1-9-1 RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR PLANNED UNIT
DEVELOPMENT FINAL PLAN, PF #1007, THE SHIRE PUD, AND ACCEPT STREETS
FOR PARTIAL MAINTENANCE - LANCE AND JULEE MEINERS
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,on May 14,2003,the Board of County Commissioners approved a Change of
Zone, PZ#1007 from A (Agricultural) Zone District to a PUD (Planned Unit Development) Zone
District,for five(5)lots with E(Estate)Zone uses and one(1)non-residential lot with A(Agricultural)
Zone uses, and
WHEREAS,on August 21,2003,the Department of Planning Services staff administratively
reviewed and approved the Site Specific Development and Planned Unit Development Final Plan,
PF#1007,for Lance and Julee Meiners,713 Sitka Street,Fort Collins,Colorado 80524,for five(5)
lots with E(Estate)Zone uses and one(1)non-residential lot with A(Agricultural)Zone uses on the
following described real estate, to-wit:
Lot C of Recorded Exemption #3092; being further
described as part of the NE1/4/4 NW 1/4 of Section 33,
Township 9 North,Range 67 West of 6th P.M.,Weld
County, Colorado
WHEREAS,on September 17,2003,the Board of County Commissioner of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements(Public Road Maintenance)for The Shire Planned Unit Development,between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County,and Lance and Julee Meiners with terms and conditions being as stated in said agreement,
and accepted a Development Loan,in the amount of$237,750.00,drawn on the Centennial Bank
of the West, 4650 Royal Vista Circle, Fort Collins, Colorado 80528-9370, and
WHEREAS,staff from the Weld County Department of Public Works has conducted a visual
inspection of the Shire Planned Unit Development and determined that Shire Road has been built
to County standards and is recommended for acceptance by Weld County for partial maintenance,
and
WHEREAS, acceptance of said Shire Road for partial maintenance may include snow
removal but shall exclude any repairs to the street,including the roadway,shoulders, or drainage
ditches, and
WHEREAS, the Board deems it appropriate to accept said Shire Road for partial
maintenance, and
WHEREAS, Connell Resources, the paving contractor, has provided a letter, dated
September 30, 2003, to warrant their workmanship for a period of one year from the date of
completion, which shall remain in full force until October 10, 2004.

CANCEL COLLATERAL AND ACCEPT ROAD FOR PARTIAL MAINTENANCE - LANCE AND
JULEE MEINERS (PF #1007)

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the claim to the proceeds from the Development Loan, in the amount of
$237,750.00,drawn on the Centennial Bank of the West,be,and hereby is,canceled and released.
BE IT FURTHER RESOLVED by the Board that the letter of warranty,dated September 30,
2003,from Connell Resources,be,and hereby is,accepted as collateral,to warrant workmanship,
until October 10, 2004.
BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County,
Colorado,that Shire Road in The Shire Planned Unit Development,be,and hereby is,accepted for
partial maintenance.
BE IT FURTHER RESOLVED by the Board that no sooner than nine months after
acceptance for partial maintenance of said streets,the Weld County Department of Public Works
shall, upon request by the developer, inspect the subject streets and notify the developer of any
deficiencies. The Department of Public Works shall reinspect the streets after notification from the
developer that any deficiencies have been corrected. If the Department of Public Works finds that
the streets are constructed according to County standards, staff shall recommend acceptance of
said streets for full maintenance. Upon receipt of a positive, qualified recommendation from the
Department of Public Works for acceptance of said streets, the Board of County Commissioners
shall accept said streets as public facilities and County property, and shall be responsible for the
full maintenance of said streets, including repairs.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 3rd day of November, A.D., 2003.

The Weld County Departments of Public Works and Planning Services are requesting the
release of collateral for PF-1007, The Shire Planned Unit Development. Site inspections have
assured both Departments that all items listed in the improvements agreement have been
completed to our satisfaction.
Items covered under the Improvements Agreement According to Policy Regarding Collateral for
Improvements (Public Road Maintenance) include:
Site grading $ 6,945.
Street grading $ 14,488.
Street base $ 5,720.
Street paving $ 35,937.
Storm sewer facilities $ 2,767.
Street name signs/stop sign $ 350.
Landscaping $ 400.
Grass lined swale/Erosion Control $ 3,000.
Electric $ 4,000.
Engineering and supervision $ 2,200.
Total Estimated Cost of Improvements and Supervision $ 75,807.
Loan amount $237,750.

Acceptance of Partial Maintenance
COLORADO
At the request of the applicant, I performed a final inspection for the project to be accepted for
partial maintenance.
All transportation items are in place except for the street name signs and stop sign installed by
Carnes Services. The signs are required to be in place no later than Friday, October 17, 2003.
Connel Resources was the paving contractor and has provided a letter to warranty their
workmanship for a period of one year from the date of substantial completion of the project.
This warranty shall remain in full force until October 10, 2004.
The Weld County Public Works Department recommends release of collateral as we are holding
a guarantee/warranty from Connel Resources which guarantees the paving section until
October 10, 2004.

Don,
Please accept this letter as our request for Weld County to perform a final inspection for
the above project. Attached is the Warranty Letter from Connell Resources regarding
their guarantee for materials and services provided on this project.
Attached is the Warranty Letter provided to us by Connell Resources. The road is
guaranteed for one year from September 30, 2003 and the Improvements Agreement has
been approved and signed by the county.
We are currently working with Carnes Service for preparing and placing the required
stop and street name sign. 1 am estimating a completion date of no later than Friday,
October 17, 2003.
