This site plan review is approved with the attached conditions:
1. The Site Plan Review Map shall be prepared in accordance with Section 23-2-160.V of the
Weld County Code. Section 23-2-160.V.2 states the scale shall be one inch equals two
hundred feet, however, given the size of the property in question and the level of detail
required, the map shall be prepared at a scale of one inch equals twenty (1"=20') feet.

2. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
A. The applicant shall submit evidence to the Department of Planning Services, from
the Colorado Division of Water Resources demonstrating that the well is
appropriately permitted for commercial use. (Department of Public Health and

B. The applicant shall submit evidence to the Department of Planning Services, from
the Colorado Department of Transportation demonstrating that all issues and
requirements pertaining to access have been resolved to the satisfaction of this

C. The plat shall be amended to delineate the following:
1. This site will be required to meet all requirements of the American Disability
Act (ADA). ADA parking spaces are twenty (20) feet by eight (8) feet with
five (5) foot aisles. A minimum of one space must be van accessible with
an eight (8) foot aisle. An accessible path shall be required from the
building to the public right-of-way(1-25 Frontage Road). Further, the ramps
from the parking area shall identify a landing area for non-ambulatory users

2. The location of the existing detention pond shall be delineated on the Site
Plan. (Department of Public Works)
3. The applicant shall delineate the relationship between the landscape buffer
and the proposed alignment with the access drive. Further, clarification of
the location of the utility easement and the access drive shall be determined.
Should the utility easement also serve as the access easement,the parking
will not be allowed to back into the access drive travel lane. This situation
shall be clearly delineated on the Site Plan. (Departments of Planning

4. The applicant shall place a typical cross-section of the parking lot on the plat
and identify the depth of base and concrete or full depth concrete according
to the Weld County Code, Sections 8-2-40.A, Appendix 8-B. (Department

5. The vehicle parking and office area shall adhere to the Off-street Parking
and Loading Requirements, per Sections 23-4-20.B, 23-4-30.A, Appendix
23-A, 23-4-30. and 23-4-50 of the Weld County Code. (Department of

6. The applicant shall provide four(4) parking stalls for the employees of this
facility. The dimensions of the parking stalls shall adhere to Section 23-4-
30.B, Appendix 23-A of the Weld County Code. (Department of Planning

7. The applicant shall provide five (5) parking stalls for the Retail Sales Yard.
The area where this parking will be accommodated shall be identified and
the dimensions of the parking stalls shall adhere to Section 23-4-30.B,
Appendix 23-A of the Weld County Code. (Department of Planning

8. The applicant shall delineate the location of all curb stops in the parking
areas per Section 23-4-30.D of the Weld County Code. (Department of

9. The applicant shall adhere to the lighting requirements for off-street parking
spaces per Section 23-4-30.E of the Weld County Code. (Department of

10. The applicant shall adhere to the lighting standards, in accordance with
Section 23-2-250 and Section 23-3-250.B.6 of the Weld County Code.

11. The applicant shall delineate the location of the trash enclosure, in
accordance with Section 23-3-250.A.6 of the Weld County Code.

12. Should outside storage of vehicles, equipment or materials be permitted on
this property, the materials shall be screened from public rights-of-way and

D. The applicant shall include in the Landscape Plan in accordance with Section 23-3-
250.A.5, delineating the following information:
1. An installation schedule which specifies when the landscaping will be
installed on site. (Department of Planning Services)
2. A Plant Material List specifying the Botanical and Common names of all
plant material to be installed;the size of the plant material at installation and
whether the plant material is to be containerized or B&B. (Department of

3. A landscape maintenance schedule which specifically states who will
perform maintenance and that maintenance is on-going and shall not end
upon final acceptance by the Department of Planning Services.

The size, type and color of the gravel mulch shall be noted. (Department

5. The size of the metal edging, if applicable, shall be noted. (Department of

6. The method of native grass planting shall be called out as drilled or
broadcast and applied at a rate of how many pounds per acre, and/or

E. The following notes shall be placed on the plat:
1. In accordance with the Weld County Code, no land, building or structure
shall be changed in use or type of occupancy, developed, erected,
constructed, reconstructed, moved or structurally altered or operated in the
Commercial Zone District until a Site Plan Review has been approved by the

2. The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building is proposed to be
leased to another party in the future, the applicant shall submit a copy of the
lease agreement and information regarding the proposed use of the leased
portion to the Weld County Attorney's office, Weld County Building
Inspection Department, Mountain View Fire Protection District and the
Department of Planning Services for review. Based upon the proposed use
and/or impacts of the leased portion, the Department of Planning Services
may require a new Site Plan Review application. (Department of Planning

3. There shall be no parking or staging of trucks allowed on the 1-25 Frontage
Road. (Department of Planning Services)
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination. (Department of Public Health and Environment)
5. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid wastes Disposal Sites and Facilities Act, 30-20-
100.5,C.R.S.,as amended. (Department of Public Health and Environment)
6. Waste materials shall be handled, stored and disposed of in a manner that
controls fugitive dust, blowing debris and other potential nuisance

7. The facility shall adhere to the maximum permissible noise levels allowed
in the Commercial Zone District, as delineated in 25-12-103, Colorado
Revised Statutes. (Department of Public Health and Environment)
8. Fugitive dust and fugitive particulate emissions shall be controlled on this

8. The applicant shall operate in accordance with the approved "waste
handling plan". (Department of Public Health and Environment)
9. Adequate hand washing and toilet facilities shall be provided for employees
and patrons of the facility. (Department of Public Health and Environment)

10. Any septic system located on the property must comply with all provisions
of the Weld County Code, pertaining to Individual Sewage Disposal

A permanent, adequate water supply shall be provided for drinking and

12. Landscaping materials as indicated in the approved landscape plan shall be
maintained at all times. Dead or diseased plant materials shall be replaced
with materials of similar quantity and quality at the earliest possible time.

13. All structures, including signs, on site must obtain the appropriate building

Effective January 1, 2003, Building Permits issued on the proposed lots will
be required to adhere to the fee structure of the Weld County Road Impact

F. The applicant shall attempt to address the requirements(concerns)of the Mountain
View Fire Protection District, as stated in the referral response received May 14,
2003. Evidence of such shall be submitted in writing to the Weld County

G. The applicant shall submit evidence to the Department of Planning Services that all
conditions and requirements as indicated in the Department of Building Inspection
letter dated May 1, 2003 have been met. (Department of Planning Services)
H. The applicant shall submit a plan describing any proposed on-site signs. Any
proposed sign shall adhere to Sections 23-4-100 and 23-4-110 of the Weld County
Code. All proposed signs shall apply for and receive a building permit.

The applicant shall submit calculations for review by the Department of Public
Works for the storm water retention basin. The letter will need to be stamped by a

J. The applicant shall submit evidence to the Department of Planning Services
that all conditions and requirements as indicated in the Department of Public
Health and Environment letter dated May 8,2003 have been met. (Department

3. Prior to Recording the Plat:
A. The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for parking and
landscaping requirements. The agreement and form of collateral shall be reviewed
by County Staff and accepted by the Board of County Commissioners prior to

4. Prior to the release of building permits:
A. A Final Site Plan and building construction plans must be submitted to the Mountain
View Fire Protection District for review and approval. The applicant shall submit
written evidence of approval to the Department of Building Inspection. (Mountain

B. Upon approval by the Department of Planning Services, the Site Plan Review shall
be prepared per Section 23-2-260.D of the Weld County Code and submitted to the

C. The applicant shall submit two complete sets of blueprints to the Weld County
Department of Building Inspection. (Building Department)
D. Effective January 1, 2003, Building Permits issued on the proposed lots will be

E. The applicant shall receive approval from the Department of Planning Services for
a Geologic Hazard Permit, Permit Number GHDP-20. All requirements as outlined

Dear Applicant:
On May 28, 2003, your application for a site plan review was administratively approved by the Weld
County Department of Planning Services with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should
you choose not to complete the site plan review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel. Withdrawing applications will not generally affect future applications.

Based on the provided information,the Department of Planning Services Staff has determined that

The purpose of the application is to give the applicant an opportunity to demonstrate through written and
graphic information how the proposal complies with the standards of the Weld County Code. The following
supporting documents shall be submitted as a part of the application:
1. Site Plan Review application form (included in this packet);
2. A signed and notarized Site Plan Review certification form (included in this packet);
3. A copy of a deed or legal instrument identifying the applicant's interest in the property under
consideration;
4. A party wall agreement and legal description for duplex or triplex uses where units are held in
separate ownership;
5. A condo declaration and legal description for the condo, if applicable;

This one acre lot is raw land where a 3000sq.ft. building once stood. It has all the
electric, gas, telephone and water hook-ups as well as a septic tank available on the lot.
My business is selling steel buildings ranging from a garden shed to light commercial
structures. I want to erect three small scale steel buildings on this acre lot for display
purposes.
One 20ft./20ft. building with a half bathroom and a 10ft./20ft. mezzanine floor which will
serve as an office. The foundation for this building will be a concrete slab. There will be
gas heat and insulation in the bathroom and office. There will be phone and electric lines
running into the building as well. The second steel building is a 20ft./30ft. Barn that will
yI be strictly for display, for people to see, touch and feel the product. The third will be a
20ft./20ft garage display. They will have concrete piers for a foundation and a gravel
floor. . I will perform a solid cleanup project of the lot prior to building commencement.
There will be no manufacturing materials or stockpiling of materials happening on this
lot. Building components are shipped directly to the customer from the manufacturer.
Nothing polluting the environment will take place on this lot. It will serve as a small

14. In the event any payment required hereunder is not made within ten(10)days after the payment is due,a late charge in
the amount of 5%of the payment will be paid by the Tenant.
15. In the event of condemnation or other taking by any governmental agency,all proceeds shall be paid to the Landlord
hereunder,the Tenant waiving all rights to any such payments.
16. This lease is made with the express understanding and agreement that in the event the Tenant becomes insolvent,the
Landlord may declare this lease ended,and all rights of the Tenant thereunder shall terminate and cease.
17.The Landlord and Tenant further agree that the above premises are subject to an easement of 30 feet in width along the
north boundary. Landlord shall supply water not to exceed 250 gallons per day. It is understood and agreed that the water
is supplied by well and the Landlord assumes no liability for any lack of water due to power outage, pump failure,
inadequate supply,or any other reason.
18. In the event appropriate zoning approvals for said premises are not granted by Weld County Planning Dept.,tenant
may terminate this agreement with 30-day notice.
19.In the event of a sale under threat of condemnation,a condemnation,or other taking by any governmental agency,this
lease shall automatically terminate,and all proceeds or award shall be paid to the Landlord hereunder.The Tenant
expressly waives any and all right to any such proceeds or award.
20.Non-permanent building improvements remaining at end of this lease agreement,may be purchased at the discretion of
Landlord at a price set by Lyndal Steel Building,LLC(tenant),if no purchase agreement is made the non-Permanent
building improvements must be removed at expense of Lyndal Steel Building,LLC(tenant),.
SHOULD ANY PROVISIONS of this lease violate any federal,state or local law or ordinance,that provision shall be
deemed amended to so comply with such law or ordinance,and shall be construed in a manner so as to comply.
This lease shall be binding on the parties,their personal representatives,successors and assigns.

This Water Tap Lease and User's Agreement (hereinafter"the Agreement")
is made this 01 day of January, 2003, between Coronet Investment Co., Owner, (hereinafter
referred to as"Owner")and Lynda! Steel Buildings, hereinafter referred to as "User").
WHEREAS, Owner is the owner of water well No. 1-5774-F(hereinafter
referred to as"Owner's well"or simply as"the well"), situated in the County of Weld, State
of Colorado in the South Yz of the Southwest 'h of Section 23, Township One North Range
68 West,6th P.M., said well being located approximately 490 feet East and 235 feet North
of the Southwest Corner of said Section 23, and
WHEREAS, User own or is otherwise lawfully entitled to occupy and use
certain land(hereinafter User's Lot)also located in said County of weld, State of Colorado,
described as follows:
Lot Description: 2190 I-25 Frontage Rd, Erie, CO 80518, and
WHEREAS, Owner's well is connected to a main water line (hereinafter
referred to as the"Main")a portion or portions of which enter and cross User's Lot and to
which User has or can obtain access, and
WHEREAS, User, at its own expense, has heretofore tapped into the Main
and has established or may establish User's own lateral water line from the Main to User's
Lot and has received or may receive water from the Main for User's uses, either with
Owner's consent and acquiescence or pursuant to a written agreement with Owner, which
written agreement has now expired by its terms, and
WHEREAS, Owner acknowledges that the portion or portions of the Main
located within the User's Lot and User's lateral water line are the property of the User;
WHEREAS, User acknowledges that a limited number of other persons who
own or occupy and use Lots that are or may be served with water in the Main, have entered
into or may enter into agreements with Owner similar to this Agreement, by virtue of which
agreements such other persons are the holders of Water Taps, as herein defined, and
WHEREAS, User desires to continue receiving water from Owner's well for
specified uses and under written terms and conditions which are mutually understood by
Owner and User and which will be mutually beneficial of Owner and User, and
WHEREAS, User also desires that the other persons having Water Taps shall
continue to be able to utilize water from the Main pursuant to their agreements with Owner,

1. Definition of Water Tap:
For purposes of this Agreement a Water Tap is defined as follows:
(i) the contractual right to obtain water from the Main
by means of a connection between the Main and
User's lateral water line, and
(ii) the physical connection between the Main and
User's lateral water line, including all the valves,
meters,hardware and other equipment that
compromise such connection.
2. Owner hereby leases to User one Water Tap located or to be located
within or adjacent to User's Lot,together with an undivided one-tenth(1/10)interest in and
to all water that is produced from Owner's well and delivered into the Main.
3. The term of the lease is for a period of one year from the date first written
above, subject to all the terms and conditions set forth in this Agreement.
4. Subject to the physical and legal availability of water and to the limitation
in Paragraphs 7 and 8, Owner will continue to operate Owner's well and deliver water
produced from Owner's well into the Main for the use of User and the others who have
Water Taps on the Main. Owner does not warrant the production of water from Owner's
well or the delivery of water to the Main in any specific quantity and Owner makes no
warranty as to the suitability of the water that is or May be delivered to the Main for any
purpose. Owner's obligation to operate the well and deliver water to the Main shall be
suspended for any period of time in which Owner is prevented or delayed from doing so by
reasons beyond Owner's reasonable control. Nothing herein shall obligate Owner to
purchase augmentation water or to prosecute or defend any legal proceedings that may be
brought by or against Owner or Owner's agents,contractors or employees in any court or
before any agency.
5. Owner shall maintain Owner's well at Owner's expense and shall make
such repairs as are necessary within a reasonable time after notification by User of any
delivery failure caused by malfunctioning of Owner's well. Owner will provide reasonable
advance notice to User of any work by Owner on Owner's well that will result in
interruption of the delivery of water to the Main.
6. User shall be solely responsible for The costs and expenses of installation,
operation, maintenance and replacement of the portion of portions of the Main that are
located within User's Lot, User's Water Tap, User's lateral water line and any and all
portions of User's water system. Owner may, but shall not be required to provide
specifications for such work, including specifications for the proper installation of backflow
prevention devices,that will minimize the interruption of delivery of water in the Main past
User's Water Tap, in which event such work shall be performed by User in compliance with
such specifications. User shall install, maintain, operate, and replace the same in
accordance with Owner's reasonable specifications, if any, but in any event in accordance
with standards generally recognized in the industry in such a way as not to impede or
interfere with the delivery of water through the Main to other persons with Water Taps.
User shall provide notice to Owner in advance if any work that User intends to perform in

User's water system. User shall provide Owner with the physical means of discontinuing
delivery of water from the Main at User's Water Tap or at some other convenient location on
User's property. User hereby consents to Owner's entry onto User's property for purposes of
inspection and for enforcement of these Agreement by discontinuing delivery of water to
User in case of User's default as provided in Paragraph 10.
7. User shall be entitled to withdraw water from the Main at User's Water
Tap in an amount not to exceed 150 gallons per day. User may at its own expense install
water storage facilities on its own property to utilize the 150 gallons per day either for direct
use or for storage for User's domestic water requirements. For purposes of enforcement of
this provision Owner shall have the option to require User to install and maintain water
meters at or near User's Water Tap. Daily amounts shall not accrue or accumulate from one
day to the next. User acknowledges that drawing water from the Main at a rate in excess of
250 gallons per day would be detrimental to the rights of others persons with Water Taps on
the Main.
8. In the event that the production of water from Owner's well declines
because of a decline in the physical water supply to the well or because of limitations placed
on the production of water from the well by the State Engineer,the Division Engineer or the
Water Commissioner or for any other reason beyond Owner's reasonable control, Owner
may discontinue or ration the available water supply among the various persons, including
User,who have Water Taps on the Main. In such event Owner shall make proportionate
reductions in the monthly rent.
9. User shall use water from Owner's well solely for domestic and industrial
uses on User's Lot.
10. In the event of any failure or omission of User to comply with any of the
provisions of this Agreement, Owner, after 30 days' written notice to User of said default or
delinquency, may discontinue the delivery of water to User until the default or delinquency
is cured. If the default or delinquency is not cured after said 30 days' written notice, Owner
may permanently discontinue delivery of water to User and declare this Agreement
terminated. Owner shall have the right to bring appropriate legal proceedings for the
enforcement hereof. In such event the prevailing party in said proceedings shall be entitled
to recover from the other party the costs of such proceeding, including reasonable attorney's
fees.
11. Assignments and Sublease. There shall be no assignment or sublease of this
Agreement except as follows: User may assign or sublease this Agreement to any person
who purchases, leases or obtains the right of use and occupancy of User's Lot described
hereinabove and who agrees to be bound by the terms and conditions hereof. The
entitlement to water under this Agreement shall not be enlarged by virtue of any assignment
or sublease. No assignment or sublease shall be effective until User has given written notice
thereof to Owner. If User remains the owner of any interest in or in possession of any
portion of User's Lot after an assignment or sublease of this Agreement, User shall remain
liable for the performance of all of the obligations of User under the Agreement.

Dear Mr. Ogle:
We have reviewed the proposed sales office and metal buildings display area. Weld
County and the City of Dacono have common development standards for sites adjacent to
the I-25 Frontage Road. This site plan does not meet the applicable Baseline Standards.
The required commercial parking area setback from the Frontage Road property line is 50
feet. The 50-foot setback is to be landscaped including an earth berm of sufficient height
to screen the parking and storage areas from I-25. The proposed sign exceeds the
permitted height and exceeds the permitted area of the Baseline standards.
The City of Dacono finds that this proposed site plan does not meet the Baseline
Standards agreed to by Weld County and the cities and towns in this area. The City of
Dacono recommends denial of this site plan application.

Thank you for referring the Site Plan Review for Multiple Display Building and a Sales Office to
The City and County of Broomfield Planning Division for our consideration. After review of the
project and its location, we have the following comments.
The proposed site, in Weld County, is generally located northeast of Interstate 25 and Weld
County Road 6 and is surrounded on three sides by The City and County of Broomfield. More
specifically, the site lies within The City of Broomfield's Interstate-25 North Broomfield Sub-
Area Plan. This Sub-Area Plan was prepared in cooperation with Weld County and in
conjunction with the 1998 intergovernmental agreement with the Town of Erie. The Sub-Area
Plan designates the project site for Employment uses and establishes design standards for
these uses. In reviewing the proposed project, it is evident that it falls far short of meeting the
Sub-Area Plan's design standards. For example, buildings in this area should be of a much
higher quality and constructed with durable materials such as masonry.
In summary, I cannot support the proposed project and I encourage you to review the Sub-Area
Plan design standards and to apply these standards to this and other developments within the l-
25 planning area.

SPR-363
There are three historical permits on record for this parcel. One permit for a Mobile Home was
issued in 1982 and a permit to install gas line and heaters in an existing building was issued in
1982, both of which received final approval. A demolition permit was issued in 2001 and the
building was removed from the site.
1. Separate building permits shall be obtained prior to the construction of the buildings. A plan
review is required. Plans shall bear the wet stamp of a Colorado registered architect or
engineer. Two complete sets of plans are required when applying for the permit.
2. The buildings will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer. Engineered
foundations shall be designed by a Colorado registered engineer.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently, the following has been adopted by Weld County: 1997 Uniform
Building Code; 1998 International Mechanical Code; 1997 International Plumbing Code; 2002
National Electrical Code and Chapter 29 of the Weld County Code.
4. The building, parking areas and assess routes shall conform with the Americans With
Disabilities Act and CABO/ANSI A117.1-1992.
5. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.

I have reviewed the submitted material pertaining to the site plan for multiple display buildings
proposed for construction at 2190 East I-25 Frontage Road(Case Number: SPR-363, Case Name:
Goldberg). The Fire District has taken the position to oppose the construction or the moving in of
any additional buildings in this subdivision because there are no fire hydrants, and an inadequate
water for fire protection in this subdivision.
In accordance with the Uniform Fire Code, an approved water supply capable of supplying the
required fire flow for fire protection shall be provided to all premises upon which facilities,
buildings or portions of buildings are hereafter constructed or moved into or within the
jurisdiction. Water supply is allowed to consist of pressure tanks, elevated tanks,water mains or
other fixed systems capable of providing the required fire flow. The minimum required fire flow
for is 1,500 gallons per minute, measured at a residential pressure of 20 pounds per square inch,
for a duration of not less than 2 hours.
Should the applicant wish to construct the buildings in accordance with the provisions of the
Uniform Fire Code and provide the required fire flow, the District would not be opposed to the
project.

COMMENTS:
Access: Access to the existing facility is from the 1-25 Frontage Road between WCR 6 and
WCR 8.
REQUIREMENTS:
The applicant shall verify with the Colorado Department of Transportation as they have
jurisdiction over accesses to the state highways. Please contact Gloria Hess-Idler or Tess
Jones at the Greeley office to verify access permit requirements or for any additional
requirements that may be necessary to obtain or upgrade the permit.
Off Street Parking: The off street parking spaces including the access drive shall be surfaced
with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage
problems. The parking lot shall conform to all standards of the Americans With Disabilities Act.
Each parking space shall be equipped with a wheel guard or curb stop where needed to prevent
vehicles from extending beyond the boundaries of the spaces and from coming into contact with
other vehicles, walls, fences, or planting.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on
site in such a manner that will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a sales office and
multiple display buildings. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The existing septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
2. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The applicant shall operate in accordance with the approved "waste handling
plan".
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

I have reviewed your request for a replacement structure at 2190 I-25 Frontage Road. The Fire District
understands the replacement structure is necessary because an existing building was removed due to the
Interstate 25 expansion project#NH-IR(CX)025-3(109)Unit 3.
Other than one other replacement structure, the Fire District has not approved additional construction within
this subdivision since 1994 because required water supply for fire protection is not available. Because the
sales building is a replacement structure, will be of a smaller size than the original building and will be non
combustible construction, the Fire District will approve the sales building and two display buildings in
accordance with the following comments and stipulations.
Buildings shall be constructed in accordance with the provisions of the Uniform Fire Code, as ratified
by the Weld County Commissioners,and all other codes and ordinances,as enforced by Weld County.
A final site plan and building construction plans must be submitted to the Fire District for review and
approval before a building permit may be issued by Weld County.
The sales building shall be the only occupied building on the property. The other two buildings shall
be for sales display purposes only.
Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriff's Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was

Thank you for your letter of June 6,2003.
I have reviewed our records and was unable to find an access permit for your property located at 21901 125 Frontage
Road. It is likely that the access predates our State Highway Access Code,so no permit exists.
CDOT deems those types of accesses to be"grandfathered". Until the traffic volume using the access increases,CDOT
does not have the warrant necessary to require any changes. Based upon information you provided,it would appear the
volumes are not increasing. No changes at the access would appear to be warranted at this time.
If increased traffic volumes to the site are planned,please contact this office for re-evaluation of access. Re-evaluation
may require relocation,reconstruction or possibly closure.

Our MultiBuild Computer Software Package generates plans and
specifications and pricing to suit the above codes.
The Multibuild: specification sheet shows all relevant information
for your particular building including the size and gauge of all the
structural steel being used and the purlin and girt spacings for your
particular building.
The MultiBuild generated Bill of Material with each building
ensures the correct quantity of materials are supplied for each job.
MultiBuild generated elevation drawings and specifications are
available with each building for you to submit for building approval.
A large range of standard colours are available so that you can
personalise to suit yourself. Choose different colour walls, roof,
doors and trim at no extra charge. (see our attached colour brochure
for the latest range of designer colous)
Most of our range of quality steel buildings feature Galvanised
Portal Frame System for durability. strength and simplicity
