development by the surface developer, KPK has many oil and gas wellheads,

The Department is concerned with septic systems suitability for these specific lots: 25 through
31, 34, 35. Lot 36 should also be reviewed for suitability based on comments from Cecila
Greenman, with the Colorado Division of Minerals and Geology.
The following items should be addressed regarding the suitability for septic systems for all lots:
1. Show correct lot sizes for all affected lots after changes to meet WC Public Works
requirements for roads, and lots affected by acreage placed into dedicated open
space;
2. Show appropriately sized septic envelopes for all lots that meet all septic system
setbacks to pertinent ground features such as ditches, wetlands, ponds, etc. These
septic envelopes should also be placed outside other lot-specific restrictions,
including but not limited to, slopes restrictions, Oil and Gas roads and easements,
etc.;
3. Show a more realistic location for building site and septic envelopes for Lot 17
(Cecila Greenman);
4. Correct the septic envelope size discrepancy - envelopes labeled on plans are
larger than measured;
5. Eliminate any lot that cannot not meet all septic system setbacks as noted above;
6. Develop and submit a Septic Management Plan as outlined in Department
comments dated October 24, 2002 for review and approval.
Additional percolation test data may be conducted for the questionable lots and may be
used for septic envelope sizing.

The Subdivision known as The Pointe is located within St. Vrain Sanitation District 208
boundary. It is the long range plan of the District to serve all land parcels within the 208
boundary. The property can be served by line extensions to the east and north(see
attached map). Currently, there are no line extension agreements to bring sewer service
to that area of the District. Service to said property is subject to the following conditions:
• Inclusion to the District
• Completion and acceptance of line extension(s)to connect owners to existing
SVSD facilities,
• Completion of necessary connection requests/agreements,and
• Receipt of applicable fees.
Service will be subject to the rules and regulations of the St. Vrain Sanitation District

Dear Mrs. Lockman,
I want to thank staff for their time on Friday morning. It is my feeling that we were able
to resolve all of the outstanding technical issues regarding the Change of Zone for the
Pointe. As I stated in this meeting, we accept the condition of approval that we may lose
or need to consolidate up to thirteen (13) lots due to our potential inability to meet
setback and percolation requirements for Individual Septic Disposal Systems while
generally maintaining our current roadway layout.
As we have discussed with your predecessors in the Planning Department on several
occasions, we will as part of our sewage disposal system require future homeowners
through their HOA to meet standard maintenance requirements including regular removal
of waste from their septic tanks. We will work with the Health Department Staff prior to
Final Plat to finalize this maintenance plan, which, as we discussed in our Friday
meeting, will be a plat note and a covenant on the property. We feel that not
withstanding the condition on the nine lots, as stated above, in concert with the rural
nature of the development we have meant Weld County's criteria for an adequate sewage
disposal system.
At your request I meant with the St. Vrain Sanitation District Friday to clarify their
position on the availability of public sewer to the property. I have attached their
response, which is a standard form letter. As stated in this letter, "there are no line
extension agreements to bring sewer service to that area of the district". From a review
of the attached map it can be determined that public sewer service for this property would
require no less than 3.5 miles of mainline sewer extensions. We estimate this cost at
approximately two million dollars. In addition these extensions, which would go north
on WCR 7 and east to and existing line just west of 125, would still leave approximately
thirteen (13) lots at the northwest corner of our property without sewer service. So, to
provide public sewer to the remaining 24 lots would cost approximately$83,000 per lot.

It has been our understandings throughout this process that our ability to gain support for
the requested zoning is based on our ability to meet the adjacent municipalities
anticipated land use for this area. An $83,000 cost per lot would be a hardship to the
property and eliminate our ability to maintain the I du/ 5 acre zoning which we are
requesting.
