I understand that Community Development Group of Erie, Inc. ("Community
Development"), formerly known as Weld County Land Company, LLC, recently filed an application
for development ("Application") with Weld County ("County") for the development of property
located in portions of the E2 of Section 33, Township 2 North, Range 68 West ("Property").
Anadarko E&P Company LP ("Anadarko E&P), formerly known as RME Petroleum
Company and Union Pacific Resources Company, owns all of the oil, gas and associated liquid
hydrocarbons that underlies the Property.
Enclosed is a letter to the members of the Planning Commission and the Board of County
Commissioners entitled "Notice of Oil and Gas Rights and Limited Objection of Anadarko E&P
Company LP." Please provide this letter to the Planning Commission and the Board of County
Commissioners to be included in the record of the proceedings on the Application as well as any
future requests associated with the Property. The purpose of the letter is to inform the County that
Anadarko E&P owns oil and gas interests for the Property and to make the County aware that
predecessor companies to Anadarko entered into an Agreement for Compatible Development dated
November 14, 2000 with Weld County Land Company, LLC that applies to the development of the
oil and gas that underlies the Property.
As you are aware, the Colorado General Assembly passed House Bill 1088 in Article 65.5,
Title 24 last year entitled "Notification of Surface Development." The law requires that developers

Ladies and Gentlemen:
This law firm represents Anadarko E&P Company LP ("Anadarko E&P"), formerly known
as RME Petroleum Company and Union Pacific Resources Company,with respect to an application
for development("Application")that has been filed by Community Development Group of Erie,Inc.
("Community Development"), formerly known as Weld County Land Company, LLC ("Weld
County Land"), for property located in portions of the E2 of Section 33, Township 2 North, Range
68 West ("Property") and described in the Application as The Pointe. Anadarko E&P owns all of

for Weld County Land to consult with Anadarko E&P and its oil and gas lessees or their assignees.
The PUD Change of Zone Plat for The Pointe identifies certain well site locations and
setbacks which are identified in the Agreement; however, it does not comply with the terms of the
Agreement with respect to the location of lot lines vis-à-vis the well site locations. Anadarko E&P
objects to the Application to the extent the proposed development plan does not comply with the
Agreement. Anadarko E&P and Community Development are in discussions to resolve the matter;
however,at this time Anadarko E&P requests that the County either deny the approval for a final plat
for the Property until such time as a resolution is reached or make any approval of the Application
for a final plat conditioned upon such an agreement.

Patina Oil & Gas Corporation ("Patina") has been contacted by Community Development Group, LLC
("Community Development") and Weld County Department of Planning Services regarding the proposed
Request for a Change of Zone from Agricultural to PUD on portions of the captioned property ("Property").
Patina operates the UPRC 33-1M oil and gas well ("Well"), associated pipelines and production facilities on
the Property. Patina also owns oil and gas leasehold rights and has rights to drill additional well(s) on the
Property. Patina is concerned about the impact the proposed development will have on Patina's ability to
produce, operate and maintain the Well, pipelines, access roads and production facilities as well as the drilling
and operations of future wells on the Property. To date, Patina has received no confirmation from Community
Development that Patina's real property rights to use a reasonable portion of the surface for oil and gas
operations and development are being preserved.
Patina requests assurance from the Weld County and Community Development that the proposed development
will not preclude Patina from producing, operating, drilling and maintaining its wells and related facilities.
Until this matter is resolved by agreement with Community Development, Patina is not waiving its rights as a
leasehold owner. Any approval of the proposed development should be conditioned upon the preservation of
Patina's real property rights that allow it to make reasonable use of the surface of the lands for oil and gas
operations. The proposed development must take into account and provide adequate setbacks from Patina's
current and future wellsites, pipelines, and production facilities as well as continuous access to these facilities.
Patina requests that these comments be entered into the record for Community Development's proposed
development and that we continue to be provided with advance notice of all other hearings affecting the

This letter is in response to Molly Sommerville's letter of October 11, 2002 and David
Siple's letter of October 15, 2002. Ms. Sommerville and Mr. Siple expressed concerns
regarding their oil and gas rights pursuant to the proposed Change of Zone for The
Pointe, which you are currently considering.
As stated in Ms. Sommerville's letter an Agreement for Compatible Development dated
November 14, 2000 requires that we "reserve and identify existing and future oil and gas
sites and production site locations for the Property". We acknowledge this agreement
and more specifically the requirement that no residential lots be located within future or
existing wellsite locations. If our current zoning for the property is approved, we will at
final plat label the wellsites, as defined in the Agreement or subsequent Surface Use
Agreements, as non-residential tracts or outlots unless the oil & gas entities consent to
wellsites in lots subject to no-build or conservation easements.
We look forward to continuing these discussions with the oil and gas entities subsequent
to the County's action on our current zoning request.
