RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST TRACY AND KAREEN WARDELL FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Tracy and Kareen Wardell, VI #0300038, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of December, 2003, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Tracy Wardell, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 9, 2004, to allow adequate time for the property owners to submit a Use by Special Review Permit or remove the mobile home and for an inspection of the property by the Department of Planning Services staff. Roskop Farms, Inc., consists of a parcel of approximately 100 acres owned by George and Helene Roskop for over 50 years_ The land has always been used as an active crop producing farming operation. George Roskop obtained a accessory to the faun permit for a mobile home in 1973. As George and Helene Roskop aged, my wife Kareen, Daughter to George and Helene wanted to move closer to home to provide care for her parents as they grew older_ We obtained a recorded exemption and purchased a 5 acre corner of the Roskop property. The new property line encompassed the area where the existing accessory to the farm mobile home was. As we are not using the entire 5 acres, approximately 1/2 is still fanned along with the adjoining fields. George and Helene Roskop are now both deceased, and their surviving children formed Roskop Farms, Incorporated to continue the farming tradition of the family. My wife Kareen is a corporate officer and manager of farming operations,and the corporate office is located in our home. Matthew Roskop, Grandson of George and Helene,now lives in the mobile home. He assists in the farming operation by performing viral tasks around the property, i.e. field maintenance and cleaning, field road maintenance, irrigation ditch maintenance, weed control, varmint control, animal care,etcetera. Matthew has never been a paid employee of the corporation,his compensation has always been in the form of a place to live. The corporation can generate an employment agreement if necessary, but there is currently no written document_ 4. Allow me ti; explain: My wife's parents, George and Helene Roskop, have owned and operated a 100 acre farm at 2557 WCR 39 for over 50 years. In that time, two mobile homes had been permitted as "Accessories to the farm", one in 1973 and one in 1984. One of those homes has since been removed, and one remains. I am not sure which is which. Approximately _S years ago, my wife and I purchased a 5 acre corner of the farm through a recorded exemption, and the new property lines placed the existing mobile home on our side of the line. George and Helene Roskop have both since passed away. After their passing, i he surviving 4 children formed a corporation, Roskop Farms Incorporated. The firm at 2557 WCR 39 is still in full operation,and the corporate office is located in m home at 2647 WCR 39. My wife is 25% owner and manager of the corporate affairs. :.vly stepson currently lives in the mobile home and performs maintenance work around thk: property_ A portion of our 5 acres is still growing crops along with the remainder of the farm_ My point is, even though our 5 acres is technically a separate address, we are still very much a part of the existing farm. After receiving your letter dated August 28, 2003, I met with a planner in the I ongmont office. The point he brought up, which I fully understand, is that our portion(.1 the property, being only 5 acres, does not need an accessory to the farm. Howev .r, as I stated above, the two properties are not really separate. His recommendation to resolve the problem was to do an amended recorded exemption to move the prop y line so the mobile home would be on the Roskop Farm's property where the trailer is permitted as an accessory. Initially I thought that would be a good idea, since we're still farming that portion of our property and it really doesn't matter what shape our property line takes. However, after returning home and measuring where we would need to move the property line we have determined this is not a viable solution. Our power meter, well, outbuildings and trees would no longer be on our side of the property line_ Whereas currently none of that would make a difference,if at some time in the future the farm is ever sold it would become a huge issue and conceivably there could be someone else's home built right next to our driveway I then looked at the possibility of moving the mobile home a couple of feet to the south to be on the property that has the mobile home permitted. In addition to the difficulties of establishing new water, power and sewer, I found that the structure of the trailer is broken on the bottom and if we try to move it the mobile home will fall apart. I guess my question is, since these two properties are adjacent to each other, owned by the same people and very much integrated, is it possible to renew the existing permit or obtain a new permit as part of Roskop Farms, Incorporated? If that is possible, do I need to complete a complete a regular permit packet including finding the old well and septic permits? Do we have to pay the full fees, including the investigation fee, or is there a different fee schedule for renewals? I very much want to keep the mobile home and bring our property into compliance, I'm just not certain which course to follow. Obviously,we fully understand that if the corporate officers ever decide to sell the farm, we would no longer have a need for the mobile home and would remove it immediately.
