Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. All septic systems must be located on their respective lots and meet all lot line and setback
requirements.
3. The Applicant has proposed well(s) as the source of adequate water. Property owners are advised
that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic Use
Only," etc. Because each situation is unique, the Department of Planning Services encourages
property owners to contact the Office of the State Engineer, Division of Water Resources (1313
Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each
individual situation.
4. Topographic or physical features of the proposed lot,such as ravines,ditches,streams etc. may limit
the area available for a new or replacement septic system. Prior to recording the plat the Weld
County Department of Public Health and Environment recommends that the applicant review the
Weld County Code pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size
to allow the installation of a septic system the lot may need to be enlarged.
5. Prior to recording the plat:
/e The applicant shall submit a proposed building envelope(s) for Lot B to the Department of
Planning Services for review. Upon approval by the Department of Planning Services, the
building envelope shall be delineated on the plat. Additional building envelopes shall be
labeled alternative building envelope. All building envelopes shall take into consideration
impacts to productive farm ground as well as the location of incompatible uses, flood plain,
ditches,wetlands,geological hazards,accesses,preferable locations,oil/gas easements and
oil/gas structures which must meet setbacks as required by Section 23-6-10 of the Weld
County Code.
The plat shall be titled: Recorded Exemption No. 0707-24-1 RE-3562
The proposed Lot A currently does not meet current Weld County Health Department policy.
The applicant shall be in compliance with Section 24-8-40.L of the Weld County Code that
states "...the minimum size of any lot proposed with a well as a water supply is not less than
two and one-half(2 1/2) acres net."
Si' Lot A shall use the existing residential access point as no additional accesses shall be granted.
The residential access to Lot B shall be placed in such a location to have adequate sight
distance in both directions and not below the crest of a hill or where physical obstructions are
present and shall be a minimum distance of 75 feet between access points to adjacent parcels.
Lot B shall use the existing agricultural / oil and gas/ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.
^ ' All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
dilel County Road 37 is designated on the Road Capital Improvement Plan in the County Wide
Impact Fee Code Ordinance, Section 20-1-30, as a collector status road, which requires an
80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. A total of forty
feet from the centerline of County Road 37 shall be delineated right-of-way reservation for the
future expansion of County Road 37on the plat. This road is maintained by Weld County.
Weld County Road 80 is designated on the Road Capital Improvement Plan in the County
Wide Impact Fee Code Ordinance, Section 20-1-30, as a local gravel road, which requires a
60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. A total of thirty
feet from the centerline of County Road 80 shall be delineated right-of-way on the plat. This
road is maintained by Weld County.
sr The applicant shall address the requirements of Weld County School District RE-9 as stated in
the referral response received April 17,2003. Evidence of such shall be submitted in writing to
the Weld County Department of Planning Services.
etre All vehicles located on the property must be operational with current license plates, or be
screened from all adjacent properties and public rights of way,or be removed from the property.
All other items considered to be part of a noncommercial junkyard must also be removed from
the property or screened from adjacent properties and public rights-of-way.
The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
L. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed
within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead.
Any construction within a 200-foot radius of any tank battery or 150-foot radius of any
wellhead shall require a variance from the terms of the Section 23-3-50 of the Weld
County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
perm its.
3) All structures requiring building permits shall be located within the designated building
envelope.
4) Future development on the property may necessitate a larger parcel than what is
displayed on the plat in order to utilize a septic system. In addition,a larger parcel would
provide additional dilution and attenuation of sewage wastes which may be beneficial to
the environment.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
7) Potential purchasers should be aware that groundwater may not meet all drinking water
standards as defined by the Colorado Department of Public Health and Environment.
The Weld County Department of Public Health and Environment strongly encourages
well users to test their drinking water prior to consumption and periodically there after.
8) Potential purchasers should be aware that approval of this Recorded Exemption does
not guarantee that well permits will be issued for the lots. Any lot may be deemed non-
buildable if the lot owner is unable to obtain a well permit. The State Division of Water
Resources issues all well permits.
9) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the Uniform Fire Code.
10) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
11) The approved configuration of LotA does not constitute justification for further land splits.
12) SE-978 was approved in conjunction with this Recorded Exemption for the purpose of
dividing off a second set of existing improvements from the parcel.
13) Effective January 1,2003,Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program.(Ordinance 2002-11)
14) Potential Purchasers are hereby notified that there are several confined animal feeding
operations located within one mile of this property. Off-site impacts that may be
encountered include noise from trucks,tractors and equipment;dust from animal pens
and odors from animal confinement, silage, and manure.
15) WELD COUNTY'S RIGHT TO FARM Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of
agricultural products sold. The rural areas of Weld County may be open and spacious,
but they are intensively used for agriculture. Persons moving into a rural area must
recognize and accept there are drawbacks, including conflicts with longstanding
agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural area:
open views, spaciousness, wildlife, lack of city noise and congestion, and the rural
atmosphere and way of life. Without neighboring farms, those features which attract
urban dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from
tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal
pens,field work, harvest, and gravel roads; odor from animal confinement, silage,and
manure;smoke from ditch burning;flies and mosquitoes;and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs
cannot simply be moved out of the way of residential development without threatening
the efficient delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not
provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after
a major snowstorm. Snow removal for roads within subdivisions are of the lowest
priority for public works or may be the private responsibility of the homeowners.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment,ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of
the farmer's livelihood. Parents are responsible for their children.
6. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty (60)days
from the date the Administrative Review was signed. The applicant shall be responsible for paying
the recording fee.
7. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles,Arclnfo Coverages and Arclnfo Export files format type is.e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to mapsco.weld.co.us.
8. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application
is based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to
meet any one of these conditions within 60 days of approval, then this case will be forwarded to the
Weld County Board of County Commissioners with a staff recommendation for denial.

The Department of Planning Services' has reviewed your application and related materials for
compliancy with the Weld County Code. We find that your proposed Recorded Exemption meets the
intent of the Code and it has been conditionally approved by staff. We have enclosed our comments for
your case.
If applicable, please address all issues identified in the staff comments. Prior to submitting the Mylar,
please submit two (2) paper copies of your plat for review by the Department of Planning Services' staff.
Upon approval of the paper copies please submit a Mylar plat along with all other documentation required
as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and
Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the
requirements of Section 24-8-70 of the Weld County Code. The Mylar plat and additional requirements

1. Water Supply Statements Addressing:
(a). Farmland has no need for domestic water use. For Irrigation on the farmland
there is a well that provides approximately one right of water together with two
(2) shares of the capital stock of The Larimer and Weld Irrigation Company, and
eight (8) shares of the capital stock of The Larimer and Weld Reservoir Company,
together with appurtenances thereto.
(b). The residence that is included in the Recorded Exemption has access to a
well. Previously this same well provided for two households, a 50 head feed lot, a
milk barn, and other yard buildings. Now that same well will provide water for
one household with its approximate two acres. For irrigation tail water from the
farm can be used to irrigate garden and other large shrubbery and returned to the
farm as tail water.
(c). The residence that is included in the Subdivision Exemption has access to
North Weld Water and a letter is enclosed stating sufficient water is available.
2. Septic Systems
(a). The residence that is in the Recorded Exemption will be serviced by the
present septic system. The present septic system serviced two households without
failure, and should be sufficient for just one.
(b). The residence in the Subdivision Exemption will have a new septic system
installed west of the house. This new septic system will be built according to county
standards.
3. Property Usage
(a). The property is currently being used as a farm and is zoned agricultural. The
farm total acreage is approximately 95 acres. After the Recorded Exemption and
Subdivision Exemption are completed the farmland should be left with
approximately 92 acres. The main house with approximately 2 acres and the final
house with approximately 1 acres.
(b). As for livestock there is currently none on the property, nor has there been for
several years.
(c). The current structures existing on the property are the principal residence,
secondary residence, four stall garage, grain shed, chicken coop and a storage
building.
(d). The irrigation ditches that exist on the property are all earth ditches and are
used to provide water for row crops.
(e). There are no oil well production facilities on the property.
4. Reason for proposed Recorded Exemption
(a). The reasoning for the Recorded Exemption and Subdivision Exemption is
there is no further advantage to keeping the property as a whole. With the
property existing in an estate, it would best be settled in this manner.
(b). The Recorded Exemption would split off the farmland for agricultural and the
main house. The main house (which is approximately 2000 sq. ft.) would include
with it the four car garage and large shed as well on approximately two acres. The
Subdivision Exemption will include the secondary house(which is approximately
950 sq. ft.) is on approximately one acres.
5. Description of location
(a). The property is located approximately. 1 mile north of Eaton with the front of
the property beginning at WCR 37 and the base of the ending at HWY 85. The
whole parcel is approximately a total of 95 acres. The present use of the property
is a farm.

(a). Survey was completed to include county setback requirements.

(a). There will not need to be a conservation easement.

11. Compatibility with Surrounding Property
(a). The Recorded Exemption and Subdivision Exemption will be compatible with
the surrounding property as the surrounding property is also farmland and homes.

13. Proposal Consistency
(a). The proposal is consistent with the efficient and orderly development of the
Weld County Code in the following:
- It is not taking away or harming the health or safety of weld county residents.
-We see it ensuring the improvement of the county as this property as not been
split or subdivided since sometime in the 1940's.
- It would help someone to take on smaller pieces of the property and improve
them in a more efficient and condensed manner.
- The interest of the owner and subdivider are one in the same. As for the interest
of the public, there are no foreseen reasons as to why this would be a
disadvantage.
-We are preserving the agricultural land as it will be kept as farmland without
homes to care for as well. The irrigation water will be split off with the
agricultural land, and will be meant to stay with the land.
- The natural vegetation will either be replaced with new and young vegetation or
cleaned up to be in its best condition.
- As there will be no drastic changes to the water, there should be no more
erosion, sedimentation or other problems caused that are not of a natural nature.
- The land will be farmed, and the yards of the home kept up to help hold the land
steady and not cause drastic flooding or erosion.
- In order to prevent any building in a flood hazard area, all building shall be sent
through the proper channels to have permits pulled to clarify that building is not
completed in a flood plain.
- As the land is not in an area that is elevated or sloped there should be no issues
with mudslides or land slides.
- There should be no need at this time for any future schools or parks as the
property is located in a county subdivision.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
WCR 37 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code
Ordinance, Section 20-1-30, as a collector status road, which requires an 80-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is
measured from the future right-of-way line.
WCR 80 is designated on the Road Capital Improvement Plan in the County Wide Impact Fee Code

There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition

REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
The residential access shall be placed in such a location to have adequate sight distance in both directions and
not below the crest of a hill or where physical obstructions are present. (Lot B, 94-acre parcel) •
If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If
the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size
your culvert. (Lot B)
There shall be a minimum of 75 feet between access points to adjacent parcels.
The applicant shall utilize the existing residential access to this parcel, and no additional accesses shall be
granted. (Lot A, 2-acre parcel)
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
(Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
2. All septic systems must be located on their respective lots and meet all lot line
set back requirements.
Additionally, please note the following:
1) This application is proposing a well(s) as its source of water. The applicant
should be made aware that while they may be able to obtain a well permit from
the Office of the State Engineer, Division of Water Resources, the quantity of
water available for usage may be limited to specific uses, i.e. domestic use only,
etc. Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
2) The proposed acreage for lot A currently does not meet current Weld County
Health Department policy. We would encourage the applicant to increase the
acreage for lot A to 2.5 acres. However, in the event the applicant cannot or
chooses not to increase the lot size, please place the following note onto the plat.
Future development may necessitate a larger(lot A, lot 8, or SE lot) than what is
displayed on the plat. In addition, a larger(lot A, lot 8, or SE lot) would provide
additional dilution and attenuation of sewage wastes which may beneficial to the
environment.
3) Topographic or physical features of the proposed lot, such as ravines, ditches,

system. Prior to Qrding the plat the Division recomrQis that the applicant
review the County Code pertaining to Septic Systems to assure that any installed

Weld RE-9 School District with district offices located in Ault Colorado
has adopted a methodology to determine the in-lieu payment for
residential dwelling units sufficient to provide adequate educational
opportunities to new residential developments. The School District
Methodology has been developed in a manner so as to fairly
apportion the cost of acquiring school sites made necessary by
residential development.
The total in-lieu payment per dwelling unit is $759. Payment should
be hand delivered or mailed to Weld RE-9 School District, Box 68,
Ault, Colorado 80610. A receipt will be mailed to the party
requesting the exemption and a copy to Weld County Officials.

This letter is in response to your inquiry regarding water service to the following described property,
Approximately 38505 &38519 WCR 37, in a portion of the
NE ''A of Section 25,T7N,R66W of the 6'"Prime Meridian
1. Water Service is presently being provided to the above mentioned property.
2.North Weld County Water District is able and intends to provide water services to the above mentioned property,
provided all requirements of the District are satisfied. If contracts have not been completed with North Weld County
Water District within one year from the date of this letter, the District may refuse to supply water to the above-
mentioned property. After one year, the District reserves the right to refuse service, in the event that raw water is
unavailable, and/or pipeline or Filter Plant capacity is not capable to provide additional service. Before a water tap
may be purchased, the applicant must provide a copy of a Warranty Deed, a Physical Address and this letter.
Water tap/service shall be placed on the physical property, defined by a legal description. In case of a Recorded
Exemption,the water tap shall only serve the parcel that the water tap is located on. Service shall NOT cross the legal
description of one parcel to serve the other parcel,unless an easement has been recorded for the water service and has
been approved by the District.
The District recommends that anticipated raw water be purchased through the District. The District guarantees
treatment and delivery of water purchased. All water that is delivered with surcharge is subject to water
availability. Water purchased through the District shall be 70%delivery of an Acre-Foot of water(228,000 gallons),if
the allotment for Colorado-Big Thompson(CBT)project water,which is determined by the Northern Colorado Water
Conservancy District,is 50%or greater. North Weld County Water District will restrict the delivery as necessary when
the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage
reservoirs.
North Weld County Water District does offer a Residence Only "RO" (For Inside Use Only)water tap. With this
option the customer purchases only'A of the Raw Water Unit. Therefore the District will deliver 35%of an Acre-Foot
of water(114,000 gallons),if the allotment for Colorado-Big Thompson(CBT)project water,which is determined by
the Northern Colorado Water Conservancy District,is 50%or greater. North Weld County Water District will restrict
the delivery as necessary when the CBT allotment is less than 50%. With purchasing a RO tap,the customer is charged
a different water surcharge rate than a normal customer. Refer to the following page for current rates.
The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU(228,000 gallons). If usage exceeds
the number of Plant Investments that were purchased, an additional Conservation Charge will be applied to your
account. Plant Investments maybe purchased to increase the amount of water to be delivered and avoid the
Conservation Charge.

On March 28,2003 an evaluation of the existing individual septic disposal system at 38505 & 38519 CR
37, Eaton; Section 24,Township 07 North, Range 66 West, was conducted by Steve Wiatrowski, an
Environmental Specialist of this department.
The existing individual septic disposal system is not of sufficient size and capacity to adequately handle
the proposed load, This evaluation is based on a final treatment capacity for 2 homes totaling 7
bedrooms.
There is not enough information provided to determine if the septic tank is adequate. According to the
Weld County Health Department of Planning Services, each house will be on a separate lot.
However, based on documentation provided for this inspection, the two homes share a common septic
tank and leachfield. This department requires that, prior to the finalization of the Recorded
Exemption/Subdivision Exemption, each home on each parcel be served by a separate septic system.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property, to any purchaser of the above property or to any lending
agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and
for detecting health hazards observable at the time of inspection. This does not constitute a warranty that
the system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.) relies on information the
property owner provides, under oath, indicating current status of the system and representing to the best
of his/her knowledge the system is not failing to function properly.

In response to the letter received from the county regarding the septic system for
the properties of 38505 WCR 37 & 38519 WCR 37 Eaton, CO 80615 the properties will
be utilized and treated as follows.
The larger home located at 38505 WCR 37, which has five bedrooms, does have
the well disconnected and the kitchen will be torn out of the home. Therefore a septic
