HomeMy WebLinkAbout20031194.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST MONRICO AND ALTHEA LEHNERT, AND JLR DRYWALL SUPPLY, LLC, FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Monrico and Althea Lehnert, owners, and JLR Drywall Supply, LLC, tenant, VI #0300060, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of May, 2003, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Monrico Lehnert, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 13th, 2003, to allow adequate time for the property owners to relocate to a different site. Our plans our as follows: 1. We have signed a contract for the purchase of 2 lots in Evans Industrial Park. 2. To build a building and warehouse and move our business to that location. 3. To move all material on the exterior of our current leased location to either that property or to another area located at 1212 N. Van Buren in Loveland,CO. within the next 30 to 45 days. 4. To move equipment from our current location including our property located on the west side of our current location to the same areas as in item 3 within the next 30 to 45 days_ 5. To keep delivery trucks going in and out of our current location to a minimum, That, in a nutshell is our plan. Our closing on the new property is on May 5s', 2003. We intend to proceed with dosing and then construction of our building as expediently as we are allowed. We estimate that it will take a maximum of 9 months for all of this to transpire. We have not yet decided what we are going to do with our current lot as of this date.
