RESOLUTION
RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR WINTER
KNOLLS PLANNED UNIT DEVELOPMENT, S #510 - ROBERT AND JANET WINTER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 14, 2000, the Department of Planning Services staff did
approve a Site Specific Development Plan and Planned Unit Development Final Plan, S #510,
for four E (Estate) zoned lots for the Winter Knolls Planned Unit Development S #510, do
Robert and Janet Winter on the following described real estate, to-wit:
Lot A of Recorded Exemption #1694, being part of
the NW1/4 of Section 14, Township 6 North, Range
67 West of the 6th P.M., Weld County, Colorado
WHEREAS, on February 23, 2000, the Board of County Commissioner of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance) for the Winter Knolls Planned Unit Development,
S #510, between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Robert and Janet Winter, 33652 Weld County Road 21,
Windsor, Colorado 80550, with terms and conditions being as stated in said agreement, and
accepted Irrevocable Letter of Credit#J43121243826, in the amount of$47,200.00, drawn on
the Farm Credit Services of the Mountain Plains, PCA, P.O. Box 39, 2308 29th Street, Greeley,
Colorado 80632, and
WHEREAS, at the request of the applicant, staff from the Weld County Department of
Public Works has conducted a visual inspection and recommends release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Irrevocable Letter of Credit#J43121243826, in the amount of
$47,200.00, drawn on the Farm Credit Services of the Mountain Plains, PCA, P.O. Box 39,
2308 29th Street, Greeley, Colorado 80632, be, and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.

Private Road Maintenance
Request for Release of Collateral
At the request of the applicant, the Department of Planning Services performed a site
inspection on May 27, 2003. The proposed plant materials associated with the approved
Landscape Plan have been installed and all material appears healthy and unstressed.
The Department of Public Works, in their memorandum dated May 8, 2003 recommends the
release of collateral for the transportation portion of this development.
Given that all transportation and non-transportation items had been installed and completed to
the satisfaction of the Department of Public Works and the Department of Planning Services,
this office recommends that the Farmers Credit Service Irrevocable Letter of Credit number
J43121243826 in the amount of forty seven thousand two hundred even ($47,200.00) dollars
be released.

The Weld County Public Works Department recommends release of the transportation portion
of collateral identified in Exhibit "A" for Winter Knolls PUD. A Letter of Credit identified as
J43121243826 in the amount of $47,200 from the Farmers Credit Service is being held with an
automatic renewal.
All other non-transportation items should be verified by Planning Services prior to release.

Dear sir:
We hereby issue and establish our Irrevocable Letter of Credit,the amount of which is available by
beneficiary's draft or drafts drawn upon us,which shall be paid at sight,when accompanied by the
following document:
A written statement from Weld County Planning Department and signed by an authorized Weld County
employee certifying that he/she is a duly authorized official acting on behalf of Weld County,Colorado,
and that the amount of the accompanying sight draft is due and payable to Weld County pursuant to
applicable provisions of the Development Approval and that Robert and Janet Winter have neglected,
failed,or refused to pay such amount requested to do so by the County.
Each sight draft so drawn and presented shall be honored by us, if presented prior to the close of business
on the expiration date of this Letter of Credit. This Letter of Credit refers solely to the Development
Proposal between Robert and Janet Winter and Weld County. This letter of credit is automatically
extended without amendment,for additional one year periods from the current expiration or any future
expiration date unless 60 days prior to such current expiration date FARM CREDIT SERVICES OF THE
MOUNTAIN PLAINS notifies beneficiary in writing that the letter of credit will not be renewed.
The original signed Letter of Credit will be presented to the PCA by the Beneficiary along with any draft
presented pursuant to this Letter of Credit,and will be surrendered to the Bank with any draft which draws
the full amount,or the balance remaining available,under the Letter of Credit.
