DISTRICT - CORRINE LEWIS
A public hearing was conducted on May 14, 2003, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 25, 2003, and duly published May 1, 2003, in
the South Weld Sun, a public hearing was conducted to consider the request of Corrine Lewis for
a Site Specific Development Plan and Use by Special Review Permit #1421 for a Single Family
Dwelling Unit(other than those permitted under Section 23-3-20.A of the Weld County Code)in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Wendi Inloes, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as written,
and stated any comments received from referral agencies have been incorporated into the
Conditions of Approval and Development Standards. Ms. Inloes stated the site lies within the three-
mile referral area of the Town of Mead, which indicated no conflicts with the proposal. Char Davis,
Department of Public Health and Environment, responded to Commissioner Geile that the
manufactured home will need to get a septic permit. Don Carroll, Department of Public Works,
asked for clarification from Mr. Morrison as to whether an easement agreement is necessary for
access to an adjacent parcel, even though both parcels are owned by the same individual. Mr.
Morrison stated language should be added, prior to recording the plat to clarify the access.
Troy Miller represented the applicant and stated there is a 50-foot easement already in place,which
is shown on the Recorded Exemption plat. Ms. Inloes verified the Recorded Exemption was
completed. Responding to Commissioner Jerke, Mr. Miller explained the existing mobile home has
been permitted as an Accessory to Farm Use; however, the need has dwindled and changed since
April, 2002. He stated the applicant is the granddaughter, who is trying to upgrade her living
facilities, and the request is to replace the 900 square foot mobile home currently in place with a
newer manufactured home. CommissionerJerke discussed the ramifications of approving this type
of request without a suitable exit strategy, stating the approval is in effect only as long as an older

person is living on the property, leaving the younger family members to deal with removing the
mobile homes later on. Responding to Commissioners Jerke and Geile, Mr. Miller said they would
like to stay on the property permanently, unless circumstances force the sale of the property for
health care or financial reasons. Mr. Morrison stated not having a permanent foundation would help
the exit strategy, because it would be simpler to remove.
No public testimony was offered concerning this matter.
Mr. Miller requested the word "permanent" in the last sentence of Condition of Approval #2.E be
changed to "temporary" or "non-permanent". The Commissioners discussed with staff and Mr.
Miller the ramifications of the word "temporary", and what is required for a semi-permanent
foundation. Mr. Morrison stated it would be best to delete the sentence entirely, since there is no
definition for"temporary" in the Code, and with the understanding the minimum foundation would
be allowed, which still meets the Building Code. After discussion, the consensus of the Board was
to strike the last sentence of Condition of Approval#2.E. Chair Long verified with Mr. Miller that the
applicant agrees with all other Conditions of Approval and Development Standards.
Commissioner Vaad moved to approve the request of Corrine Lewis for a Site Specific
Development Plan and Use by Special Review Permit #1421 for a Single Family Dwelling Unit
(other than those permitted under Section 23-3-20.A of the Weld County Code) in the A
(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record, with the last sentence of Condition of Approval #2.E deleted. The motion was seconded
by Commissioner Geile. Commissioner Jerke stated he will vote in favor of the motion, although
he is reluctant because of resolving a family situation with no exit strategy in effect. He stated it
puts Department of Planning Services staff into a Social Services agency position, with annual
checks to see if hardships exist. He stated he will have a hard time voting for more of these in the
future. Commissioner Geile stated the Board also needs to support families in their support of each
other, and this is the only way currently existing to accomplish it. On a call for the vote, the motion
carried unanimously.
There being no further discussion, the hearing was completed at 10:35 a.m.
