HomeMy WebLinkAbout20031009.tiff RESOLUTION RE: APPROVE AMENDMENT #2 TO COOPERATIVE LAW ENFORCEMENT AGREEMENT FOR PAWNEE NATIONAL GRASSLAND AND AUTHORIZE CHAIR TO SIGN - U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment#2 to the Cooperative Law Enforcement Agreement for the Pawnee National Grassland between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, and the U.S. Department of Agriculture, Forest Service, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Amendment#2 to the Cooperative Law Enforcement Agreement for the Pawnee National Grassland between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriffs Office, and the U.S. Department of Agriculture, Forest Service, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. Reimbursement for all types of enforcement activities shall be at the following rates unless specifically stated otherwise: $0/mile patrolled Per diem rate is $0/day Wages at the prevailing rate of$35/hour. II. PATROL ACTIVITIES: A. Officers will patrol in 3-4 hour increments during the times and days listed on"EXHIBIT B". Time schedules for patrols will be flexible to allow for emergencies, other priorities, and day-to-day needs of both the Cooperator and the Forest Service. B. Ample time will be spent in each area to make residents and visitors aware that law enforcement officers are in the vicinity. Officers will complete proactive patrols where they focus specifically on educating visitors about shooting and off-road-vehicle regulations on the Pawnee Grasslands. • Patrol the loop described below(See also map, "EXHIBIT C"): From Highway 14, 1) County Road 57 North to 2)County Road 96 East -Take the spur Forest Road 59 into Coal Creek(popular shooting area) 1/3 mile to where it dead ends 3)Continue back on County Road 96 East -Take County Road 63 North for one mile 4)Continue back on County Road 96 East to 5)County Road 69 North -Check spur County Road 98 West 6)Continue back on County Road 69 North to 7)County Road 104 West to 8) County Road 57 South(and back to highway 14) Total reimbursement for this category shall not exceed the amount of: $ 4,167.00 III. TRAINING: See Cooperative Law Enforcement Agreement Provision IV-J for additional information. Total reimbursement for this category shall not exceed the amount of: $0 IV. SPECIAL ENFORCEMENT SITUATIONS: A. Special Enforcement Situations includes but is not limited to: Fire Emergencies, Drug Enforcement, and certain Group Gatherings. B. Funds available for special enforcement situations vary greatly from year to year and must be specifically requested and approved prior to any reimbursement being authorized. Requests for funds should be made to the Forest Service designated representative listed in Item I-A of this Operating Plan. The designated representative will then notify the Cooperator whether funds will be authorized for reimbursement. If funds are authorized, the parties will then jointly prepare a revised Operating Plan. 1. Drug Enforcement: 2. Fire Emergency: 3. Group Gatherings: This includes but is not limited to situations which are normally unanticipated or which typically include very short notice, large group gatherings such as rock concerts, demonstrations, and organizational rendezvous.
