HomeMy WebLinkAbout20032699.tiff Town of Lochbuie Wastewater Treatment Plant ANNEXATION REPORT September 15, 2003 raa vi `n, r4 " "AMR op Current wastewater plant, circa 1980 Annexation of property to the Town of Lochbuie, Colorado -Th �-/� /��_c , (7 -4,?_) _ d ; S-CD 2003-2699 INTRODUCTION The following report has been prepared pursuant to Section 31-12-108.5 of the Colorado Revised Statutes (C.R.S.)and concerns the proposed annexation of certain real property known as the Wastewater Treatment Plant to the Town of Lochbuie. The property is proposed to be annexed in 4 parcels comprising a total of 20.453 acres more or less. The Property is generally located in Section 29, Township 1 North, Range 65 West, of the 6th Principal Meridian, Weld County, Colorado. The Property is located within the right of way of Weld County Rd. (WCR) 39 and southeast of the intersection of WCR 39 and WCR 6. The Town of Lochbuie is adjacent to the Property along lands bordering I-76 and WCR 4. CURRENT ZONING/USES/PROCESS The Property is currently either the right of way of Weld County Road 39, or zoned A (Agriculture) in Weld County, Colorado. A change in zoning to industrial uses is being proposed as a part of this application. For purposes of this Report, the word Property relates to the lands that are the intended location of the Wastewater Treatment Plant. Agricultural uses are the only current uses found on the Property. The Beebe Seep Canal borders the proposed Wastewater Plant site (Annexation#6)along its eastern edge. The Town of Lochbuie Board of Trustees intend to approve Ordinance No. 398 annexing these properties on October 1, 2003. The annexations would become effective 30 days after publication of the adopted Ordinance. Advertising and notice, pursuant to the C.R.S., has been directed by the Town of Lochbuie. Copies of this Impact Report, annexation materials, the referenced Ordinance, and the published notice of the hearing, were mailed to the Weld County Board of County Commissioners and the County Attorney, among others, in accordance with C.R.S. §31-12-108. a( ) MAPS Six maps are included as attachments to this report as required by Subparagraph(a) of C.R.S. 31-12-108.5: ATTACHMENT A: Annexation Maps 3 -6 The Annexation Maps reflect a series of annexations and that portion of the boundary of each proposed annexation that is projected to be contiguous with the Town of Lochbuie. In total, the proposed annexation would include approximately 20.453 acres. 1 The contiguity established with the Town is indicated on the Annexation Map with a hatch pattern along the contiguous portion of the boundary line. It is anticipated that these annexations will proceed in a series from#3 through#6. In this way, contiguity will be established for each succeeding annexation. The approximate size and percentage of the perimeter of each the annexations that are contiguous with the Town of Lochbuie are: Annexation No. 3, approx. 0.717 acres - approximately 18.08 % contiguous Annexation No. 4, approx. 1.456 acres - approximately 16.67 %contiguous Annexation No. 5, approx. 2.51 acres - approximately 21.96 %contiguous Annexation No. 6, approx. 15.77 acres -approximately 38.51 % contiguous Each of these annexations, if approved in succession, meet the requirement found in the Colorado Revised Statues §31-12-104 that property is at least 1/6 (16.6%) contiguous with the municipality that is being petitioned for annexation. ATTACHMENT B: Conceptual Utility Service Map This map identifies the conceptual alignment of the proposed Town of Lochbuie sewer and water lines from the existing water lines and from the existing wastewater treatment plant to the proposed wastewater treatment plant on the Property. ATTACHMENT C: Generalized Land Use Map This map identifies proposed general land uses on Annexation#6,the proposed Town of Lochbuie Wastewater Treatment Plant. Annexations#3 -#5 will remain in use as Weld County roadways. Streets: Annexations numbered 3-5 are a series of annexations that comprise a portion of the right of way of Weld County Rd. 39. These annexations run approximately one mile in succession from a point near the intersection of WCR 4 and Interstate 76 in a northerly direction toward WCR 6. A portion of WCR 39 is included in Annexation#6. No streets currently exist in the portion of Annexation#6 that is the proposed site of the wastewater treatment plant. Street extensions into the Property will be developed from WCR 39. Street improvements are anticipated on WCR 39 due to the development of the Property. The Town will take over maintenance of the portion of WCR 39 included in these annexations upon final recording of the annexations at the offices of the Weld County Clerk&Recorder. 2 Major trunk water mains, sewer interceptors and outfalls: There are currently no water mains, sewer interceptors or outfalls on-site or adjacent to the property. Wastewater service will be provided as set forth below. Other Utility Lines and Ditches: The Beebe Seep Canal runs north and east along the eastern boundary of Annexation No. 6. The 75 foot wide right of way and the Beebe Seep canal is used to irrigate farmlands and municipal uses throughout this area of Weld County. The Beebe Seep Ditch is owned and operated by the Farmers Reservoir and Irrigation Company(FRICO). (b) PREANNEXATION AGREEMENT A preannexation agreement is not required and has not been prepared. The Town of Lochbuie is the owner of the Property. (c) MUNICIPAL PLAN FOR EXTENDING SERVICES For all facilities and services, the Annexor will have the obligation to develop and install all on-site and off-site transmission infrastructure facilities necessary to serve the Property with water, wastewater and stormwater facilities and services. Water: It is anticipated that the Town will deliver a sufficient amount of raw water or water rights to serve the development of the Property and that water treatment and water services will be provided to the Property by the Town. Wastewater: It is anticipated that the wastewater services and wastewater treatment will be provided by the Town upon construction of the proposed wastewater facility. Stormwater: The Annexor will design and construct storm drainage facilities within the Property including, but not limited to: channels, inlets, piping, detention ponds and water quality facilities. The Annexor shall convey and manage the 100 year storm events in compliance with standards approved by the Town. It is anticipated that historic flows will be conveyed to the Beebe Seep Canal under an agreement with FRICO. Other Dry Utilities: Providers other than the Town of Lochbuie will provide services including: telephone service by Qwest, electrical service by United Power, and natural gas service by XCEL Energy (Public Service Company of Colorado). Service lines are intended to be located within street or other rights of way dedicated to those purposes within the Property. 3 Emergency Services: Police protection will be provided by the Town of Lochbuie Police Department. Fire protection and emergency response will be provided by the Hudson Fire Protection District. Open Space/Parks/Public Land Dedication: The annexation will result in the addition of public lands suitable for a wastewater treatment plant and other public facilities. No dedication of other open space, parks, or public lands is contemplated as a result of this series of annexations. Streets: The proposed access to the Property will be from Weld County Rd. 39 and Weld County Rd. 6. The Annexor will improve the on-site streets to urban public standards. (d) FINANCING PLAN FOR EXTENDING MUNICIPAL SERVICES The extension of municipal services into the Property will occur through one or more of the following mechanisms: 1. Development Fees, 2. Plant Investment Fees, 3. Water and Sewer Fund capital expenditures, 4. Grants, loans, and/or bonding, and 5. As otherwise decided by the Town as appropriate. (e)EXISTING DISTRICTS IN THE AREA TO BE ANNEXED The Weld County Treasurers office records reflect that prior to purchase by the Town of Lochbuie, the Property was subject to the following taxing authorities: Tax District Levy Aims Junior College District 6.316 Hudson Fire Protection District 3.318 CCW Water District .871 Central Colorado Water Conservation District 1.428 Weld County School District RE-3(j) 39.500 Weld County Library District 3.249 Weld County Administration 20.056 With the purchase of the Property by the Town of Lochbuie, one or more of the taxing entities noted above no longer tax the Property. 4 (f) EFFECT ON SCHOOL DISTRICT RE-3(i) Proposed development of the Property as a Town of Lochbuie Wastewater Treatment Plant will have no direct effect on attendance within the School District.No residential land uses are proposed on lands subject to this annexation. Successful annexation and development of the Property will decrease revenues to the School District over the amount generated by this Property prior to its purchase by the Town of Lochbuie. Development of a state-of-the-art wastewater plant with a long lifespan and large capacity will indirectly affect School District RE-3(j). Wastewater plant capacity is an important factor for all types of development.
