NOTICE OF HEARING ON PETITION
PUBLIC NOTICE IS HEREBY GIVEN that there was filed in the District Court
in and for Weld County, Colorado, on the 23`d day of September, 2003, a Petition entitled
"IN RE KOHLER FARMS METROPOLITAN DISTRICT, TOWN OF KERSEY,
WELD COUNTY, COLORADO" which Petition prays for the organization of a special
district, pursuant to the provisions of Part 3 of Article 1 of Title 32, Colorado Revised
Statutes. Notice is further given that a Resolution of Approval of the Town of Kersey,
County of Weld, Colorado, approving the Service Plan was also filed with the Court in
this matter as required by law. Said document is now on file at the office of the Clerk of
the District Court of Weld County, in Greeley, Colorado, and is available for public
inspection.
The purposes of the proposed District are as follows:
a) Water
b) Streets
c) Traffic and Safety Controls
d) Parks and Recreation
e) Sanitation
The proposed Kohler Farms Metropolitan District is generally located on
Campbell Drive and Weld County Road 55. The site will initially consist of

approximately 146.25 acres divided into three (3) development areas planned for
development of single family and multi family residential and commercial areas all
within the boundaries of the Town of Kersey.
NOTICE IS FURTHER GIVEN that at any time after the filing of the petition for
the organization of the proposed district in the District Court for Weld County, but no
later than ten (10) days before the hearing on the petition, in accordance with the
provisions of Section 32-1-305(3), C.R.S., the owner of any real property within the
proposed district may file a petition with the District Court stating the reasons why said
property should not be included therein and requesting that said real property be excluded
therefrom. Such petition shall be duly verified and shall describe the property sought to
be excluded. The District Court shall hear said petition for organization and shall
determine whether, in the best public interest, said property should be excluded or
included in the proposed special district.
NOTICE IS FURTHER GIVEN that by an Order of the District Court in and for
Weld County, a Public Hearing on said Petition will be held at the hour of 10:30 a.m. on
the 29th day of October, 2003, at the District Court in Weld County, Greeley, Colorado,
in Division 1, at 901 9TH Avenue, 4th Floor, Greeley, Colorado 80631 at which time and
place any parties or persons in interest may appear if they so desire, within the limitations
provided by law.

ORDER FOR HEARING -
It appearing to the Court that a Petition in the above entitled matter was filed with the
Court on the 23rd day of September, 2003, which Petition appears to be in proper form and to be
signed by not less than 30 percent of the taxpaying electors of the proposed District, in
accordance with Part 3 of Article 1 of Title 32, C.R.S.; and
It further appearing that a Bond was duly filed, with security approved by this Court,
sufficient to pay all expenses connected with the proceedings in the event the organization of the
District is not effected; and
It further appearing to the Court that a Service Plan for the proposed District and a
Resolution of the Kersey Town Council of Weld County, Colorado, approving the Service Plan
have also been filed, as required by the applicable provisions of Title 32, C.R.S.;
THE COURT THEREFORE FINDS AND ORDERS THE FOLLOWING:
1. That a Hearing on said Petition be held and the same is hereby set for the hour of
10:30 a.m. on the 29th day of October, 2003, in District Courtroom 1, at the Weld County
District Court, 901 9th Avenue, 4`h Floor, Greeley, Colorado 80631, in Weld County, Colorado.
2. That pursuant to Section 32-1-304, C.R.S., this Court is hereby ordering Petitioner
to cause Notice of such Hearing to be published one time in The Voice, a newspaper of general
circulation in the proposed District, pursuant to the publication requirements set forth is Section
32-1-103(15), C.R.S., and that the Clerk of this Court forthwith shall cause copies of said Notice
to be mailed by United States registered mail to the Kersey Town Council and the Board of
County Commissioners, Weld County, Colorado, and to each party entitled to notice pursuant to
Section 32-1-206(2), C.R.S. Said Notice shall include a general description of the land contained
within the boundaries of the proposed District and information explaining methods and
procedures for the filing of a petition for exclusion of territory pursuant to Section 32-1-305(3),
C.R.S.
3. That the Clerk of the District Court, pursuant to Section 39-1-110 (1), C.R.S.,
cause a copy of such notice to be mailed, by first class mail to the Assessor of Weld County,
Colorado; and the Division of Local Government in the Colorado Department of Local Affairs.
