HomeMy WebLinkAbout20033487.tiff RESOLUTION RE: GRANT REQUEST FROM CORNISH PLAINS LIVESTOCK, LLLP, C/O CLAIR ORR TO PREADVERTISE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT #227 WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has received a request from Cornish Plains Livestock,LLLP,do Clair Orr, 800 8th Avenue, Suite 321, Greeley, Colorado 80631,for preadvertisement of an application for a Site Specific Development Plan and Amended Use by Special Review Permit#227 fora Cattle and Sheep Feeding Operation, and WHEREAS,said property is described as N1/2 of the N1/2 of Section 4,Township 6 North, Range 63 West of the 6th P.M., Weld County, Colorado, and WHEREAS,after study and review the Board deems it advisable to grant said request,with the hearing date to be set as February 11, 2004, at 10:00 a.m. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request from Cornish Plains Livestock, LLLP, do Clair Orr for preadvertisement of an application for a Site Specific Development Plan and Amended Use by Special Review Permit #227 for Cattle and Sheep Feeding Operation be, and hereby is, granted. Gesick, Deputy Clerk to the Board COLORADO SUBJECT: Request for Pre-advertisement Cornish Plains Livestock, LLLP, do Clair Orr, has submitted a request that the application for Amended Use by Special Review Permit#227,which will be heard by the Planning Commission on February 3, 2004, be pre-advertised. COLORADO DATE: December 9, 2003 • FROM: Michelle Katyryniuk SUBJECT: AmUSR-227 The applicants of Cornish Plains Livestock are requesting a Pre-Advertisement for AmUSR- 227. The applicants have indicated that the reason for this request is primarily financial. According to memo dated November 21, 2003 the party who wants to purchase the property is locked into an interest rate and therefore time is of the essence. The Department of Planning Services understands the concerns of the applicants but does not feel this is adequate justification. Therefore the Department of Planning Services is recommending denial of the Pre-Advertisement for AmUSR-227. Sincerely, iCz , Michelle Katyryniuk rLe-,76 9 2003-3487 • RE: Request for Pre Advertisement for Cornish Plains USR On behalf of Cornish Plains Livestock I would like to request a pre advertisement for the hearing before the Weld County Commissioners for the following reasons: 1. This feedlot has been in existence for over thirty years and there will be no substantial change to the size of the current operation. The primary change will be changing the acres from a previous SUP of 160 acres to 80 acres in the USR as applied for. Since there will be no noticeable change to the present operation we are not anticipating any opposition at the USR hearings. 2. This property is currently leased to the party who wants to purchase the property pending the approval of a USR. They have locked in a interest rate with their lender; so time is of the essence so they are not unduly forced to pay additional fees for an extension with the possibility of having to pay a higher interest rate should interest rates increase 3. The Seller has some financial obligations they have to meet and it is very important for them to know the future of this transaction in the timeliest matter possible.
