RESOLUTION RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING SPECIAL REVIEW PERMIT#828 -JUDY OAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 24th day of March, 2003, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Judy Oakley, 12236 Weld County Road 18, Fort Lupton, Colorado 80621, was in compliance with certain Conditions of Approval and Development Standards contained in Special Review Permit#828 for a Kennel (64 Adult Dogs and 120 Puppies), and WHEREAS, the alleged violations were said to be occurring on property described as part of the NW1/4 and part of the NW1/4 NE1/4 of Section 30, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after hearing testimony from the Department of Planning Services, the Board finds that sufficient probable cause does not exist to schedule a Show Cause Hearing concerning said Use by Special Review Permit. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Probable Cause concerning Use by Special Review Permit#828, issued to Judy Oakley, be, and hereby is, dismissed. Standard 16 The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. Standard 17 Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. She informed me that she had visited a site and was completely appalled. She said it was on CR 18 and this lady had a massive number of dogs. I asked if it was Judy Oakley. She said yes. I informed her that we are aware of some problems and are attempting to correct them. I advised her that one of our planners had gone to the property twice and was denied access both times. She said he should break the door down. I told her that we did not have the right to go on someone's property without their permission. She said that she went there because Judy was selling it and she went to look at it. She said that Judy showed her all around and she was very upset. She said the dogs did have food and water (but the water was frozen). She said she saw 1 female dog in a rabbit hutch and the puppies were in a cage next to her. She said they were very upset. I asked if she would be willing to testify in court as to the conditions of the kennel. She said yes. I asked for her information. She said that she really wanted something done. She said that she had already contacted a few animal activists groups (Every Creature Counts) and Channel 9 news. I explained this information to him. I asked him to keep me enlightened of any progress. I called Lee Morrison and gave him a"heads up". He told me to go ahead and send a letter to Judy Oakley. He said that if we had was her"not letting us access the property" our case would be questionable. But with the other info, we had enough to send a letter. Gary Schwarz called me back. He said that he spoke to the complainant and he didn't think there was enough for a warrant. He said that the complainant did tell him that Judy had admitted to her that she had 130 adult dogs and about 70 puppies. He said that Ms. Berger was going to go back out to the property and he gave her some specific things to look for. He said that he was going to call Scott Leech with PACFA(303-239-4161). I asked that he just keep me informed. He said he would. I then called Ms. Berger. I asked if she knew when she would be going back to the property. She didn't answer. She did say that she was buying a dog from Judy Oakley and would be going back soon. She said that Gary had asked her to try to take photos of the property. She said she was going to try. I told her that we were going to go ahead and send a letter to Ms. Oakley. She asked that I not do that. I spoke to Kim Ogle. We will proceed in sending a letter to Ms. Oakley. I called Ms. Berger and left a message indicating that we were sending a letter out today due to the severity of the situation. Everything seemed in order.She had 58 adults and 31 puppies on the property. The large kennel at the rear of the property housed 2 or 3 dogs per run,which did not appear overcrowded.Heckling material was present for each kennel but had been removed for washing at the time of my visit.Some kennels were empty.All had been cleaned earlier that morning Females with puppies were in a Sundowner facility which was clean and warm. The dogs all had access to the outside. All dogs had food and water in their kennels. She has kennels with overhanging roofs and doghouses but these were not in use at this time and looked like they had not housed dogs for some time. There were a several coated dogs with long hair,only one of which had a few mats. this is to be expected since it is too early in the year to clip them down.I have visited this kennel 4 or 5 dines over the last 5 years. All previous visits were during the summer and all dogs had been clipped short.No dogs were thin, injured or ill.A few were too fat, but that is expected when they are feed free choice. One dog,a neutered pet,has a skin problem. I took him with me to see if I could find a solution for his problem.He does not appear to be contagious or suffering,but he is unsight'y.I have permission to put him to sleep if he cannot be cured. Overall,I was impressed with the improvements.At my fast visit. there was a lot of old boards and fencing laying around,hut this has been cleared out.One stack of usable building timber was carefully stacked beside a re(Ice.Two small Quonset huts were unused but usable.
