RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI
#03000036 AGAINST DAVID WRIGHT AND BETTY GOIN FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David Wright and Betty Goin, VI #0300036, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of August, 2003, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, David Wright and Betty Goin were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation back to the Weld County Department of Planning Services due to the fact that a
Zoning Permit for a Mobile Home Application was received on August 11, 2003.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that VI #0300036 be, and hereby is, referred back to the Weld County
Department of Planning Services.

REMEDY

immediate legal action.

Dear Mr. Wright or Ms. Goin:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on August 12, 2003, at 10:00 a.m.,to consider the
violations occurring on the property. The above mentioned property is in violation of the following
Section(s) of the Weld County Code:
Chapter 23,Article lii, Div 1 "A.(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-20.P "Mobile home subject to the additional requirements of Article IV,
Division 3 of this Chapter."

-No mobile home may be located or relocated in the County after August 25, 1981,except
in accordance with this Division, including the issuance of any zoning permit which may
be required by this Section. Each mobile home located or relocated in the County after
said date must have a building permit fora mobile home issued pursuant to Chapter 29 of
this Code....

This meeting will take place in the County Commissioners' Hearing Room, First Floor,Weld County
Centennial Center,915 10th Street,Greeley,Colorado. It is recommended that you or a representative
be in attendance to answer any questions the Board of County Commissioners might have about the
violations. -
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation,and that you were given sufficient time to remedy this violation. If you have any

I am in receipt of your letter regarding the mobile home located at 24300 WCR 48. According to our records, in
November of 1995, David Wright was approved for a principle dwelling for a mobile home (ZPMH-1992), with the
condition that the other mobile home was removed. I have included this for your review. At this time,the mobile home
is in violation and would either need to be removed from the property, or obtain the appropriate permits. I have also
included a zoning permit application for your review along with the sections of the Weld County Code for an accessory
to the farm, which would need to be applied for and approved. Once you have reviewed this information, you may

This matter coming on before the Court upon stipulation of all parties in interest,
and the Court having examined the files and records herein, and being sufficiently
advised.
DOTH FIND that jurisdiction has been obtained of all parties, that the parties
have negotiated pursuant to the Case Management Order, and arrived at an
agreement for establishing a disputed boundary pursuant to Sec 38-44-112, CRS;
1. NOW THEREFORE, rr IS ORDERED AND DECREED that this
proceeding be changed from a Quiet Title proceeding under Rule 105 Colorado Rules
of Civil Procedure to a proceeding to establish a disputed boundary under Sec 38-44-
112, CRS.
2. That the boundary between the lands of plaintiffs and defendants is
confirmed, established; approved anct ordered-as follows:
A line of agreed use located in the North Half of the Northeast
Quarter and the North Half of the Northwest Quarter of Section 7,
Township 4 North, Range 64 West of the 6th P.M., Weld County,
Colorado and being more particularly described as follows:
Beginning at the North Quarter Corner of said Section 7 and
considering the East line of said Northwest Quarter to bear South 00° 50'
01" West and with all other bearings contained herein relative thereto;
Thence South 00° 50' 01"West, 400.00 feet along said East line;
Thence North 89°09' 59"West, 25.00 feet;
