eradication, and
WHEREAS,a copy of said list, containing the legal descriptions of the lands and the names
of those landowners who have failed to comply with said recommendations, is attached hereto and
incorporated herein by reference, and
WHEREAS, the County Vegetation Management Specialist has requested that the Board
approve his entry upon lands, as set forth in the abovementioned list, to affect the control or
eradication of noxious weeds, and
WHEREAS, at its meeting of June 16, 2003, the Board did Find as follows:
1. That those landowners mentioned on the list are the owners of said land within a
pest control district.
2. That Canada thistle(Cirsium arvense),musk thistle(Carduus nutans), Scotch thistle
(Onopordum acanthium), field bindweed (Convolvulus arvensis), leafy spurge
(Euphorbia esula), and/or Russian knapweed (Acroptilon repens), noxious weeds,
are found upon said lands.
3. That said landowners received appropriate notice and such notice specified the best
available means for control or eradication of said noxious weeds.
4. That said landowners have not complied with the requirements as stated by the
County Vegetation Management Specialist.
WHEREAS, pursuant to said Findings, the Board deems it advisable to approve the entry
by the Weld County Vegetation Management Specialist upon said lands described in the list
attached hereto, to affect the control or eradication of the abovementioned noxious weeds.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board does hereby approve the entry upon various lands as set forth
in the list attached hereto by the Weld County Vegetation Management Specialist to affect the
control or eradication of Canada thistle (Cirsium arvense), musk thistle (Carduus nutans), Scotch
thistle (Onopordum acanthium), field bindweed (Convolvulus arvensis), leafy spurge (Euphorbia
esula), and/or Russian knapweed (Acroptilon repens), noxious weeds.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 16th day of June A.D., 2003.

Dear Weld County Commissioners:
Under the Colorado Weed Management Act,CRS,35-5.5-109 and Weld County Code,Chapter 15, Section15-2-
20,I must seek approval or right of entry from the Board of County Commissioners to enter on private land to carry
out weed control measures.
Below is a list of landowners,and the legal description of their land,that we may have to enforce on. I am seeking
your approval to enter upon these lands.

The weed notices were mailed on May 29, June 2, 3, 4, and 5, 2003, requesting control of the following weed
species: Canada thistle(Cirsium arvense),musk thistle(Carduus nutans),Scotch thistle(Onopordum acanthium),
field bindweed (Convolvulus arvensis), leafy spurge (Euphorbia esula) and/or Russian knapweed (Acroptilon
repens). Enclosed is a copy of a notice sent under the Colorado Weed Management Act.

Dear Landowner:
Under provision of the Colorado Weed Management Act(35-5.5-109 CRS)and Weld County Code, Chapter
15, Article II, this letter is to serve as notice that the presence of noxious weeds has been observed on
properties which are owned, leased, and/or occupied by you and located in Section 26. 27 &28, Township 1
North, Range 67 West of the 6th P. M., in Weld County, Colorado.
The noxious weed present on the property is: Canada thistle(Cirsium arvense), Scotch thistle (Onopordum
acanthium), and musk thistle (Carduus nutans).
Because these weeds are nearing bloom stage, they must be controlled and kept from going to seed.
Presently, the best methods of control are: 1) to mow as necessary throughout the year to keep the weeds
from going to seed (3-5 times)and then spray with herbicides in the fall, 2)to mow throughout the season to
keep the plants from going to seed, 3)to spray with herbicides up to the early flower stage.
Section 35-5.5-109,C.R.S.and Weld County Code, Chapter 15 requires you to control the weeds by using at
least one of these methods. Please be advised that if you do not control or eradicate these weeds by June 9.
2003, I will ask the Board of County Commissioners of Weld County for permission to enter the property to
use one of these methods of control or eradication at your expense, as provided in Section 35-5.5-109 (5a)
C.R.S. and Weld County Code, Chapter 15.
I will be glad to answer any questions you may have regarding the control or eradication of the noxious weeds
on the property. I am also available to assist you in developing short and long term weed management plans.
