HomeMy WebLinkAbout20030647.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ERNEST PETERSON, OWNER, AND SCOTT PETERSON, TENANT, FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ernest Peterson, owner, and Scott Peterson, tenant, VI #0200315, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of March, 2003, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Ernest Peterson, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 11, 2003, to allow adequate time for the property owner to obtain a new Building Permit. Mobile Home building permits are only valid for 180 days. On February 20, 2003 an inspection was conducted; however, nothing was passed. As a result, this permit should be expired. While I understand that you are going through some personal hardships,it is not within our power through the Weld County Code to grant additional extensions. Until we receive a letter from you,the operator, this aspect of the violation will remain open. If you are no longer operating the"Landscaping Business",please submit a letter or e-mail stating this to be the case. Also all commercial equipment, including, but not limited to, the semi, semi trailers, materials (rock) and signs would need to be completely removed from the site. If you choose to remain in operation, a Use by Special Review application shall be completed and submitted. This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County Centennial Center,915 10th Street, Greeley, Colorado, It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. Mobile Home building permits are only valid for 180 days. However,due to unforseen reasons your permit is still active and will remain open until February 22, 2003. If you call for and pass an inspection prior to this date,the permit will remain open. If not, a new building permit and fees will be required. For heat he uses a number of space heaters . All in all the place is a real eyesore, not to mention that with the conditions described above , an accident waiting to happen. Could the County bring pressure on him to clean it up?
