WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Engineer has presented to the Board of County Commissioners, a Public Utilities Commission application for authority to install automated signals at the Union Pacific Railroad crossing and County Road 44, 'which is located at Peckham, Colorado, and WHEREAS, the estimated total expenditure for the project, including both Federal and Contract funds, is $105,000. 00, and WHEREAS, this application is filed under the funding source of Section 203 (c) of the Federal "Highway Safety Act of 1973 and 1976" . ` The County of Weld has- been notified that funds have been budgeted and appropriated; the costs of said project to be borne by the Federal Highway Administration at the rate of 90% and 10% percent by Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Public Utilities Commission application for automated signals at the railroad crossing on County Road 44, at Peckham, Colorado, be, and hereby is, approved. CROSSING OF THE UNION PACIFIC ) RAILROAD COMPANY AND ) COUNTY ROAD 44 , IN THE ) COUNTY OF WELD, STATE OF ) COLORADO. ) The Board of County Commissioners of the County of Weld, a Political Subdivision of the State of' Colorado, hereby applies -to the Public Utilities Commission for authority to install signals at the crossing of the Union Pacific Railroad Company ("UP ') and County Road 44 , which is located at Peckham, Colorado, located in Weld County, Colorado, and in support of this application states as follows: 1. "UP" has one (1) track crossing County Road 44 adjacent of U. S. Highway 85. There currently exists Crossbucks and stop signs at that crossing. The desire is to change the present system to automatic flashing light signals with short arm gates in accordance with plans to be prepared by the "UP" . 2. Said improvements are necessary and proper at this crossing for the service, accomodation, convenience, and safety of the motoring public. County Road 44 is a major collector with an average daily trafic count of 325 vehicles per day. It serves homes, farms, business, and is used heavily by school busses .and emergency vehicles. There is a grain elevator and • siding track immediately south of the crossing that restricts • visibility of east-bound vehicles. 3. The "UP" is agreeable to signal installation at this crossing. tete-7 203447c< c 4 . The proposed signal installation will be constructed and installed in accordance with this Commission' s specifications as well as the specifications of the Association of American Railroads . 5. The estimated total expenditure, including both Federal and Contract funds is $105,000. 00 . 6 . The names and addresses of the adjacent property owners are shown on Exhibit "A" . 7. This application is filed under the funding source of Section 203 (c) of the Federal "Highway Safety Acts of 1973 and 1976" . The County of Weld has been notified that funds have been budgeted, appropriated and otherwise made available. The • County of- Weld has appropriated funds to pay the required ten percent (10%) local match. The costs of the project will be borne by. the Federal 'Highway Administration and by the County of Weld at the rate of ninety percent (90%) and ten percent (10%) re- spectively, up to the allocated Federal Highway Administration' s share, all without cost the the State of Colorado. S . Exhibit B provides a map of suitable scale showing the location of all tracks, buildings, structures, and property lines, streets, and roads in the vicinity of the. crossing.
