RE: DENY REQUEST OF PETITIONERS TO ESTABLISH THE BRIGGSDALE
PEST CONTROL DISTRICT
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , pursuant to Section 35-5-104 , CRS, as amended, the
Board of County Commissioners of Weld County, Colorado, caused
the mailing of ballots to landowners in the Briggsdale area after
having received a petition for the establishment of a Pest Control
District in said area, and
WHEREAS, said statute requires that at least 66 2/3% of the
landowners and leasees of State land who own or lease 50% of the
land, excluding Federal lands and unleased State lands, in said
district must vote in favor of the establishment of said dis-
trict, and
WHEREAS, a ballot counting committee, which was appointed
by Resolution dated May 14 , 1984 , did count those ballots which
were returned within the required ten days of the date of mailing
by Weld County, and
WHEREAS , upon completion of the ballot count by the committee
it was found that there were 81 votes in favor of the establish-
ment of the Briggsdale Pest Control District and 30 votes opposed,
representing 96 ,620 acres voted, and
WHEREAS , there are 249 , 760 total acres in the proposed dis-
trict and the U.S. Forest Service has verified that there are
31 ,263 acres of Federal land within the proposed boundary, which
leaves 218 ,497 acres of private and State leased land, and
WHEREAS , the results show that while the number of those
voting in favor of the proposed Pest Control District was adequate
for passage, the required 50% , or 109 ,248 acres, was not attained,
and
WHEREAS , due to the insufficient number of acres voted, the
petitioners ' request to establish the Briggsdale Pest Control
District must be denied.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request for the
establishment of the Briggsdale Pest Control District be, and
hereby is, denied due to the insufficient number of acres being
voted as shown in the letter submitted by the counting committee,
a copy of said letter being attached hereto and incorporated
herein by reference.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 11th day of
June, A.D. , 1984 .

Dear Board of County Commissioners:
By resolution, dated May 14, 1984, the Weld County Extension Service
was directed to prepare ballots and conduct an election for a pest
control district in the Briggsdale area. This was done and the ballots
were mailed May 18, 1984.
The ballots and verifications were counted on May 30, 1984.
Following are the results:
81 votes in favor
30 votes opposed
96,620 acres voted
In order for this election to pass sixty-six and two-thirds percent
(66 2/3%) of landowners and leasees voting must vote in favor of
establishing a district, and those persons voting shall constitute
ownership of fifty percent (50%) or more of the land in the proposed
district.
The results show that the number voting in favor is adequate to pass;
however, the acres voted is not sufficient for the election to pass.
The proposed district has 249,760 acres total . The U.S. Forest Service
has verified that there are 31,263 acres of federal land within the
proposed boundry. This leaves 218,497 acres of private land and state
leased land in the proposed district. For the vote to pass , fifty
percent (50%) or 109,248 acres would have needed to be voted.
The counting committee verifies that the above figures and dates
are correct to the best of our knowledge.

Dear Board of County Commissioners:
We have received petitions from Briggsdale area landowners
requesting an election for a Pest Control District.
It has been verified from the assessors records and State Land
- Commissioners records that there are 239 resident landowners and 4
resident leasees that are not landowners. This is a total of 243
resident landowners and leasees of state land within the proposed
district. For an election to be held, twenty-five percent (25%)
of these are required on petitions. The required number is 61
persons.
The enclosed petitions show 72 names which is more than the
required number.
The proposed district has 249,760 acres total . The U.S. Forest
Service has verified that there are 31,263 acres of federal land within
the proposed boundary. This leaves 218,497 acres of private and state
leased land in the proposed district.
For the vote to pass, 50 percent (50%) , or 109,248 acres must be
voted and 66 2/3 of those voting must vote in favor of establishing
a district.
