RE: APPROVAL OF AMENDED RECORDED EXEMPTION #2425 - ELIZABETH
WILSON/HEIRS OF RICHARD WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2425, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land," and
WHEREAS, the request for Amended Recorded Exemption #2425 was submitted by
Elizabeth Wilson/Heirs of Richard Wilson, 6707 Weld County Road 19, Fort Lupton, Colorado
80621, for property which is located in part on the following described real estate, to-wit:
Lot B of Recorded Exemption #2425; being part of
the N1/2 of Section 33, Township 2 North, Range
67 West of the 6th P.M., Weld County, Colorado
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit "A," said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 93.88 acres and 80 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #2425
by Elizabeth Wilson/Heirs of Richard Wilson is, approved conditional upon the following:
1. Prior to recording the plat:
A. The plat shall be titled: Amended Recorded Exemption No. 1311-33-1
AMRE #2425
B. Lot B shall use the existing agricultural/oil and gas/ditch road access
points necessary for agricultural operations as no additional accesses
shall be granted.
C. The plat shall reference the existing access agreement which allows the
property owners to cross the 180-foot strip of property adjacent to Weld
County Road 16. The reference shall include the Weld County Clerk and
Recorder's reception number.

D. All approved accesses shall be clearly shown on the plat.
E. Weld County Road 19 is designated on the Weld County Transportation
Plan Map as a Collector status road, which requires 80 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way.
A total of 40 feet from the centerline of Weld County Road 19 shall be
delineated on the plat as right-of-way reservation for the future expansion
of Weld County Road 19. This road is maintained by Weld County.
F. The applicant shall provide the Weld County Department of Planning
Services with a Statement of Taxes from the Weld County Treasurer
showing no delinquent taxes exist for the original parcel.
G. The applicant shall complete all Conditions associated with Recorded
Exemption #3507 and submit the plat for recording to the Department of
Planning Services.
H. The applicant shall submit a written request to vacate Use by Special
Review Permit#787 for a trucking business.
The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property
is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future
right-of-way line. No building or structure as defined and limited
to those occupancies listed as Groups A, B, E, H, I, M, and R in
Table 3-A of the 1997 Uniform Building Code (UBC), shall be
constructed within a 200-foot radius of any tank battery or within a
150-foot radius of any wellhead. Any construction within a
200-foot radius of any tank battery, or 150-foot radius of any
wellhead, shall require a variance from the terms of the
Section 23-6-10 of the Weld County Code.
2) Any future structures or uses on site must obtain the appropriate
Zoning and Building Permits.
3) Prior to the release of Building Permits, the applicant shall submit
a recorded deed describing the Lot upon which the Building
Permit is requested with the Building Permit applications. The
legal description on such deed shall include the Lot designation
and Amended Recorded Exemption number.
4) Prior to the release of Building Permits, the applicant shall submit
evidence to the Department of Planning Services that Lot B has
an adequate water supply of sufficient quality, quantity and
dependability.

5) Prior to the release of Building Permits for any structure
exceeding 3,600 square feet, the applicant must comply with the
requirements of Appendix III-A of the Uniform Fire Code (UFC).
6) Should noxious weeds exist on the property, or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II, of the
Weld County Code.
7) Subdivision Exemption #757 was approved, in conjunction with
Recorded Exemption #2425, for the purpose of dividing off a
second set of existing improvements from the parcel.
8) Effective January 1, 2003, Building Permits issued on the
proposed lots will be required to adhere to the fee structure of the
Weld County Road Impact Program, Area 3.
9) Potential Purchasers are hereby notified that confined animal
feeding operations are located in the area. The first is located
north of Weld County Road 16 and east of Weld County Road 17,
and is permitted by Use by Special Review#1356 for 1,450 head
of cattle. The second is located north of Weld County Road 16
and west of Weld County Road 19, and is permitted by Use by
Special Review#1231 for 2,500 head of cattle. Off-site impacts
that may be encountered include noise from trucks, tractors, and
equipment; dust from animal pens; and odors from animal
confinement, silage, and manure.
10) Weld County's Right To Farm statement, as it appears in the
Weld County Code, Appendix 22-E, shall be placed on the Plat.
2. The applicant shall submit two (2) paper copies of the plat for preliminary
approval to the Weld County Department of Planning Services. Upon approval of
the paper copies the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by the Department
of Planning Services. The plat shall be prepared in accordance with the
requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and
additional requirements shall be submitted within sixty (60) days from the date of
the Board of County Commissioners Resolution. The applicant shall be
responsible for paying the recording fee.
3. The Department of Planning Services respectfully requests the surveyor provide
a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg,
.dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles,
Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred
format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file
may be sent to maps@co.weld.co.us.

The Department of Planning Services' staff has reviewed this request and recommends that this request be
approved.
1. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with the
following criteria as listed in Section 24-8-40.B.1 through 24-8-40.8.6 of the Weld County Code:
A. Section 24-8-40.8.1 -Conformance with the urban growth boundary goals and policies contained in Chapter 22
of the Weld County Code as well as any approved intergovernmental agreement when the recorded exemption
application is located within a specified intergovernmental boundary area.
The lot is not within an intergovernmental boundary area. However, the lot is within the three mile referral area
for the Towns of Firestone and Frederick and the City of Dacono. In referral response the Town of Firestone
indicated no comment and the City of Dacono indicated no conflicts with the proposal. The Town of Frederick
did not respond to the referral request.
B. Section 24-8-40.8.2- Compatibility with existing surrounding land uses.
The proposed boundary change will have little, if any impact on the surrounding land uses.
C. Section 24-8-40.8.3-Consistency with the intent of the zone district the recorded exemption is located within as
expressed in Chapter 23 of the Weld County Code.
The proposed boundary change will follow an existing ditch boundary which will conserve agricultural land for
agricultural purposes which foster the economic health and continuance of agriculture as stated in Section 22-2-
60 (Agricultural Goal 1)of the Weld County Code.
D. Section 24-8-40.8.4-Consistency with the purpose of efficient and orderly development as expressed in Section
24-1-30 of the Weld County Code.
The proposal meets all of the applicable goals listed in the Statement of purpose as follows:
1) Section 24-1-30.A -Assisting orderly and integrated development.
2) Section 24-1-30.B-Promoting the health, safety, and general welfare of the residents of the County.
3) Section 24-1-30.C-Ensuring conformance of land subdivision plans with the public improvement plans
of the County and its various municipalities.
4) Section 24-1-30.D-Ensuring coordination with public municipal improvement plans and programs.
5) Section 24-1-30.E-Encouraging well-planned subdivisions by establishing adequate standards for design
and improvement.
6) Section 24-1-30.F-Improving land survey monuments and records by establishing standards for surveys
and plats.
7) Section 24-1-30.G-Safeguarding the interests of the public, the homeowner, and the subdivider.
8) Section 24-1-30.1-1-Securing equitable handling of all subdivision plans by providing uniform procedures
and standards.
9) Section 24-1-30.1-Preventing loss and injury from fire in wooded terrain.
10) Section 24-1-30.J-Preserving agricultural land and promoting its most productive agrarian use.
11) Section 24-1-30.K-Ensuring irrigation water currently associated with a farm or rural unit of land will be
retained for agricultural uses.
12) Section 24-1-30.L - Preserving natural vegetation and cover and promoting the natural beauty of the
County.
13) Section 24-1-30.M-Preventing and controlling erosion,sedimentation, and other pollution of surface and
subsurface water.
14) Section 24-1-30.N-Preventing flood damage to persons and properties and minimizing expenditures for
flood relief and flood control projects.
15) Section 24-1-30.0-Restricting or regulating building in flood hazard overlay district areas, shorelands,
areas covered by poor soils, or in areas poorly suited for building or construction.
16) Section 24-1-30.P-Preventing loss and injury from land slides, mud flows, and other geologic hazards.
17) Section 24-1-30.Q-Providing adequate space for future development of schools and parks to serve the
population.
18) Section 24-1-30.R-Ensuring the planning for and provisions of an adequate and safe source of water and
means of sewage disposal.
E. Section 24-8-40.B.5 - Compliance with the recorded exemption standards set forth in Section 24-8-80 of the
Weld County Code.
1) Section 24-8-80.A - The water supply for all lots as proposed by the recorded exemption application is
adequate in terms of quality, quantity, and dependability.
The applicant has submitted a Tap Fee Agreement with Central Weld County Water District.
2) Section 24-8-80.8-An adequate sewer service is available to serve the uses permitted on both proposed
lots. The sewer service shall comply with the requirements of the applicable zone district and the Weld
County Health Department.
The applicant is proposing an Individual Sewage Disposal System for any future residence.
3) Section 24-8-80.C-An adequate legal access exists for all proposed lots to a public road. All accesses
shall be in accordance with Chapter 8, Article II of the Weld County Code.
The applicant has included an access agreement to cross the 180 foot strip adjacent to Weld County Road
16 in the application.
4) Section 24-8-80.D- The proposed recorded exemption will comply with Chapter 23,Article V of the Weld
County Code.
The site is not located within an overlay district.
5) Section 24-8-80.E The minimum size of any lot proposed is not less than one (1) acre, except where
smaller lot sizes are allowed in the zone district or where exempted by the Board of County
Commissioners.
The proposal will create an eighty(80) acre lot.
6) Section 24-8-80.F-The decision to approve a recorded exemption may be conditioned to mitigate impacts
or address concerns of referral agencies. Existing or future public rights-of-way shall be dedicated or
reserved in conformance with Chapter 22 of the Weld County Code and any adopted intergovernmental
agreements, or master plans of affected municipalities.
The Weld County Department of Public Works has requested 80 feet of right-of-way reservation along
Weld County Road 19. The municipalities within the three mile referral boundary did not express any
requests or conditions.
7) Section 24-8-80.G-The recorded exemption application shall include the total contiguous land ownership,
except in the Agricultural Zone District. In the Agricultural Zone District when a contiguous ownership
equals at least twice the minimum lot size (160 acres), or a parcel otherwise recognized as a complete
quarter section, a portion of the lot equal to the minimum lot size(80 acres)may be used in the recorded
exemption application. The three(3)-lot recorded exemption application shall include the total contiguous
land ownership equal to no less than twice the minimum lot size (160 acres) in the Agricultural Zone
District, or is a parcel otherwise recognized as a complete quarter section. The fact that the applicant has
conveyed, within the last calendar year, land which would have been considered contiguous had it been
retained, maybe considered as evidence of an intent to evade the purpose provisions of Sections 24-1-30
and 24-8-20 of the Weld County Code.
The acreage being amended out is being incorporated into Recorded Exemption 3507 which does follow
County policy.
8) Section 24-8-80.H-The proposed recorded exemption is not part of a recorded exemption approved within
the last ten (10)years. This provision shall not apply in any commercial or industrial zone district.
The criteria is not applicable to amendments.
9) Section 24-8-80.1- The proposed recorded exemption is not part of an approved subdivision or recorded
subdivision plat or unincorporated community legally filed prior to adoption of any regulations controlling
subdivisions.
10) Section 24-8-80.J- The proposed recorded exemption does not evade the statement of purpose as set
forth in Section 24-1-30 of the Weld County Code.
As stated above the proposal meets all of the applicable goals listed in the Statement of Purpose.
F. Section 24-8-40.8.6-Adequate provision for the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County.
Conditions of Approval and Development Standards ensure that there are adequate provisions for the
protection of health, safety, and welfare of the inhabitants of the neighborhood and County.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:.
1. Prior to recording the plat:
A. The plat shall be titled: Amended Recorded Exemption No. 1311-33-1 AMRE-2425
B. Lot B shall use the existing agricultural / oil and gas / ditch road access points necessary for agricultural

comply with the requirements of Appendix III-A of the Uniform Fire Code.
6) Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to
Chapter 15, Articles I and II of the Weld County Code.
7) SE-757 was approved in conjunction with Recorded Exemption 2425 for the purpose of dividing off a
second set of existing improvements from the parcel.
8) Effective January 1,2003, Building Permits issued on the proposed lots will be required to adhere to the
fee structure of the Weld County Road Impact Program, Area 3. (Ordinance 2002-11)
9) Potential Purchasers are hereby notified that confined animal feeding operations are located in the area.

10) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive agricultural counties
in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of
Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving
into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the drawbacks come the
incentives which attract urban dwellers to relocate to rural area:open views,spaciousness,wildlife, lack
of city noise and congestion,and the rural atmosphere and way of life. Without neighboring farms,those
features which attract urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities
will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles
on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal
confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of
pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot
simply be moved out of the way of residential development without threatening the efficient delivery of
irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or
private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that
are commonly or reasonably associated with agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)with
more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the
area to be served stretches available resources. Law enforcement is based on responses to complaints
more than on patrols of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by
volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no
matter how often they are bladed,will not provide the same kind of surface expected from a paved road.
Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several
days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural areas, in many
cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-
sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center
pivot operations,high speed traffic,sand burs,puncture vines,territorial farm dogs,and livestock present
real threats to children. Controlling children's activities is important, not only for their safety, but also for
the protection of the farmer's livelihood. Parents are responsible for their children.
2. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of

Elizabeth Wilson and the Heirs of Richard Wilson have applied to amend Lot B of Recorded
Exemption 2425 along with an additional Recorded Exemption (RE-3507) on the adjacent
property to the west.
The vroposed Recorded0e a ptions are east of and adjacent to WCR 19. On the north and
west The lots are180 feet RifiriVeld county Road 16 and 17. The 180 feet is owned by Public
Service Company for electrical transmission towers. The town of Frederick is 1/2 miles west
of the site. The area is agricultural in nature with 2 dairys in close proximity.
10 referral agencies reviewed this case, 9 responded favorably or included conditions that
have been addressed through conditions of approval.
The amendment to Lot B of Recorded Exemption 2425 is intended to align the boundary of
the lot to the existing ditch. Planning staff is recommending approval of this request,
however, because the original Recorded Exemption was approved by the Board of county
commissioners, any amendments must come before the Board for your final decision.
Recorded Exemption 3507 will create a 3.4 acre lot A and a 77 acre lot B. Once again staff is
recommending approval of the request.
On March 17, 1999 the Board of County Commissioners denied Recorded Exemption 2426
it
for the following reasons:
1 . The proposal evades the purpose of the Weld County Subdivision Ordinance as
defined in Section 1 .3.(Statement of Purpose)
2. The division would be inconsistent with efficient, orderly and integrated development
pursuant to Section 1 .3.1 of the Weld County Subdivision Ordinance.
3. pursuant to Section 11 .5.1.2 (which addresses compatibility with existing surrounding
land uses, the proposal is not consistent with the Weld County Comprehensive Plan.
4. Any further division of these lots will increase the density of the existing linear
subdivision inconsistent with Section 11 .5.1.2 of the Weld County Subdivision
Ordinance.(One again, section 11 .5.1 .2 addresses compatibility with existing
surrounding land uses)
5. The proposal increases the need for more urban-type services in the area.
Pursuant to Chapter 2, Article II, Section 2-3-10 of the Weld County Code, the Board of
County Commissioners shall consider whether within the concept of a new application, the
facts and circumstances of which are substantially changed from the initial application:
Criteria 1. -- Has the land-use application substantially changed? (e.g., substantial changes
in lot size or density, in internal or external roads, or, in the case of a rezoning, in the uses
proposed)
Criteria 2. — Have the surrounding land-uses substantially changed ?

Recorded Exemption 2426 (R M26) proposed to create a 20 acre lot for the development
of a minor subdivision. Staff comments for RE-2426 indicate concerns were in regards to the
potential cumulative number of residences to be created and the compatibility with A.Goal 7
of the Weld County Code which stated "Protect agricultural land from encroachment by those
urban uses which hinder the operation efficiency and productivity of the agricultural uses."

Dear Ms. Lockman,
Enclosed are the packets for the proposed Recorded Exemption and for the proposed
boundary changes between two parcels on the Wilson property on Section 33. 1 have
attached an additional packet that details the recent subdivision activity on neighboring
parcels. Hopefully the packet will illustrate the substantial change that has taken place
since our previous application in 1999.
On Pages 1 and 2, highlighted in pink, is information about parcels on Section 32,
immediately west of the Wilson property. The first four entries are properties that were
divided up by previous owner Kate Carey, after she spoke against our request for a single
recorded exemption RE-2426 at the hearing before the Board of County Commissioners
in 1999. She then moved away. The dates of sale have all occurred since our previous
hearing, and are also highlighted. A multi-section picture on page 8 also indicates heavy
major subdivision activity on Section 32, all new since our 1999 hearing.
The final three entries on page 2, and the first entry on page 3, are for Zane Nelson, Bud
Hunziker and Lawrence Richmeier. Patty Nelson and Kimberly Richmeier are the
Hunzikers'daughters, and the daughters'parcels were divided from the parents' land on
Section 32, and on Section 28, which is directly across the street from the applicant's
property to the north. This information is included to show that it is consistent with
neighboring use to divide off parcels of farmland to children, in order to maintain the
agricultural use and encourage rural life.
The remaining parcels listed on page 3, and the first one on page 4 are from section 28,
highlighted in yellow. These properties are directly across from the subject property, and
indicate the pattern of smaller parcels, which are also shown on the map on page 8.
On page four and the top of page 5 are parcels from Section 34 belonging to Thomas and
Diana Spurling, who also objected to our previous application for RE-2426. This
information is included to show that the Spurlings have divided their property into 4
parcels also.
The balance of page 5, and all of pages 6 and 7 show activity, highlighted in blue, on
Section 27,which is across from the Wilsons'property, north and east, at the corner of
Weld County Roads 16 and 19. Since the Wilsons'application for RE-2426 was denied,
a 12-acre parcel directly across from the corner has been divided into 5 lots, and 4 new
homes have been built. Page 6 and 7 show entries indicating that Darrell and Nelva
Bearson deeded a parcel to their children, Michal and Bradley. The proliferation of
small parcels indicates that substantial change has taken place since the Wilsons'previous
hearing. The Bearson family entries show that the Wilsons'proposal is consistent with
the surrounding land use, the historical practice of making it possible for farmers'
children to continue the family farm.
Additional factors we hope will be considered are:
1. In 1999,the planning department found no problem with the initial application for
RE-2426. The hearing was so confusing, however,that one of the commissioners
thought he was voting to deny 5 four-acre parcels or 4 five-acre parcels, suggesting
that if the applicant's request for one parcel had been clear, perhaps the ruling would
have been different.
2. This application is for a different area of the parcel, and is geographically situated in
a naturally logical place for a small RE.
3. This application is being submitted by the heirs of Richard Wilson,who is now
deceased. The RE is being requested in order for the Wilsons' son to be able to build
a home and continue to farm in his father's place.

RECORDED EXEMPTION QUESTIONNAIRE
1. Water Supply Statement:
a. Domestic Use:
The applicant has purchased a tap which can be used for the proposed
recorded exemption (Proposed Lot "B"). Proposed Lot "A" is eligible
for a domestic water tap, subject to current requirements of Central
Weld County Water District (CWCWD). CWCWD states that
applicant's tap fee agreement dated August 1998 should suffice as
proof that domestic water is available. (Copy is attached)
Proposed Lot "A" is also of sufficient size that a well permit could be
applied for.
L Irrigation: Both proposed Lot "A" and proposed Lot "B" are
currently farmland, both dryland since prior to current applicant's
purchase of the property in January 1996. There is a pivot sprinkler
located on proposed Lot "A" but it has not been used by applicant,
and according to the previous owner, was not used for several years
prior to 1996. No irrigation water shares are attached to either of the
proposed lots. Both parcels are currently farmed in wheat.
Proposed Boundary Changes:
Domestic Water: The proposed boundary changes have no impact on
the current domestic water status.
Irrigation Water: The proposed boundary changes will bring the lot
lines into a more natural conformity with land usage and the natural
topography, but will have no impact on irrigation.
2. Statement regarding sewage disposal/septic:
Each of the proposed lots is eligible for a future septic system.

Have no impact on eligibility for septic systems.
3. Description of current use of the property:

Both of the proposed lots are currently nonprime farmland, used for
raising wheat and native grasses common to the area. There are no
dwellings on either parcel. There are oil and gas wells with
accompanying structures and storage tanks on proposed Lot "A". There
are no structures on proposed Lot"B".
Proposed Boundary Changes:
There are no structures on the portion of Existing Lot B RE 2425 that
would become part of Proposed Lot A. Boundary changes will have no
effect on current usage of the farm ground of either proposed Lot A or
Lot B or Existing Lot B RE 2425.
4. Reason for the Recorded Exemption and proposed use of property:
Reason for Recorded exemption:
This Recorded Exemption(RE) application is being filed in conjunction
with an application to amend existing boundary lines between existing
80-acre parcel #131133000046 and Existing Lot B of RE-2425.
Reason for Proposed Boundary Changes
The original parcel configuration reflected the Wilsons' desire to build a
new home "with a view" on that portion of Proposed Lot "A" which is
currently part of Lot B RE-2425. Since Richard Wilson's death in
September 2001, the plan to build a new house on Proposed Lot"A" is
no longer feasible for his widow. The newly proposed lot line
amendments more closely follow the natural topography of the land, and
follow the existing irrigation ditch and road which service existing Lot B
of RE-2425.
The new boundaries also approximate the actual separation of existing
fields. Proposed Lot "A" is planted in dryland wheat, and the bulk of Lot
B of RE-2425 is presently in irrigated alfalfa and grass. In addition, the
proposed amended RE utilizes the existing ditch access road which
follows the ditch and divides most of Proposed Lot "A" from Lot B RE-
2425.
Proposed Use:
Proposed Lot "A" is currently under contract for sale to Longmont
Broadcasting, LLC. Their expressed intent is to maintain the property as

a dryland farm, and to make application to build up to 2 communication
towers, with supporting structures, as permitted in the agricultural zone.
Proposed Lot "B", the recorded exemption, creates a parcel of
approximately 3.4 acres contiguous to the remaining Wilson farm, to be
used by the son, who is currently farming the property since his father's
death in Sept 2001. He and his wife are currently residing in a 632
square foot tenant house on his mother's property, and would like to
build their own home while continuing to farm for his mother. The
recorded exemption would facilitate and support continuing the family
fanning operation.
Proposed Boundary Changes:
Make both parcels more usable, by following the natural topography of
the land, by utilizing existing ditch and road as a natural boundary, and by
facilitating farm usage as outlined above.
5. Description of location, size, use of new lots:
Proposed Lot "A" is in the northwest corner of the parcel, at the corner of
WCR 17 and WCR 16. It will be 93.88 acres in size. It is under contract
to be sold, and new owners will continue agricultural use, and have
expressed intent to apply for permits to build two communication towers.
Proposed Lot "B" is east of Proposed Lot "A" and north and west of
Existing LOT B RE-2425. Proposed Lot "B" will be approximately 3.4
acres in size, and will be used as a rural residential property by applicant's
son who will continue to farm the adjoining property belonging to his
family.
Proposed Boundary Changes:
Would facilitate economical continued use of existing farmland by
separating dryland wheat ground on Proposed Lot A from Existing Lot
B- RE-2425 which is planted below the irrigation ditch in alfalfa.
The newly delineated amended Lot B of RE-2425 would be
approximately 80 acres, and would continue as farmland.

6. Statement regarding unusual physical properties:
A 180' strip of land owned by Public Service Company of Colorado
(PSCo) containing power lines and supporting towers borders the
proposed lots "A" and "B" on the north, and Proposed Lot "A" on the
west. There are currently no private access roads to the property; there
are access roads to existing oil and gas wells, and the existing ditch
access road which is included in the legal description for Lot B RE-2425.
Applicants have obtained an EASEMENT from PSCo to construct and
maintain four (4) access roads across PSCo's 180' strip. Deed to two of
those easements would transfer to the purchaser of Proposed Lot "A";
one would be deeded for use on the Recorded Exemption, Proposed Lot
"B"; one would be deeded for use on amended Lot B RE-2425. (Copy of
EASEMENT attached).
Proposed Boundary Changes:
Have no effect on access roads to either parcel.
7. Statement regarding structure setback requirements:
All structures will meet all setback requirements.
8. Statement regarding conservation easement:
The applicant does not have a need to establish a conservation easement
at this time, and has no plans to do so.
9. Statement regarding building envelope:
There are no specific plans to build on the proposed lots, so applicant
prefers not to establish a building envelope as part of this application, but
is willing to locate any new structures so as to minimize interference with
farming activities.
10.Statement of consistency with Weld County Comprehensive Plan:
This application is consistent with the provisions of the Weld County
Comprehensive Plan. Particular attention has been paid to preservation
of prime agricultural land wherever possible. None of the subject land is

prime, but the intent of this application is to promote and to maintain
current agricultural use of the property.
Proposed Boundary Changes:
Facilitate maximum farming efficiency and create more natural parcels,
following the natural topography and utilizing existing ditch and road as
boundary.
11.Statement of compatibility with surrounding land uses:
The proposed uses of production agriculture and rural residence are
consistent with the similar uses of all surrounding properties.
Proposed Boundary Change:
No impact on surrounding land use.
12.Statement explaining consistency with intent of Agricultural District
This proposal will provide one approximately 3.4 Acre building site -
Proposed Lot B-on a tag of land, which forms a natural northeast corner
boundary to Proposed Lot A. It, is then located in the northwest corner of
the Wilson family farm. Providing that building site will allow the
Wilsons' son and his wife to build and own a home, while continuing to
farm. This promotes continued agricultural use of the land and
community stability. It protects and maintains our agricultural heritage.
Proposed Boundary Change:
Promotes natural boundary of existing ditch and ditch road which utilize
the natural contour of the road.
13. Statement explaining consistency with efficient and orderly
development.
This proposal for a Recorded Exemption is consistent with efficient and
orderly development. It is located on the tag end of a dryland wheat
parcel. Using it as a building site will encourage planting native grasses
which will help stabilize and hold the ground, as well as promote the
natural beauty of the area. The proposal has the minimal impact of
allowing one additional building site on a total of 170 acres. Provisions
are available for adequate water and septic.

The general welfare of the residents of the area will be enhanced by
having another small family farm, thereby maintaining rural heritage,
and by the continued agricultural use of the Wilsons' existing adjoining
farm. Impact to sheriffs patrols and fire protection is minimal. The

Improve the conformity of the parcels to the topographical contour of the
land, maintaining the existing ditch and ditch road as natural boundaries

COMMENTS:
WCR 16 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the
required setback is measured from the future right-of-way line.
WCR 17 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-
way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County.
Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.

become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

TAP FEE AGREEMENT
THIS AGREEMENT,made and entered into this &V"'day of
by and between the CENTRAL WELD COUNTY WATER DISTRICT,hereinafter called the District,and
Richard L,&Elizabeth A.Wilson
hereinafter called Customer,WLTNESSF.TH:
WHEREAS,District has been organized as a legal body and is known as the Central Weld County
Water District,and
WHEREAS,Customers arc taxpaying electors within said District,or desiring to join said District,or
•and,
WHEREAS,Customers are desirous of acquiring one water tap of 5/8 inches in diameter
from the said District,
NOW,THEREFORE,in consideration of the premises and the terms of this agreement,it is mutually
agreed as follows:
1. Customer agrees to pay the tap fee of$ 5 100 00
Five Thousand One Hy7tdrod and 00/100 Dollars.
2. The description of the premises for which this tap is being purchased is as follows:

3. This agreement, when approved by the Board of Directors, shall become a legal and binding
contract upon all parties hereto.
4. Customer further agrees to execute any and all easements needed by District at no expense to
District,across Customer's property for the installation of the Meta pit and appurtenances constructed by
District. District shall be responsible for restoring surface area back to reasonable condition at District cost.
5. Customer further agrees to execute any and all easements needed by District at no expense to
District,across Customer's for the purpose of installing the District's service line and meter pit constructed
by District. District shall be responsible for restoring surface area back to reasonable condition at District
cost.
6. Customer further agrees to the following special provisions:

7. Customer further agrees to abide by the rates established and the rules and regulations of thr

EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That, PUBLIC SERVICE COMPANY
OF COLORADO, a Colorado corporation, whose address is 1225 Seventeenth
Street, Denver, Colorado 80202 (Grantor), for the sum of Five Hundred Dollars
($500.00) and other good and valuable consideration in hand paid, does hereby
grant, bargain, sell and convey to Richard L. Wilson, whose address is 6767 WCR
19, Ft. Lupton, Colorado 80621, (Grantee), its successors and assigns, a non-
exclusive easement to construct, maintain, alter, repair, replace, reconstruct,
inspect, operate and remove a four (4) access roads, together with related
appurtenances on, over, under and across the following described premises
located in the County of Weld, State of Colorado, to wit:
The North 180.00 feet of and the West 180.00 feet of the North of
Section 33, Township 2 North, Range 67 West of the 6th P.M., County of Weld,
State of Colorado. Subject to existing county roads.
This grant of easement is subject to the following conditions:
1 . The use of the premises shall be for above stated purposes only. No buildings,
structures, signs or wells shall be erected, placed or permitted to remain on the
premises.
2. Grantor reserves the right to place utility facilities in, under, over and across
said Easement which do not interfere with Grantee's use of the premises.
3. Grantor shall, at all times, have the right of access by a reasonable route to the
Easement and along and upon the same for the operation and maintenance of
its utility facilities.
4. The easement herein granted is subject to the lien of Grantor's Indenture, and
to its termination by the Indenture Trustee upon the occurrence of an event of
default under the Indenture.
5. Grantee agrees, to the extent permitted by law, to save, indemnify and hold
Grantor harmless from and against all claims and liability for damages, loss or
expense caused by any injury or death to any person or damage to property if
the same shall in any way be connected with or result of the exercise by
Grantee of the rights granted herein, or the existence, operation, use or
maintenance of the roadway herein permitted.
6. This Easement is issued subject to any prior licenses, easements, or leases
granted by Grantor for facilities of other parties.
7. In case of the permanent abandonment of this Easement, all right, privilege and
interest herein granted shall end, cease and terminate.

8. Grantee and its agents, employees, and contractors shall comply with all
Federal, State and local hazardous materials laws including but not limited to
the Comprehensive Environmental Response, Compensation and Liability Act,
the Resource Conservation and Recovery Act, the Solid Waste Disposal Act
and Sections 25-15-101 , et. seq., 25-16-101 , et. seq., 25-07-101 , et. seq.,
and 25-8-101 , et., seq. of the Colorado Revised Statutes. Grantee shall not
use, generate, store or dispose of any hazardous substance on, under or about
the premises except in full compliance with any applicable hazardous materials
laws. If the presence of hazardous substances arises out of Grantee's use or
occupancy of the premises, Grantee shall be responsible for all actions, legal or
administrative proceedings, demands, claims, judgments, damages, penalties,
fines, costs, liabilities, or expenses including, but not limited to personal injury,
property damage, diminution in property values and remediation of
contamination.
9. Each of the four new access roads is to be installed no closer than fifty (50)
feet to any electric transmission tower. Written approval from PSCo is required
prior to any removal or addition of soil along the ROW.
