RE: ACTION OF BOARD CONCERNING SUBSTANTIAL CHANGE 23 REGARDING
CHANGE OF ZONE, PZ#613, FROM A (AGRICULTURAL) ZONE DISTRICT TO
PUD (PLANNED UNIT DEVELOPMENT) ZONE DISTRICT - CATTAIL CREEK
GROUP, LLC, CIO TODD HODGES DESIGN, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 8th of
October, 2003, at the hour of 10:00 a.m. in the Chambers of the Board, on behalf of Cattail
Creek Group, LLC, c/o Todd Hodges Design, LLC, 1269 North Cleveland Avenue, Loveland,
Colorado 80537, for the purpose of considering whether or not there has been a substantial
change in the facts and circumstances regarding the application for a Change of Zone, PZ #613,
which was denied by the Board of County Commissioners by Resolution dated October 2, 2002,
and
WHEREAS, said action was taken concerning property described as:
Lot C of Recorded Exemption #2537; being part of
the SW1/4 of Section 9, Township 6 North, Range
66 West of the 6th P.M., Weld County, Colorado
WHEREAS, said applicant was represented by Anne Best-Johnson, Todd Hodges
Design, LLC, and
WHEREAS, said hearing was conducted pursuant to the Board's policy concerning
applications for land use for property previously denied, as set forth in Section 2-3-10 of the
Weld County Code, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and, having been fully informed, finds that said
request to apply for a Change of Zone, PZ #613 shall be approved for the following reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has
demonstrated that a substantial change in facts and circumstances has
occurred, as follows:
A. The applicant originally proposed to create a Planned Unit Development
with eight (8) one-acre Estate lots and one (1) 121-acre Agricultural lot,
along with 30.13 acres of open space. The new proposal has the
following changes:
1) The applicant has increased the size of the eight (8) Estate zoned
lots to four (4) acres each.
2) The road has been relocated to the east.
3) Landscaping has been included in the open space between the
lots and adjacent home to the west.

4) Coal Bank Creek and the flood plain have been included in the
residential lots instead of the open space.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that there has been a substantial change in the facts and
circumstances regarding the application of Cattail Creek Group, LLC, do Todd Hodges Design,
LLC, for a Change of Zone, PZ#613.
BE IT FURTHER RESOLVED by the Board that the request of Cattail Creek Group,
LLC, do Todd Hodges Design, LLC, to apply for a Change of Zone, PZ #613 be, and hereby is,
approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of October, A.D., 2003.
