RE: APPROVAL OF RECORDED EXEMPTION NO. 561 - CARROLL DON GODBY
AND IVAN G. COLLINS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 561, being the property of Carroll
Don Godby and Ivan G. Collins, described as part of the NW4,
Section 31, T8N, R65W of the 6th P.M. , Weld County, Colorado,
being more particularly described in the plat which shall be
provided by the applicant and known as Exhibit "A" , said plat to
be recorded, does not come within the purview of the definition
of the terms, "subdivision" and "subdivided land" , pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Carroll Don Godby and Ivan G. Collins be,
and hereby is, exempt from the definition of the terms , "subdivi-
sion" and "subdivided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
July, A.D. , 1982.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Carrol Don Godby and Ivan G. Collins for a recorded exemp-
tion. The parcel of land on which this request is being made is described
as the NWo, Section 31, T8N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located 2.5 miles east of the town of Pierce on Weld
County Road 37. The property contains approximately 160 acres of Class
II, IV, and VI irriaged and IV and VI nonirrigated soils.
The request is to divide the property into parcels of 145 acres and 15
acres, more or less. The applicant no longer utilizes the improvements
on the property and would like to sell the improvements and a fifteen (15)
acre parcel that contains them. The applicant will continue farming the
propesed 145 acre parcel.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld County
Subdivision Regulations submission requirements.
2. The request complies with Section 9-2 E. of the. Subdivision
Regulations as follows:
The 160 acres, more or less, under consideration will
allow agriculture and related uses to be the predominant
uses. The uses will be compatible with existing surrounding
agricultural uses. These facts support the proposal as
being consistent with the intent clause of the agricul-
tural zone district.

- The proposal was reviewed by the city of town of Pierce
and was found to comply with their longrange Comprehensive
Plan.
- The proposal is in compliance with Section 1-3 of the
Weld County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive
plan; therefore, the proposed use is consistent with
efficient and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- North Weld Central Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from
Weld County Road 37
- The Weld County Health Department has indicated, in a
letter dated June l4, 1982, that both lots will have
adequate sewage capacity.

Dear Mr. Honn:
Please find enclosed a copy of the survey on which we wish to secure a
recorded exemption.
I represent Mile High Sheep Company, a Colorado corporation, Carroll Don
Godby and Ivan G. Collins, being the officers of the corporation.
It is our general belief that this recorded exemption would in fact fit
the general comprehensive plan of Weld County. The farmable farm land has
been rented for the last two or three years to a tenant who lives close by
and does not need the improvements presently situated on this quarter nor
does the tenant need, and/or use the approximate ten to twelve acres or
wet pasture land which lies just below south of the Collins Lateral Ditch.
Because of the fact the owners do not want to be in the rental business
in renting the two residences on the described exemption, they therefore
feel that this approximate fifteen acres could be used to a much better
advantage by an individual owner. The individual owner would certainly
do a much better job or maintaining the building and corrals than does
the present owners.

The exemption, I am sure, will not be in violation of any of the items in
paragraph II, A through M, of the Procedural Guide for Recorded Exemption
Application.
The property that we are requesting the recorded exemption for will be
used as a horse or small livestock operation. The use of the recorded
exemption would be consistent and compatible with the uses of the surround-
ing area.
