Our comments and requirements are as follows: COMMENTS: WCR 98 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of- way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County, pursuant to the definition of SETBACK in the Weld County Code Zoning Ordinance 89, as amended. The required setback is measured from the future right-of-way line. Our most current ADT count on WCR 98 between US Highway 85 and WCR 37 reflects 51 vehicles taken on 6/16/1997. REQUIREMENTS: Access: The proposed gravel roadway should be 20 feet in width to accommodate any emergency equipment and shall be graded and drained to provide an all-weather access to the facility. The applicant identified on the plat drawing a 14-foot wide gravel road access to the facility. A sign-off from the Nunn Fire and Rescue shall be required if the applicant chooses to use anything less than the 20-foot wide access standard. Off-Street Parking and Circulation: The On-site and Off-street parking spaces including access drives shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. The circulation appears to be adequate to accommodate three to five people loading and unloading of animals. Storm Water Drainage: The storm water drainage does not appear to be a problem at this proposed location, as this facility is located towards the center of the 80-acrea parcel. We have no objections to the proposal, however, if the applicant falls under the Pet Animal Care Facilities Act (PACFA), potable water and sewage disposal shall be provided to the kennel facility to satisfy the housing and sanitary standards of the PACFA rules and regulations. We recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan to the Environmental Health Services, Weld County Department of Public Health & Environment, for approval prior to operation. 2. The applicant shall submit evidence to the Department of Planning Services, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the use. 3. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. This contact shall determine if a license under the Pet Animal Care Facilities Act (PACFA), as defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide evidence that the applicant is not subject to the PACFA requirements. 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed modular home and proposed kennel facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: ✓1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 5. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. vi This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 2 4. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling. 8. The applicant shall operate in accordance with the approved "waste handling plan". 9. If applicable, the facility shall maintain compliance with PACFA rules and regulations. ✓10.Adequate toilet facilities shall be provided for employees and volunteers of the facility. ,-1 1.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. DATE: February 27, 2003 FROM: Kim Ogle, Planner III SUBJECT: USR-1423, Heather Weir Landscape /Site Plan Review The Department of Planning Services reviewed the above referenced Use by Special Review for a Greyhound kennel for up to sixty (60) dogs and ten (10) cats and offers the following comments: The plant material description delineates a broad diversity of native drought tolerant plant material associated with the Conservation reserve program guidelines. A traditional Landscape Plan was not included in the application materials and will not be required for this application. Landscaping materials located on site and/or additional planting associated with this proposal shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. The applicant shall demonstrate how the proposed plant material will be watered, thus ensuring adequate growth and established of the feeder root system. The 5500 square foot residence and dog kennel facility, per Appendix 23-B of the Weld County Code requires 1 space for every 1000 square feet of kennel. At a minimum four spaces are required. The second residence for the caretaker has no specific parking requirements, although at a minimum two parking spaces are required. The applicant has not delineated handicapped parking spaces. As stated in the application materials, there are no employees associated with this application and persons visiting the property are volunteers. The applicant shall provide additional information on how the facility will meet the intent or provide reasonable accommodation to address the requirements of the American for Disabilities Act. Per Section 23-3-350.B, the applicant shall delineated sufficient screened off street paved parking areas unless waived by the Department of Public Works. Further, one off-street loading space is required for a facility of this size. All parking and loading areas shall be screened from adjacent properties and road rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the potential negative impact and aesthetic concerns on surrounding properties. Section 23-3-350.D provides for adequate street access. The applicant shall demonstrate a safe and approved access. SERVICE,TEAMWORK,INTEGRITY,QUALITY A Site Plan Map was not included in the application materials, therefore the internal circulation within the ten acre parcel is unclear. Future drawings shall delineate the proposed circulation pattern and location of all structures. Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. Section23-3-360 addresses operation standards for Industrial uses. The applicant shall address the issue of on-site lighting, including security lighting in applicable. Subsection F. states "any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." The applicant has not delineated any on-site sign. If an on-site sign is desired, the signs shall adhere to Section 23-4-90.A and .8 of the Weld County Code. One identification sign per principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet in area per face. Further, the location of the sign, if applicable shall be delineated on the Landscape/ Site Plat. All structures, including signs, on site must obtain the appropriate building permits. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera). The School District Methodology has been developed in a manner so as to fairly apportion the cost of acquiring school sites made necessary by residential development.
