Beebe Draw Farms and Equestrian Center
Beebe Draw Farms and Equestrian Center is located on 4,300 acres of beautiful rolling hills
adjacent to the Milton Reservoir. The site provides the ideal setting for families to experience
the traditional values of a vanishing country lifestyle including an appreciation and respect for
the importance of Nature and Conservation.
PUD Approval
In December 1984, the Board of County Commissioners unanimously approved the Beebe
Draw Farms and Equestrian Center Planned Unit Development("PUD") for 803 residential
lots and recreational uses. Development was planned in multiple Filings with several phases
in each Filing.
The First Filing of 188 lots,open space and all community amenities was approved in 1985,
and an Amended Planned Unit Development District was approved in 1989 to include
permitted oil and gas production uses. Within each approval, the Commissioners
unanimously concluded that the plan was in conformance with the Weld County Zoning
Ordinance in that they:
i) were consistent with the Comprehensive Plan;
ii) were compatible with the existing and future development of the surrounding
area and;
iii) Conformed to the performance standards contained in the Zoning Ordinance.
Specifically, the Commissioners found that the PUD next to the Milton Reservoir with large
lots and horse lots could not be located within a municipality, that the low-density residential
uses permitted would be compatible with existing development and that adequate utilities and
services were available.
The Beebe Draw Farms Metropolitan District was created in 1986 to provide water, parks,
and recreational facilities, street and drainage improvements and related services. The
Petitioner acquired the property in 1994, and in 1999, the Board approved the creation of a
second Metropolitan District to provide services to a Second Filing.
Relying upon these approvals for a development of 803 residential units, the Petitioner,
through general obligation bonds of the Metropolitan District and private funds, invested
over$5.6 million dollars (see exhibit incorporated herein) to bring facilities sufficient in
capacity to serve the entire 803 lot project including gas lines, water storage and water lines,
roads,electricity and gas. Additionally, construction of an Entry House, Community Center
Building, and a Marina facility have been completed in anticipation of a full build-out of the
803 homesites.
Second Filing
In 1999, the Petitioner submitted its application for the Second Filing. The application
followed the plans that the Commissioners had unanimously approved in 1984, 1985, and
1989 with respect to density of residential development and the provisions for water, sewer,
streets and recreation.
The Weld County Department of Planning Services recommended approval of the Second
Filing Final Plan. However,the Board did not pass a resolution of approval at its September
13, 2000, hearing.
The Petitioner reviewed the concerns of the Board, redesigned the plan and resubmitted the
Second Filing for Substantial Change on December 19, 2001, and received unanimous
approval for a resolution of substantial change to the Plan.
Modified Second Filing Plan
Today, the Petitioner is submitting the modified Plan for final approval. This Plan
substantially addresses all of the issues and concerns voiced by the Board at the December 19,
2001 hearing and all previous hearings.
This modified Final Plan for the Second Filing of Beebe Draw Farms and Equestrian Center is
designed to preserve, protect and enhance the natural landscape of this scenic parcel adjacent
to the scenic Milton Reservoir.
The Plan for the Second Filing now being submitted provides:
a. 406 residential lots on 2,307 acres, a reduction of 130 lots from the originally
proposed 536 and 13 less than the 419 lots of substantial change resolution;
b. Over 1,000 acres of open space, representing 44% of the Second Filing;
c. Each lot is a minimum of 2.5 acres in size;
d. Increased responsibilities of the Metropolitan District to provide long-term
maintenance and operations of individual septic systems, the installation and
testing of monitoring wells to provide information regarding downstream quality
of underground waters, and ongoing education in the proper care and use of
systems for all new owners, including water-use conservation techniques;
e. Re-vegetation of all disturbed development areas by seeding, fertilization and
xeriscape landscaping at specific locations;
f. Letters for continuance of services for the Second Filing from schools, law
enforcement, fire and ambulance protection, Central Weld Water District and the
Weld County Health Department.
With this Final Plan, the Petitioner has met or exceeded all of the issues, concerns and
requests that the Board outlined in the December 13, 2001 hearing. Further, the Petitioner has
already invested millions of dollars and valuable resources on the basis of prior unanimous
Board approvals for the 803 lot development. The development will preserve the vanishing
county lifestyle within a quality community that will become one of the finest communities
in Weld County.
Now the Petitioner respectfully requests the Board's consideration for final approval of the
Beebe Draw Farms and Equestrian Center Second Filing.

1. DEFINITIONS

2. LATER DEFECTS
The Exceptions in Schedule B - Section 2 may be amended to show any defects, liens or
encumbrances that appear for the first time in public records or are created or attached
between the Commitment Date and the date on which all of the Requirements of Schedule B
- Section 1 are met. We shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B,
we may amend Schedule B to show them. If we do amend Schedule B to show these defects, liens
or encumbrances, we shall be liable to you according to Paragraph 4 below unless you knew of this
information and did not tell us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you
have met its Requirements. If we have any liability to you for any loss you incur because of an error

Dear Mr. Fell:
We have the following comments in regard to our agreement dated January 15, 1998:
1. The site will be deeded to Weld RE-1 on or before the recording of the plat for Filing Ni) 2 in the PUD.
2. The 36 acre site, more or less, is located on the site plan. A certified survey will be pre)ired at your
expense and furnished with the deed.
3. The site will be accepted by the district and the district is under no obligation to build a school on the
site and may use the site for any purpose. The acceptance of the site will not alter the o)ligation of the
district to provide public education to residents of Weld RE-1. The deed shall convey thi; site free of
any mortgages or deeds of trust and taxes will be paid to date of closing.
All communications with Mr. Morris Burk and yourself have been very open and cordial. You hat a met each and
every request positively. You have provided a central pick up point for current students and will pi c vide
additional ones, with our approval, as the project develops. It has been a pleasure working with yo l and your firm.

RE: Water System for Filing II, Beebe Draw Farms Metropolitan District
A potable water system has been designed and provided to Milestone Engineering to be included
in the preliminary plan submittal to Weld County for the referenced project. The letter is to
certify that this system has been prepared to a level that indicated the size of lines required to
provide adequate flow for domestic use and fire protection based on the existing and proposed
infrastructure of the water provider, Central Weld County Water District, and per the LaSalle
Fire Protection District.
The above referenced plans do not show the detail that will be required of final drawings,
including class of pipe and type,valves, fittings, fire hydrant locations, pressure reducing valves,
blow-off, and appurtenances. The details will be added to final drawings prepared for each
Phase of Filing H. Easements for the system are to be provided on the subdivision plat.
