FOR A BUSINESS PERMITTED AS A USE BY RIGHT IN THE A(AGRICULTURAL)ZONE
DISTRICT - RONALD AND MICHELE SACK
A public hearing was conducted on February 12, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 10, 2003, and duly published January
15, 2003, in the South Weld Sun, a public hearing was conducted on January 29, 2003, to
consider the request of Ronald and Michele Sack for a Site Specific Development Plan and Use
by Special Review Permit#1406 for a Business Permitted as a Use by Right or an Accessory
Use in the Commercial Zone District (parking of commercial trucks and equipment) in the
A (Agricultural) Zone District. Due to the absence of the applicant, the Board deemed it
advisable to continue the matter to Wednesday, February 12, 2003, at 10:00 a.m., at which
time Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman,
Department of Planning Services, presented a brief summary of the proposal and entered the
favorable recommendation of the Planning Commission into the record as written. She gave a
brief summary of the Board's previous discussion, and stated a surrounding property owner did
express concern with trucks which were being parked along the road posted for sale. She
stated those have since been removed. In response to Chair Long, Ms. Lockman stated there
is a Condition of Approval that all equipment must be kept behind the screened areas indicated
in the Screening Plan. Don Carroll, Department of Public Works, stated the site is accessed
from State Highway 52, and reviewed his requirements which have been incorporated into the
Resolution as Development Standard #11 for off-street parking and access drives, and #12
regarding stormwater run-off.
Michele Sack, applicant, stated they are willing to screen the trucks and keep them back from
the road. She further stated they also agree not to park trucks which are for sale along the
road, and they can move the trailers behind the trees. Ms. Sack expressed concern with
parking trucks behind the trees due to mice damaging the internal wiring and upholstery, and
she is also concerned with parking there during the irrigation season due to the muddy
conditions. She stated when they farmed this area, they had no restrictions on the amount or
location of farm equipment. She stated, ironically, these trucks are in much nicer condition and

now have to be screened, and the site is kept in good order. Commissioner Geile reviewed the
application materials listing the various types of equipment that will be on the site. Ms. Sack
stated most times the equipment will be gone, and they will not store any other equipment than
what is listed. Commissioner Jerke stated he has driven past the site and it is well maintained,
there is nice landscaping, and there are also large buildings which may act as shields to help
screen the equipment, which he feels is adequate since there are farmers that have
unmitigated amounts of equipment.
No public testimony was offered concerning this matter. In response to Commissioner Geile,
Mr. Carroll clarified he has no proposed amendments to the conditions, he was simply drawing
attention to the transportation items required by staff. Ms. Lockman stated the Colorado
Department of Transportation (CDOT) indicated the access is adequate as long as the property
owner is the only personnel transporting the equipment and not hired employees. In response
to Chair Long, Ms. Sack stated she has reviewed and agrees with the Conditions of Approval
and Development Standards as proposed.
Commissioner Masden moved to approve the request of Ronald and Michele Sack for a Site
Specific Development Plan and Use by Special Review Permit#1406 for a Business Permitted
as a Use by Right or an Accessory Use in the Commercial Zone District (parking of commercial
trucks and equipment) in the A (Agricultural) Zone District, based on the recommendations of
the Planning staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record. The motion was seconded by
Commissioner Vaad, who added he appreciates the neighbors indicating the applicant has
been cooperative and has expressed a willingness to accommodate their requests. There
being no further discussion, the motion carried unanimously, and the hearing was completed at
10:30 a.m.
This Certification was approved on the 19th day of February, 2003.
