HomeMy WebLinkAbout20031329.tiff RESOLUTION RE: APPROVE CHILD PROTECTION INTRA-GOVERNMENTAL AGREEMENT FOR SERVICES AND AUTHORIZE CHAIR TO SIGN -WELD COUNTY DIVISION OF HUMAN SERVICES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Child Protection Intra-Governmental Agreement for Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Weld County Division of Human Services, commencing June 1, 2003, and ending May 31, 2004, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the Child Protection Intra- Governmental Agreement for Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services, and Weld County Division of Human Services be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Jerk county Attorney Glenn Vaa 6 Date of signature: / 2003-1329 �6R c�2 t C� SS0030 Intra-Governmental Agreement No. 03-CORE-0005 CHILD PROTECTION INTRA-GOVERNMENTAL AGREEMENT FOR SERVICES BETWEEN THE WELD COUNTY DEPARTMENT OF SOCIAL SERVICES AND WELD COUNTY DEPARTMENT OF HUMAN SERVICES This Intra-Governmental Agreement,made and entered into the?a-6/day of May 2003,by and between the Weld County Department of Social Services,hereinafter referred to as"Social Services,"and Weld County Department of Human Services,hereinafter referred to as the"Human Services." WITNESSETH WHEREAS,the County of Weld, a political subdivision of the State of Colorado,by and through the Board of County Commissioners of the County of Weld, sits as the Board of County Commissioners for Human Services and,sitting as the Board of Social Services, for Social Services;and WHEREAS,the Colorado Department of Human Services has provided Core Services Colorado Family Preservation Act funds to Social Services for court-ordered parent visitation services, as identified by Social Services;and WHEREAS,the County of Weld will ensure that Social Services and Human Services abide by the same State rules and regulations governing Core Services Colorado Family Preservation Act Funds;and WHEREAS,the County of Weld governs Social Services and Human Services under the same Weld County management,administrative and code requirements; and WHEREAS,Human Services has part-time personnel who are qualified to assist Social Services in performing court-ordered visitation services;and WHEREAS, the Board of County Commissioners desires that Social Services and Human Services enter into an Infra-Governmental Agreement to provide court-ordered parent visitation services associated therewith. NOW THEREFORE,in consideration of the premises,the parties hereto covenant and agree as follows: 1. Term This Agreement shall become effective on June 1,2003,upon proper execution of this Agreement and shall expire May 31,2004. 2. Duties of Social Services A. Social Services agrees to reimburse to the Human Services, in consideration for the work and services performed by Human Services' part-time workers a rate of Eighteen Dollars and Ten Cents($18.10)per hour for services rendered under this Intra-Governmental Agreement. B. Social Services will determine the capacity of the program by how many specific part-time workers from Human Services will be available to provide the service. It is estimated that the total number of clients to be served by this program would be seven to ten families per month,or approximately 30 people per month per full-time equivalent worker. The capacity would increase proportionately with each additional full-time equivalent worker. Children who are in the custody of Social Services would be eligible for transportation. C. Social Services will conduct pre-screening of Human Services' part-time workers,who are referred by Human Services,prior to work performed under this Intra-Govemmental Agreement. This pre- screening will include criminal and related background checks, identification of proper driver's license,accessibility to a vehicle,and suitability for the work to be performed. D. Social Services will monitor Human Services' part-time workers to ensure that proper standards and job performance are met for Human Services' part-time workers who are acting as Case Aides including security,confidentiality,and other related areas as identified in Social Services'job 2O93 /3;`) Intra-Governmental Agreement No. 03-CORE-0005 description. E. Social Services will be responsible for matching the name and location of supervised visits to the hours submitted by Human Services. 3. Duties of Human Services A. Human Services will prepare and submit monthly time sheets and mileage logs for reimbursement rendered by Human Services' part-time workers under the Intra-Governmental Agreement. Human Services shall submit all itemized monthly billings to Social Services using proper invoices no later than the fifteenth(15)day of the month following the month the cost was incurred. B. Human Services will submit a list of Social Services clients seen on a monthly basis by Human Services' part-time workers. C. Human Services will release Human Services' part-time workers to attend any mandatory training deemed necessary by Social Services. D. Social Services may withhold any payment if the Human Services has failed to comply with the Financial Management Requirements,program objectives, Infra-Governmental Agreement terms, or reporting requirements. In the event of a forfeiture of reimbursement,the Human Services may appeal such circumstance to the Director of Social Services. The decision of the Director of Social Services shall be final. 4. Confidentiality Social Services and Human Services agree to comply with 19-1-120 C.R.S.,which requires that reports of child abuse and any identifying information in those reports are strictly confidential. 5. Compliance with Applicable Laws At all times during the performance of this Intra-Governmental Agreement, Social Services and Human Services shall strictly adhere to all applicable federal and state laws, orders,and all applicable standards, regulations, interpretations or guidelines issued pursuant thereto. This includes the protection of the confidentiality of all applicant/recipient records,papers,documents,tapes and any other materials that have been or may hereafter be established which relate to this Infra-Governmental Agreement. Social Services and Human Services acknowledges that the following laws are included: Title VI of the Civil Rights Act of 1964,42 U.S.C. Sections 2000d-1 et. seq. and its implementing regulation,45 C.F.R.Part 80 et. seq.; and Section 504 of the Rehabilitation Act of 1973,29 U.S.C. Section 794, and its implementing regulation,45 C.F.R.Part 84;and the Age Discrimination Act of 1975,42 U.S.C. Sections 6101 et. seq. and its implementation regulation,45 C.F.R.Part 91;and Title VII of the Civil Rights Act of 1964; and the Age Discrimination in Employment Act of 1967;and the Equal Pay Act of 1963;and the Education Amendments of 1972;and Immigration Reform and Control Act of 1986,P.L. 99-603; 42 C.F.R.Part 2 and all regulations applicable to these laws prohibiting discrimination because of race,color,national origin,and, sex, religion and handicap, including Acquired Immune Deficiency Syndrome(AIDS)or AIDS related conditions,covered under Section 504 of the Rehabilitation Act of 1973,as amended,cited above. Included if 45 C.F.R.Part 74 Appendix G 9,which requires that affirmative steps be taken to assure that small and minority businesses are utilized,when possible,as sources of supplies, equipment,construction and services. This assurance is given in consideration of and for the purpose of obtaining any and all federal and/or state financial assistance. Intra-Governmental Agreement No.03-CORE-0005 Any person who feels that s/he has been discriminated against has the right to file a complaint either with the Colorado Department of Human Services or with the U.S.Department of Health and Human Services, Office for Civil Rights. 6. Monitoring and Evaluation The Human Services and Social Services agree that monitoring and evaluation of the performance of this Agreement shall be conducted by the Board of County Commissioners. 7. Modification of Agreement All modifications to this agreement shall be in writing and signed by both parties. 8. Entire Agreement This Agreement,together with all attachments hereto,constitutes the entire understanding between the parties with respect to the subject matter hereof, and may not be changed or modified except as stated in Paragraph 10 herein. Griego, Director, Social Services u+� t l l kAu L'v RE: Intra-Governmental Child Protection Agreement for Services Between Weld County Department of Social Services and Weld County Division of Human Services Enclosed for Board approval is an Intra-Governmental Child Protection Agreement for Services between the Weld County Department of Social Services (Department) and the Weld County Division of Human Services (Human Services). The Agreement was discussed and reviewed at the Board's Work Session of May 12, 2003. The major provisions of the Agreement are as follows: 1. The term of the Agreement is June 1, 2003 through May 31, 2004. 2. The source of funding is Core Services Funding. The Department will reimburse Human Services' part-time workers a rate of$18.10 per hour plus mileage. 3. Human Services will provide qualified part-time workers to assist the Department in performing court-ordered visitation services.
