RESOLUTION RE: GRANT REQUEST OF ARIX, ON -BEHALF OF -BEEBE DRAW CATTLE COMPANY, TO ERE-ADVERTISE CHANGE OF ZONE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, ARIX, on behalf of Beebe Draw Cattle Company, has submitted a letter to the Board of County Commissioners requesting that a Change of Zone application be pre-advertised, and WHEREAS, a copy of said letter is attached hereto and in- corporated herein by _reference, and WHEREAS , after review, the Board deems it appropriate to grant said request to pre-advertise these matters . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners -of Weld County, Colorado, that the rainiest made by ARIX, on behalf of Beebe Uraw Cattle Company, to pre-advertise the application for a Change of Zone be, and hereby is , granted. THE INITIAL STARTING POINT IN THE PLANNING AND ONE OF THE PRINCIPAL USES AND MOST IMPORTANT FEATURES OF THE DEVELOPMENT IS THE COMPLETE EQUES- TRIAN CENTER AND TRAINING FACILITY FOR ALL TYPES OF EQUINE USES, INCLUDING A CROSS COUNTY COURSE AND APPROXIMATELY 18 MILES OF RIDING TRAILS THAT WILL EXTEND THROUGHOUT THE GREEN BELT AREA. 2. THE DEFINITION IN THE ORDINANCE OF A PUD FITS THIS PROJECT COM- PLETELY: "THE OBJECTIVES OF THE PUD (PLANNED UNIT DEVELOPMENT) DISTRICT ARE TO: ENCOURAGE FLEXIBILITY AND VARIETY IN THE DEVELOP- MENT OF LAND TO PROMOTE ITS MOST APPROPRIATE USE ; IMPROVE THE DESIGN, CHARACTER, AND QUALITY OF NEW DEVELOPMENT; FACILITATE THE ADEQUATE AND ECONOMICAL PROVISIONS OF PUBLIC AND PRIVATE SERVICES ; PRESERVE THE NATURAL AND SCENIC FEATURES OF THE DEVELOPMENT AREA; ENCOURAGE AN INTEGRATED PLANNING APPROACH; AND ENSURE COMPATABILITY WITH WELD COUNTY ' S COMPREHENSIVE PLAN AND SUBDIVISION REGULATIONS. WELD COUNTY IS AUTHORIZED TO REGULATE PLANNED UNIT DEVELOPMENTS BY SECTION 24-67-101, ET. SEQ, COLORADO REVISED STATUTES, 1973 AS AMENDED." 6. THIS PUD WILL RESULT IN THE CREATION OF A HOMOGENEOUS COMMUNITY OF PROPERTY OWNERS WHO HAVE TO HAVE THE SAME INTEREST IN THE LIFESTYLE BEING OFFERED OR THEY WOULD NOT BE WILLING TO BUY UNDER THE SEVERE RESTRICTIONS THAT ARE BEING PLACED ON THE DEVELOPMENT. 7. THE POLICIES ON PAGES 59 AND 60 OF THE COMPREHENSIVE PLAN APPLYING TO RESIDENTIAL TYPE DEVELOPMENTS CANNOT BE APPLICABLE TO SUCH A LARGE MIXED USE PUD SUCH AS THIS. THIS DEVELOPMENT WILL NOT ESTABLISH A PRECEDENT FOR RESIDENTIAL DEVELOPMENT IN THE AREA. WHILE THE COMPREHENSIVE PLAN SEEMS 10 ENCOURAGE RESIDENIIAL GROWTH ADJACENT TO EXISTING MUNICIPALITIES THIS IS NOT POSSIBLE IN THE CASE 1 OF THIS LARGE AND UNIQUE PUD DEVELOPMENT WHICH REQUIRES THE SPECI- FICS OF THIS SITE THAT CANNOT BE DUPLICATED ANYWHERE ELSE. THIS PUD IS UNIQUE AND UNLIKE ANY CONVENTIONAL RESIDENTIAL DEVELOP- MENT ANYWHERE ELSE IN WELD COUNTY OR IN THE FRONT RANGE AREA. ITS SIZE AND COMBINATION OF USES WOULD MAKE IT IMPOSSIBLE TO BE LOCATED IN OR ADJACENT TO ANY EXISTING CITY, SINCE IT COMBINES SINGLE FAMILY HOUSING OWNERSHIP WITH THE COMMON OWNERSHIP OF A FULL SERVICE EQUESTRIAN CENTER, 3000 ACRES OF COMMON GREEN BELT RECREATION AREA AND ACCESS TO A LARGER AREA FOR WATER SPORTS. THE FOLLOWING FACILITIES AND SERVICES ARE TO BE PROVIDED TO TH PROPEgTY OWNERS AND WILL BE OWNED BY ALL OF THEM, SEE EXHIBITS AND A. PROPERTY OWNERS ASSOCIATION WILL OWN: ALL PUD ROADS AND EASEMENTS EQUESTRIAN CENTER FACILITIES RECREATION FACILITIES GREEN BELT RECREATION AND COMMON OPEN SPACE AREA THE TOTALLY UNIQUE COMBINATION OF ALL OF THE FEATURES INCLUDED IN THIS PUD ARE NOT AVAILABLE NOR COULD THEY BE MADE AVAILABLE IN CLOSE PROXIMITY TO ANY TOWN IN WELD COUNTY OR ANYWHERE ELSE IN COLORADO THAT WE ARE AWARE OF. THIS PUD WILL NOT REALLY CONFLICT WITH THE RESIDENTIAL GROWTH POLICIES OF THE COMPREHENSIVE PLAN BECAUSE ALL OF THE NECESSARY MUNICIPAL TYPE SERVICES ARE AVAILABLE TO THE PUD SITE. THE PUD WILL BE SELF CONTAINED WITH ITS OWN ENVIRONMENT AND ACTIVITIES AND WILL NOT HAVE EITHER AN ADVERSE ECONOMIC OR ENVIRONMENTAL IMPACT ON WELD COUNTY. SEE EXHIBIT SECTIONS O AND (ID . B. BUILDING PERMITS WILL BE LIMITED TO A MAXIMUM OF 50 PER YEAR. THIS DEVELOPMENT WILL THUS MAKE A POSITIVE CONTRIBUTION TO THE TAX BASE OF THE COUNTY, PRODUCING A SURPLUS OF 2 8. THE EXTREMELY LOW DENSITY WITH A MAXIMUM OF ONE HOME PER EACH SIX ACRES OF THE PUD NOT INCLUDING THE 2200 ACRES OF THE MILTON RESERVOIR LEASE. The problems of a development such as purposed, fifteen miles away from any population center, are overwhelming. A few of the problems include: 1) Roads in the area- the developer may promise oil roads etc. but who will maintain these roads in the future . A drive on Weld County roads makes you aware of the huge maintenance problems . . 2) Pressure on the RE-1 School District - Even if a developer promised land for this it is a small price for him to pay, the tax payers of this district will foot the burden. 3) Police and fire protection - this is a very remote and rural area. 4) Misuse of limited agriculture land. The praire land in this area is .a very aandy and delicate ecosystem. Intensely developed there can be several unseen problems of land erosion and sand blowing. 5) What effect will a development as purposed have on adjacent agrriculture land? 6) Water usage and pollution - a development as this takes a huge amount of limited water. What effect will 600 closely packed septic systems have on water in the area? 7) Air pollution - the remoteness of the development dic- tates increased driving in the front range. 8) The Milton Reservoir is not in any condition to be any- thing but an agriculture reservoir. To portray this area as a summer playground of waterskiing, sunbathing, windsurfing, horseback nature riding is a cheap ploy by the developer to sell. The mosquitos , horseflies and other insects along with rattlesnakes etc. make this area less than ideal in the sum- mertime. With all these problems , I as a lifetime resident of the Beebe Draw community cannot see how anyone who has seen this area could vote for the development purposed. The developer has shown no regard for the area and is prepardd to promise anything to get his way so he can make a huge profit. This parcel of land contains approximately 4,300 acres. They have a lease with the Milton Damn for recreational uses for twenty Years, renegotiable every five years. They are asking that this parcel of land be rezoned to allow for approximately 1,500 single family and multiple family dwellings on approximately 1,500 acres and an equestrian training and riding area. There will be over three thousand acres of greenbelt area with horse riding trails. Any equestrian events seen at the Olympics can he held here as well as other equestrian events. He discussed how this proposal complies with the Weld County Zoning Ordinance and the Comprehensive Plan. There will be no prime farmland taken out of production. The size of each lot, approximately two acres, and the use make it impossible to locate next to an existing town. Building permits will be limited to a maximum of fity per year so the fiscal impact on the area can be controlled. In this way the fiscal impact can be reviewed as outlined in their written plan. They have worked with the State Fish and Wildlife Department to preserve the wildlife in the area. Central Weld Water would provide water to the area and they have agreements with both ditch companies. The Planned Unit Development will be buffered on all County Roads, and all -accesses to the individual properties will he within the Planned Unit Development itself. Individual septic tanks will serve the Planned Unit Development area. Each individual lot will be located on a greenbelt area. There are currently twenty—nine oilwells on the property and these will also be protected by a greenbelt area and any residences would more than meet the setback requirements. Summary of the Weld County Planning Commission Meeting November 33, 1984 Page 9 Tape 183 — Side 2 Mr. Burk reviewed the traffic study done on the proposed Planned Unit -Development. They will maintain seven miles of gravel roads in the area plus dust control. They will pave Weld County Road 32 from Platteville into the project, but they have not set a definite time limit on this. All interior roads will be permanently maintained by the association. He also discussed the possibility of forming a law enforcement authority district. Steven Blue, Arix, presented a drawing of the Planned Unit Development. This was retained by the staff as evidence. Drew Scheltinga, Weld County Engineer, felt this development would have a major impact on the Weld County Road and Bridge Department, especially on Weld County Road 32 and 39. This is a huge development and by the developers projections there is the possibility of traffic increasing to five or six thousand cars per day. Tape 184 — Side 1 Louise Allen, Rosall Remmers Cares, Planning Urban Design and Research, discussed the fiscal and school impacts the Planned Unit Development would have on the area. Art Uhrich, P.E. , Arix, reported the Weld County Health Department has now given approval for individual septic systems to be placed within the Planned Unit Development area. The Chairman asked Rod Allison to read the recommendations of the Department of Planning Services staff, which is for denial, into the record. The Chairman called for discussion from the audience. Craig Anderson, surrounding property owner, asked that this request be denied because it is a residential venture rather than an agricultural project. David Karpell, Rocky Mountain Energy, a Division of Union Pacific -Railroad Company, stated they own the mineral rights on all odd numbered sections. They would like to maintain the use of any area which may have a mineral deposit. Audry Ward, Property owner one mile south of the area, spoke against this proposal fearing the electric lights from the project would interfer with her study of astronomy. Neil Peters, Attorney, Amoco, stated Amoco is the holder of the lease rights and they would like to be sure that if this request is approved their rights are protected. They would also like a provision written into the standards and filed with the plat that oil and gas is a use by right and that they will be able to drill in any area they feel would be productive. Carl Jeppson, II, stated that he felt developments of this type should be next to an existing town instead of starting a new city in the middle of nowhere. Dave Harvey, equestrian instructor, reported they want to move their equestrian center from Fairplay to this area because of the longer season and the lower altitude. Pamela Staley, Engineer, Amoco, discussed oil formations in this area. She presented a map with geological formations for the area. This was retained by the staff for evidence. She does not feel this is necessarily the best use of the land, and in light of cost to the County, whether or not we like it or not, the cost is there and is a significant detraction from what in many ways is an attrative proposal. It is her feeling they adequately addressed many of the concerns she had including a major concern, which is our compliance with our Comprehensive Plan. These moles were drilled to determine if potentially economic coal and sand and gravel deposits exist beneath the site. The Laramie core hole did not find coal seams in excess of 3.4 feet. Two core hole logs west of the property indicate that many of the coal seams are discontinuous. An exploritory hole was drilled in the ancient Platte River channel , northwest of Milton Reservoir. This hole indicates that approximately 60 feet of sand overlies gravel in the channel . This drill hole data from the Leonard Rice economic geology report indicates that economic coal and gravel deposits are not present beneath the site. Based on this information, we have no objection to the proposed zoning change. However, we continue to recommend that a geologic report, as required by Senate Bill 35, be completed for this development. The applicant has based his road improvements proposal on the premise that Weld County has capital improvement funds available to devote to the road network serving the proposed development. Quite to the contrary, we have no capital improvement program. All available funds are now committed to maintaining our 3000 miles of roads at present service levels. This is not always possible, and some of our roads are being degraded. We have been forced into a mode of de-building our transportation infrastructure and are unable to provide adequate, facilities for the levels of usage our road network is now experiencing. Certainly, it is inconceivable that we could financially support the severe increase in service levels required by this development. A traffic increase from 200 vehicles per day to 3000 would require improvements far in excess of those proposed by the applicant. The applicant has requested that the County share in the improvements to six miles of gravel road. There is no doubt among all parties that these gravel roads are not sufficient to serve the project. There are, however, at least eight additional miles of roadway which are also inadequate to serve the development. The paved section of Road 32 into Platteville and the paved portion of Road 39 north to Road 44 are in poor condition. These roads are narrow, lack shoulders, lack adequate vertical and horizontal alignment, lack proper structural base, and the pavement sections are deteriorated beyond repair. These roads, along with the sandy section of Road 32 along the south boundary of the subdivision, will not properly serve any increase in traffic volume. In reality, this development requires upgrading of at least 14 miles of road. Based on the applicant' s projections for County Road and Bridge income from the development at build out, these initial improvements have a 75 to 100 year pay-back period. Not only are the proposed improvements insufficient, but the County should not be shouldered with the responsibility of mitigating this development's impact on the road system. The proposed improvements package incorporates a 14 year stage construction plan. Our experience has shown that stage construction methods, such as those proposed, are not effective. The base course becomes contaminated and loses its structural value in a very short period of time. In addition, the surface treatments are not adequate to support interim traffic loads prior to paving. We have tried these methods on Weld County Roads 16, 39, 41 and 100. None of these attempts at stage construction were successful . These roads experience relatively light traffic of less than 100 vehicles per day. Yet, the applicant has proposed pavement only after reaching 1750 vehicles per day. Even then, only 21/2 inches of pavement is proposed. In accordance with the Colorado Department of Highways' Design Manual , we anticipate a the need for at least twice that pavement thickness to support the projected traffic volume. The proposed road improvements would be administered through a long-term (14-year) agreement between the County and the Homeowners ' Association. Our experience has shown that long-term commitments such as these are not effective, even with the best of initial intentions and well-conceived plans . The slightest problem, dis- content, lack of sales, change in financial abilities , or change in the desires of the residences becomes a difficult situation which always falls back into the County. Even if the County were willing devote over $869,000 to this project, we do not think that a 14-year commitment with the future property owners would be an effective way to pursue these improvments . We also feel that the cost of improvements would increase to over $4,000,000 over the years . We realize that the road improvements needed to properly serve this development are beyond the fiscal feasibilities -of the project, but that is not the fault of Weld County. The problem is attempting to develop a parcel so far removed from existing services . The Weld County Zoning Ordinance is quite clear in that the applicant is required to show adequate existing access facilities . The site is not located to comply with this requirement, nor can it be made to comply without serious financial impacts on the developer as well as the Weld County Road and Bridge Budget. Warden t\' Vt COLORADO From 1 Fiscal Impact Analysis of Beebe Draw Subject: At your request, I have reviewed the fiscal impact report submitted by Beebe Draw. I have only reviewed the report from Weld County Government's perspective, and not from the School District's or special district's point of view. The methodology utilized in the fiscal impact analysis is a reasonable methodology and the data is reliable with the following exception. The report appears to not include the future maintenance cost o₹ the road system that will be required to support the project. The project, as described, appears to have two major impacts on Weld County. The first impact will be the impact on roads and bridges. I concur with the memorandum of October 10, 1984 to you from Rodney Hutchinson, Engineering Manager, regarding the cost of the roads. I would not recommend approval of the project until there is a commitment on the part of the developer to pay for the road impact in the area. Without a commitment up front, I cannot envision Weld County having the financial ability in the future to accommodate the road system requirements. Not to get the developer before the project is approved or approved conditionally upon solving the road problem would do nothing but aggravate the current road and bridge problem -in Weld County. The key problem to be resolved is the development of the road system to support the project. Once the system is in place, obviously there will be maintenance costs associated with the road system developed over the next several years that would have to be absorbed by the Road and Bridge budget. The second area of significant impact will be law enforcement, as indicated in Undersheriff Rick Dill's October 26, 1984 memorandum. Again, I would concur with Undersheriff Dill's comments and suggestions. This project does meet the intent of a law enforcement authority (LEA) and should be created as part of the development. The LEA would have it's own mill levy to support the law enforcement services required. Finally this project, like all others in Weld County, will not contribute added property tax to Weld County as long as the Home Rule Charter 5% limitation remains with it's current status. The added assessed value will only contribute to lowering the property tax mill levy without any appreciated actual property tax revenue to Weld County Government. The above comments are directed only at the fiscal impact and are not in any way intended to be pro or con for the project's approval or disapproval as a land use issue. The key recommendation is that the project should not be approved until the problem of road access and development is resolved between the County and the developer. I would first of all like to refer to my letter dated July 19, 1984 (see enclosure #1) in which S raised some questions about hydrants and water pressure. The proposal did not answer these questions. I would also like you to consider the following comments and recommendations: 1. No parking to be allowed in either the standard or one way cul-de-sacs. 2. The hay storage building #4 should have at least a 100 foot separation from any planned future buildings. 3. A 6 foot chain link fence with barbed wire on top shall be placed around all oil and gas wells to prevent the tampering with valves, etc. Where deemed necessary by the LaSalle Fire Department, guard posts shall be installed to protect the wells from vehicle damage. 4. The Uniform Fire Code has been adopted by the LaSalle Fire Protection District and shall be enforced in the Beebe Draw Farms and Equestrian Center. Please see enclosures #2 & #3 for some of the main concerns at this time. 5. The applicant has based his road improvements proposal on the premise that Weld County has capital improvement funds available to devote to the road network serving the proposed development. Quite to the contrary, we have no capital improvement program. All available funds are now committed to maintaining our 3000 miles of roads at present service levels. This is not always possible, and some of our roads are being degraded. We have been forced into a mode of de-building our transportation infrastructure and are unable to provide adequate, facilities for the levels of usage our road network is now experiencing. Certainly, it is inconceivable that we could financially support the severe increase in service levels required by this development. A traffic increase from 200 vehicles per day to 3000 would require improvements far in excess of those proposed by the applicant. The applicant has requested that the County share in the improvements to six miles of gravel road. There is no doubt among all parties that these gravel roads are not sufficient to serve the project. There are, however, at least eight additional miles of roadway which are also inadequate to serve the development. The paved section of -Road 32 into Platteville and the paved portion of Road 39 north to Road 44 are in poor condition. These roads are narrow, lack shoulders, lack adequate vertical and horizontal alignment, lack proper structural base, and the pavement sections are deteriorated beyond repair. These reads, along with the sandy section of Road 32 along the south boundary of the subdivision, will not properly serve any increase in traffic volume. In reality, this development requires upgrading of at least 14 miles of road. Based on the applicant's projections for County Road and Bridge income from the development at build out, these initial improvements have a 75 to 100 year pay-back period. Not only are the proposed improvements insufficient, but the County should not be shouldered with the responsibility of mitigating this development' s impact on the road system. The proposed improvements package incorporates a 14 year stage construction plan. Our experience has shown that stage construction methods, such as those proposed, are not effective. The base course becomes contaminated and loses its structural value in a very short period of time. In addition, the surface treatments are not adequate to support interim traffic loads prior to paving. We have tried these methods on Weld County Roads 16, 39, 41 and 100. None of these attempts at stage construction were successful . These roads experience relatively light traffic of less than 100 vehicles per day. Yet, the applicant has proposed pavement only after reaching 1750 vehicles per day. Even then, only 21/2 inches of pavement is proposed. In accordance with the Colorado Department of Highways' Design Manual , we anticipate lt the need for at least twice that pavement thickness to support the projected traffic volume. The proposed road improvements would be administered through a long-term ( 14-year) agreement between the County and the Homeowners ' Association. Our experience has shown that long-term commitments such as these are not effective, even with the best of initial intentions and well-conceived plans . The slightest problem, dis- content, lack of sales , change in financial abilities , or change in the desires of the residences becomes a difficult situation which always falls back into the County. Even if the County were willing devote over $869,000 to this project, we do not think that a 14-year commitment with the future property owners would be an effective way to pursue these improvments . we also feel that the cost of improvements would increase to over $4,000,000 over the years . We realize that the road improvements needed to properly serve this development are beyond the fiscal feasibilities of the project, but that is not the fault of Weld County. The problem is attempting to develop a parcel so far removed from existing services . The Weld County Zoning Ordinance is quite clear in that the applicant is required to show adequate existing access facilities . The site is not located to comply with this requirement, nor can it be made to comply without serious financial impacts on the developer as well as the Weld County Road and Bridge Budget. Primary objective of the following discussion is to define in preliminary terms some of the quantitative aspects of the proposed road maintenance and improvement program. To summarize the proposed program, the project developer, via the Property Owners Association, agrees to: 1. Maintain portions of the County Road network which are now in gravel until they are paved; and 2. Establish an account, funded by building permit related fees, to be dedicated towards paving these gravel roads at some point in the future. SCOPE OF ANALYSIS The traffic impact assessment concludes that virtually all development related traffic will move to/from U.S. 85 via WCR 32 (west and south) or WCR 39 and 44 (north) . At present, approximately 4 miles of WCR 32 is surfaced, east of Platteville; the remaining 2 miles from WCR 35 to WCR 39 is gravel . Approximately 2 miles of WCR 39 is surfaced between WCR 44 and 40; the remaining 4 miles to WCR 32 is gravel . WCR 38 is gravel . As noted, the developer plans to maintain approximately 18 miles of gravel road within the development , and will have a maintenance crew plus equipment (dump truck, front end loader, road grader, truck mounted tanks, and attachments -- plows, hoist, winch, etc. ) . Apart from the question of equity, it would be impractical for the developer to maintain 800 Eighth Avenue P.O. Hence the developer proposes to maintain the portions of WCR 32 and 39 now in gravel . Of the 13 miles of road in question the developer would maintain 7 miles; the County would retain maintenance responsibility for the remaining 6 miles. The imediate effect of this proposal is to remove some 7 miles of County road from County maintenance responsibility, permitting the reallocation of current County maintenance effort to other portions of the overall road system. County maintenance of the paved portions of WCR 32 and 39 would continue as required. Over time, as the gravel portions of MCR 32 and 39 are upgraded to surfaced condition, the County would take back maintenance responsibility. GRAVEL ROAD MAINTENANCE PROGRAM The maintenance program for gravel roads is proposed as follows: 1. Grading, shaping, ditch clean-out once a week per 150 ADT. 2. Application of waste oil or waste oil/diesel mix four times per year at a rate of 0.15 gal/sq. yd. or approximately 10,000 gal/mi . 3. Restoration of road base material at a rate of 6 inches per year per 750 ADT, for a 30 ft. width. 4. Spot repair of localized problem areas (culvert cleanout, more frequent grading at intersection approaches, excavation and replacement of soft spots, etc.) on an as-needed basis. The road grading, oil , and spot repair materials/equipment costs would be _1__ borne by the developer. Road base material would be made available to the developer -- he would furnish transportation from the County materials source area. The grading and shaping work would emphasize cutting out on side ditches and moving material into the roadway, so that over time the roadbed would be widened to a nominal 32-36 ft. between edges of shoulder. This will ultimately permit a 24 ft. treated surface road plus 4-6 ft. shoulders 4--— The combination of periodic gravel placement, oiling, spot repair and maintenance of crowned cross-section for drainage should work to develop z a stable and strong roadbase over the period of gravel road maintenance. " SURFACE IMPROVEMENT PROGRAM Eventually traffic volumes may increase to the point where the frequency of gravel road maintenance functions (grading, new base) becomes so great that it would be more economical to treat the roadway surface. We C Mr. Drew Scheltinga Page 3 September 28, 1984 propose that the initial level of upgrading be a 24 ft. wide double surface treatment, followed at periodic intervals by single surface treatments. This would be scheduled for shortly after placement of the last gravel fill lift on a particular section of road, so that a compacted, crowned base is in place. Criterion for initial double -'-- surface treatment. would be when traffic volume on the road section reached 750 ADT. Supplemental single treatments would be applied at three year intervals or 500 ADT increases (eg. at approximately 1250 ADT, 1750 ADT) . At the point when traffic volume reached 1750 ADT, and other conditions concerning the mix of traffic justified the action (eg. acceptable levels of heavy vehicles) the road would be overlayed with a 2-1/2 lift of HBP, 24 ft. in width. STAGED CONSTRUCTION CONSIDERATIONS The initial grading program, in addition to providing adequate level of service during relatively low traffic volume periods, accomplishes three important things. First, -it permits widening of the roadbed in increments to accommodate the ultimate section. Second, the gravel replacement and oiling activities permit development of a smooth profile and adequate crown for ride comfort and lateral drainage. Third, the combined effects of traffic loading and spot repair of soft spots will develop a strong, uniform, compacted base. The interim surface treatment is applied at a point when the road base is in good condition, but requires surface protection from drainage and wear to be preserved . Periodic surface treatment continues to preserve the base and bonds the asphalt to the base. During this period, profile and cross-section adjustments and spot repairs can continue. Paving the roadway occurs at a point when traffic volumes are sufficient to wear down the surface treated road. But by this point, the base will have been compacted, the profile and cross-section developed, and drainage accommodated. Thus the cost of paving is minimized -- place mat, paint center and edge lines. UNIT COSTS AND ALLOCATION The developer will obtain and operate the gravel road maintenance equipment in any case. Hence an operating cost factor equal to the County value of $50.00/hour is used. The level of effort will be considerably higher than County standards, on the order of 50 hours per mile per 150 ADT annually. In addition to the grader work, the oil dust control/base stabilization will be applied. Note that these reflect the maximum rate of build-out, which presents the most conservative estimate of costs. The more likely build-out pace will extend the program over a longer period, and reduce per-year costs. To summarize the overall road program: ° Costs of maintaining and upgrading the six miles of gravel road to ultimate paved status are $1,703,700. The allocation is: - County $869,500 or 51% - Developer $834,200 or 49% Approximate cost per mile to grade, sh-ape, fill and pave a comparable road at one time are approximately $235,000 per mile. Cost per mile of staged construction is approximately $284,100 or 20 percent greater. However, this cost is spread out over a 14 year period, so the time cost penalty for delaying construction is less than 1.5 percent per year. In other words, if current construction funds can be spent on projects with an effective rate of return greater than 1.5 percent it is economically preferable to defer construction to match growing traffic demand, rather Mr. Drew Scheltinga Page 5 September 28, 1984 than build now and have excess capacity. The maximum construction cost for the County in any single year would occur in 1989, in the amount of $186,200; average annual construction cost would be $62,200. The reports of special concern to us are the coal resource evaluation, percolation tests run by Empire Labs. Inc. , Soil Conservation Service letter and background geologic information. The geologic data provided with this application is very preliminary; therefore, our review is preliminary in nature. This area is underlain by Laramie Formation, surface deposits of windblown sand and water deposited sand and gravel . Milton Reservoir lies within an abandoned north-south trending channel of the South Platte River. The sand and silt material that covers most of the property is highly erodible, has fast percolation rates, and may have locally shallow groundwater levels perched on top of the Laramie shales. The channel deposits may be economic sand and gravel resources and the Larimie coal beds may be a potentially -economic coal resource. These conditions may adversely effect on-lot sewage disposal , foundation stability and future land use. Dn-lot septic systems are effected by percolation rates , depth to groundwater and depth to bedrock. Cultural features such as development density will also effect the suitability of individual leach fields. Three of the six percolation tests did not meet Colorado Health Department standards for standard on-lot septic systems. Test boring number 5 has a percolation' rate of 40 minutes/inch, however, this testAoutside of the area of platted lots. Fast percolation rates and relatively large number of lots increase the potential of groundwater polution from malfunctioning septic systems. We recommend that a central disposal system be designed for this development. A central system will provide a manageable, long-term sewage disposal without great risks to groundwater resources. The windblown sand and silt that blankets the site is subject to wind erosion. The addition of roads, paths and houses will increase impermiable surface area and alter drainage patterns on the site. Although the sands are very permiable, we recommend that a drainage study be completed for this project. The study should take an overall look at drainage trends and road and trail locations. Any minor drainages that will be blocked by roads or driveways may need culverts. Concentration of runoff from house clusters may need minor erosion control and roadside ditch design. We recommend that this study be completed prior to final plat. GEOLOGY STORY OF THE PAST...KEY TO THE FUTURE October 23,1984 WE-84-0013 Page two The windblown material on the site may be subject to consolidation when loaded or wetted. The Soil Conservation Service review indicates that locally shallow groundwater levels exist on the site. To adequately evaluate the site geologic conditions that will affect development, we recommend that a geotechnical report be completed for the development. This report should address the site geology and subsurface conditions that may affect foundation, utility and road design. We recommend that this report be completed, per Senate Bill 35 requirements, at the preliminary plat stage. Oil and gas resources, coal deposits and sand and gravel resources are found at and around the proposed development. The sketch plan shows careful accommoda- tion of the producing gas wells. The preliminary coal evaluation report has no data for the development site. While drill holes in the area show no extensive coal beds, an operating coal mine exists in the area. We recommend that the geologic and geotechnical report include one or two drill holes to identify any potential coal resources. The eolian sand that covers most of the site is of little economic significance. However, the ancient South Platte channel north-northwest of Milton Reservoir may contain an economic gravel deposit beneath the windblown sands. We recommend that this potential resource also be evaluated during the geologic investigation. We will be glad to complete our review of the proposed development when the geologic report has been submitted for our review. Please contact our office if you have any questions. I have used the proposed housing units multiplied by 3. 12 persons and condominiums occupancy rate of 2.58 per unit to arrived at total serviced population for the development. Using this formula and the 1.9 sworn officer staffing per 1,000 population reported as the national average for suburban counties, the following analysis can be made: Cumulative Officers 1986 - 188 persons 188 persons .36 1987 - 156 persons 343 .69 1988 - 182 persons 525 1.00 1989 - 182 persons 707 1.34 1990 - 182 persons 889 1.7 1997 - 151 persons 2,130 4.0 I used the hourly costs for 1985 of $17/hr and calculated total law enforcement cost during the 12 year buildout as follows: 1986 - $ 12,730. 1987 - 24,398. 1988 - 35,360. 1989 - 47,382. 1990 - 60,112. 1997 - 141,440. *Note - costs have not been adjusted for inflation for the period. Admittedly, this is an estimate based upon national law enforcement staffing patterns. However, the impact upon general fund costs appear to be understated even when conservatively evaluating law enforcement staff costs. It would appear that traditional methods of funding law enforcment services for such a develop- ment would be better served by a special law enforcement taxation district or contracted law enforcement beyond basic service levels.
