HomeMy WebLinkAbout20030704.tiff HEARING CERTIFICATION DOCKET NO. 2003-26 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT#941 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY,INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (OIL AND GAS PROCESSING) IN THE A (AGRICULTURAL) ZONE DISTRICT - DUKE ENERGY FIELD SERVICES A public hearing was conducted on April 16, 2003, at 10:00 a.m., with the following present: Commissioner David E. Long, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner M. J. Geile Commissioner William H. Jerke Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Pam Smith Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated March 28, 2003, and duly published April 3, 2003, in the South Weld Sun, a public hearing was conducted to consider the request of Duke Energy Field Services for a Site Specific Development Plan and Amended Use by Special Review Permit #941 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility (oil and gas processing) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ogle gave a brief description of the location of the site and surrounding uses. He stated the primary access will be from Weld County Road 4 and the internal roads are surfaced with gravel and graded to prevent drainage problems. He further stated 11 referral agencies reviewed this proposal, eight responded with comments that have been addressed in the Conditions of Approval and Development Standards, and no correspondence has been received from surrounding property owners. In response to Commissioner Geile, Mr. Ogle stated the applicant will be unable to record the plat until any outstanding Building Permits related to this site are resolved or closed. Responding to Commissioner Masden, Mr. Ogle stated this site is one acre in size, and the amendment does not expand the permit boundary, rather, it reflects the current uses and layout of the site. Don Carroll, Department of Public Works, stated Weld County Road 4 is designated as a local gravel road. A traffic study conducted in 2001 reported 83 vehicles in a 24-hour period on Weld County Road 4 between Roads 13 and 15. He stated this is a non-manned site, with very little truck traffic, and the applicant will utilize on-site parking rather than parking on the County road. 2003-0704 PL0838 HEARING CERTIFICATION - DUKE ENERGY FIELD SERVICES (AMUSR#941) PAGE 2 Pam Smith, Department of Public Health and Environment, stated Development Standard#9 can be deleted since no employees will remain at the site. Tim Clancy,Attorney with Witwer, Oldenburg, Barry,and Bedingfield, LLP,stated the applicant has a number of sites in Weld County and has been in the process of upgrading the facilities, which require amendments to the previous permits. Mr.Clancy stated he and the applicant have reviewed and agree with the Conditions of Approval and Development Standards as proposed and modified. Jim Kirkpatrick, applicant representative, stated this is a compressor site which is used to get gas into the system. In response to Commissioner Masden, Rusty Hopkin, applicant representative, stated this is a small compressor facility producing an average of 4.5 million cubic feet per day which is sent to the Fort Lupton site. He stated any liquid is stored and periodically hauled off the site, and there is a launch/receiver station on the site. Mr. Hopkin further stated during the winter the facility receives approximately 300 to 400 barrels per month. Responding to Commissioner Geile, Mr. Clancy stated Building Permits were applied for to begin making the various upgrades, which triggered the need to an amended Use by Special Review Permit. He stated the applicant has been working to resolve any open permits as this process is completed and they prepare to record the plat. No public testimony was offered concerning this matter. In response to Chair Long, Mr. Clancy stated he and his client have reviewed the Conditions of Approval and Development Standards as proposed and modified. Commissioner Vaad moved to approve the request of Duke Energy Field Services for a Site Specific Development Plan and Amended Use by Special Review Permit #941 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility(oil and gas processing) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included deleting Development Standard #9 and renumbering. The motion was seconded by Commissioner Jerke, and it carried unanimously.
